What Happens if I stop paying?


There is a set procedure for when Council Tax is not paid.

First of all they issue a FAKE summons, then whether you attend or not they issue a FAKE Liability Order. The FAKE court does not operate under either Civil Procedure Rules or Criminal Procedure Rules, it operates solely under The Local Government Finance Act 1992, which is obviously not a set of rules for a REAL court.


When threatened with FAKE court action you should contact the Council (A real person at the Council) and challenge the jurisdiction of the court action:

  • "We see from your letter that you intend to take legal action to recover this alleged debt. Be aware that, if you do pursue a legal action, in civil jurisdiction, that all records of any court action that is initiated by you will be monitored by ourselves under 'Civil Procedure Rules r.5.4 (1) & Civil Procedure Rules r.5.4.2. Any actions taken by you or any other representative of your company that is in breach of Section 2 (1) (a) of the Fraud Act 2006, will be reported to the correct authorities."

The civil procedure rules cover your access to court documents. If the council claim to have a liability order against you, then you can enter a request, in writing under these rules, to see any judgments against you. Those that have done so have found that no judgment was made against them because the 'court' is bogus and hired privately by the councils. Some of you may have noticed that when you get notification of 'court' proceedings that they encourage you to NOT attend court. Not surprising, because they do not want you to challenge the nature of the court and the jurisdiction.

The next step after that is to instruct a Debt Collection Agency - FAKE bailiff. They will try to enter your home, but can only do so with your permission, to levy goods. The first possession they target is a car which they could clamp if it is on your driveway or the road. They cannot clamp or remove a car from private property belonging to someone else.

THERE IS NO COURT ORDER


This is a request sent to the court in 2014 requesting a copy of the Liability Order. The court do not possess it because they did not issue it. The letter clearly states that the "Council who issue the Liability Orders", NOT the Courts!

Section 68 of the Tribunals, Courts and Enforcement Act 2007.68 Magistrates' courts warrants of control In the Magistrates' Courts Act 1980 (c. 43) after section 125 insert— Warrants of control (1) This section applies to a warrant of control issued by a justice of the peace.(2) The person to whom it is directed must endorse the warrant as soon as possible after receiving it. (3) For the purposes of this section a person endorses a warrant by inserting on the back the date and time when he received it. (4) No fee may be charged for endorsing a warrant under this section.

So a FAKE Bailiff (debt collector) collecting Council Tax can be challenged under Section 2.

Never let the Debt Collector in or sign any of their paperwork. There is simply no reason for you to deal with the Debt Collector at all. He is just there to threaten bully and add on huge fees. Only deal directly with the Council on Council Tax issues.

Ask to see the Letter of Authority

They have no court order of any kind. Always ask to see the letter giving them authorisation, many don't have or carry it. 45- (5) The person levying distress on behalf of an authority shall carry with him the written authorisation of the authority, which he shall show to the debtor if so requested;

If the debt collector can't get hold of you to contract and make an arrangement to pay (plus his huge fees) then the matter goes back to the Council who try to enforce via attachment of earnings. But you don't have to wait for it to be passed back, you can request that the Council takes it back with THIS LETTER.

ATTACHMENT OF EARNING/BENEFITS

The Council Tax (Administration and Enforcement) Regulations 1992 (Regulation 32 and 38 to 42 to justify issuing an attachment of earning to an employer, they must first have a Liability Order (they have a FAKE one ). If you are on benefits the Deduction from benefits can be done by the DWP under Schedule 9 of the Social Security (Claims and Payments) Regulations 1987 . This does not require the DWP to go to a court, it does require the Council to provide details of the Court judgement. The Council and DWP can share information under Section 131 of the Welfare Reform act 2012.

Your employer can also take an extra £1 for each deduction for their administration costs.

The Council can send a maximum of 2 orders at any one time.

Because the whole Council Tax enforcement is based on a LIE as in there is not LIABILITY ORDER. All the employer has to do is ask to see the court documents backing up the Councils request for an Attachment of Earnings. There simply is NONE.

So go to the County Court and ask them for a copy of all judgments against you, the Council one will not be listed. That should be enough evidence to motivate your employer to request the court documents from the Council. Some employers will do this:

This process is repeated for each year you do not pay and every visit the FAKE bailiff makes is recorded and can be used as evidence that the Council has attempted to collect the debt they claim is owed. If ALL else fails, the Council can apply to have person committed to prison for non payment if they a) have had the means to pay and b) have refused to pay or are culpably negligent in paying the debt. So the worst method of dealing with Council Tax is ignoring it. They can also apply for Bankruptcy.


VICTORY IN COUNTY COURT AGAINST COUNCIL TAX

Though in a recent ruling in Nottingham, the Council's case was thrown out due to lack of any proof that there was any service of a "Statutary Demand" i.e The Fake Liability Order was not served on the person they were trying to make bankrupt (It never is because it is just a list of names!):

Whatever you do NEVER refuse to pay. You can legally "Withhold" payment but it is an offence to refuse to pay.


The first way to address Council Tax

If you are struggling to pay is to make an application for a discount under Section 13a of the Local Government Finance Act 1992, for a discount to ZERO. You can set out all the reasons for requiring the discount and the Council have to give due consideration to your application. If they do not deal with this application correctly, they cannot legally progress any claim against you, so make a detailed record of their response to your application. Send it to the "151 officer" who is normally the Chief Financial Officer.


What if I am Vulnerable?

Never deal with the debt collector (FAKE bailiff) as they will just add on huge fees. If you are Vulnerable, they are not allowed to "Levy Distress" and the matter has to be dealt with by the Council. So check if you are vulnerable and bear in mind that anyone who has an illness that lasts longer that 12 months is considered disabled under the Disability Discrimination Act 1995.

You may be vulnerable if:

- you’re disabled

- you’re seriously ill -you have mental health problems

- you have children or are pregnant - especially if you’re a single parent

- your age makes it hard for you to deal with bailiffs - usually if you’re under 18 or over 65

- you don’t speak or read English well

- you have had a recent bereavement in the family

How to challenge

If you have an attachment of earning or benefits, or being threatened with Bankruptcy or Prison, the key document to challenge is the Liability Order, it simply does not exist as a document. What the Council has is a list of names of all people who did not pay the Council tax in that year, which is rubber stamped by a Private Administrative Hearing, that is conducted in many cases in the rooms normally used by the Magistrates Courts.

The best way to start to challenge the Council Tax is to make an application for a discount under Section 13a of the Local Government Finance Act 1992, here is a sample application pointing out that Councils are Funding Terrorism.

If the application is turned down, you can appeal the decision to an Independent Valuation Tribunal.
