CooKing: Pantry & Meal Plan Application Terms and Conditions

1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your use of the CooKing: Pantry & Meal Plan mobile and web applications (“CooKing”, “the App”) provided by Rares Soponar. By downloading, installing, accessing, or utilizing CooKing, you signify your agreement to be bound by these Terms. If you do not agree, you are prohibited from using the App. Where CooKing is accessed via an application store (such as Google Play or Apple App Store), your use is additionally subject to that store's terms and policies.
2. Description of the Application
CooKing serves as a personal cooking and meal-planning assistant, enabling users to:
Create and manage recipes;
Track pantry inventory and expiration dates;
Establish and manage shopping lists;
Plan meals utilizing a calendar interface;
Receive scheduled reminders and notifications;
Capture recipes from photographic images and web sources;
Optionally utilize voice input and automated parsing for pantry and shopping items;
Synchronize data across multiple devices via cloud services.
Note: Certain advanced functionalities are reliant upon third-party services, including Firebase, text recognition, recipe parsing, and unit conversion.
3. Account Creation and Responsibilities
Access to specific features mandates the creation of an account, requiring an email address and password or utilization of supported social login providers (Google or Apple).
You agree to:
Provide information that is accurate and current;
Maintain the strict confidentiality of your login credentials;
Promptly update your information following any changes;
Immediately notify us upon suspicion of unauthorized access to your account.
You assume full responsibility for all activities transpiring under your account. We shall not be held liable for losses incurred due to unauthorized access resulting from your failure to safeguard your credentials.
4. Free Tier (Current Status)
As currently implemented, CooKing operates exclusively as a free tier application:
You are permitted to create recipes, manage pantry items and shopping lists, and plan meals without incurring any payment obligation. Your content is stored locally on your device and, upon signing in, is synchronized with Firebase to facilitate cross-device access. No in-app purchases or paid subscriptions are currently processed by the App. We reserve the right to introduce supplementary limitations, features, or tiers in subsequent releases.
5. Premium Tiers and Subscriptions (Planned Features)
The project documentation includes internal planning for potential Premium and Pro tiers. As of the current codebase:
No billing or subscription logic has been implemented.
No payments are collected by the App.
Should paid subscriptions become available:
5.1. Subscription Purchase and Billing
Subscriptions will be procured through the respective platform’s store (e.g., Google Play or Apple App Store). The store’s terms (including provisions for billing, cancellation, and refunds) shall apply. We shall not receive your complete payment details; we will receive only purchase identifiers and status information.
5.2. Planned Subscription Structure (High-Level, Subject to Modification)
Free: Features limited storage capacity for recipes/pantry/lists and a minimal persistent allowance for AI-powered operations.
Premium: Offers elevated or unlimited storage, increased AI allowances, and comprehensive sync and export capabilities and many more features.
5.3. Auto-Renewal and Cancellation
Subscriptions shall auto-renew at the conclusion of each billing period unless cancelled by you through the app store. You may effect cancellation at any time; access to paid features will persist until the end of the current billing cycle. Refunds, if any, shall be handled exclusively by the app store pursuant to its established policies.
5.4. Changes
We reserve the right to modify subscription pricing, features, or structure. Such modifications shall not apply retrospectively to completed billing periods.
Once subscriptions are officially launched, updated Terms and in-app disclosures will meticulously clarify the exact operational details. Until such time, all users are utilizing the free tier.
6. AI and Automated Processing – Disclaimers
CooKing employs automated systems and third-party services for tasks such as OCR, recipe extraction, parsing, and unit conversion.
You acknowledge and concur that:
AI and OCR outputs constitute mere suggestions. You are obligated to review and, where necessary, modify ingredients, steps, units, and quantities prior to reliance upon them.
We provide no guarantee concerning the correctness of recipes, ingredient lists, nutritional information, units, or translations.
You bear sole responsibility for verifying that recipes and ingredient quantities are safe and appropriate for your specific needs, encompassing allergies, dietary restrictions, and kitchen safety.
Under no circumstances should the App be utilized as a source for medical, dietary, or allergen advice.
7. User Content and Ownership
7.1 Ownership
As between you and us, you retain full ownership of:
Recipes you originate or import;
Pantry inventory records;
Shopping lists;
Notes and all other content entered into the App.
By utilizing the App, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely for the purpose of operating and enhancing the App (including for backups, analytics, and debugging).
7.2 Responsibility for Content
You are exclusively responsible for the content you input, upload, or import, including the assurance of:
Possessing the requisite rights to copy recipes or other texts from websites;
Non-infringement of third-party intellectual property rights by your content;
Compliance of your content with applicable laws and the regulations of the app stores.
We do not engage in active monitoring of all content but reserve the right to remove content or restrict access should we reasonably believe it violates these Terms or applicable law.
8. Prohibited Activities
You covenant not to:
Utilize the App in any unlawful manner or for any unlawful purpose;
Attempt to reverse-engineer, decompile, or otherwise obtain the source code beyond what is legally permissible;
Circumvent, disable, or interfere with security-related features;
Upload, store, or transmit content that is illegal, harmful, abusive, defamatory, obscene, or infringes upon any intellectual property or privacy rights;
Employ the App for the distribution of unsolicited communications or spam;
Misuse AI features (e.g., attempting to generate harmful content or abuse third-party APIs);
Attempt to gain unauthorized access to other users’ data, our systems, or third-party services;
Use the App for commercial multi-user operations (e.g., as a back-end system for a restaurant) without our prior written consent.
We may investigate suspected violations and shall cooperate with law enforcement agencies as required.
9. Service Availability and Changes
CooKing is provided on an “as is” and “as available” basis. We offer no warranty that:
The App will be perpetually available or without interruption;
The App will be devoid of errors, bugs, or security vulnerabilities;
Specific features will remain available indefinitely.
We reserve the right to modify, suspend, or discontinue the App or any segment thereof at any time, with or without notice, including for reasons of maintenance, security, or business strategy. Where feasible, we shall exert reasonable efforts to notify you of significant changes.
10. Intellectual Property
Excluding your own content, all rights, title, and interest in and to the App are owned by Rares Soponar or its licensors, encompassing the App’s name, logos, branding, user interface design, underlying software, code, and documentation.
You are prohibited from using our trademarks, trade dress, or branding without our prior written consent, except as strictly necessary to identify the App on your device or within app stores.
11. Third-Party Services and Links
The App incorporates various third-party services (e.g., Firebase, Google ML Kit, AI APIs). Your utilization of these services through the App is governed by their respective terms and privacy policies. We assume no responsibility for their content, accuracy, or practices. The App may contain links to external websites (e.g., recipe pages you import). We do not control and are not accountable for the content or practices of those websites.
12. Termination
You may cease using the App at any time by uninstalling it and, where applicable, logging out of your account. We reserve the right to suspend or terminate your access to the App, with or without notice, if:
You materially violate these Terms;
We are mandated to do so by law or by an app store;
We discontinue the App.
Upon termination:
Your right to use the App shall immediately cease;
We may delete or anonymize your account data after a reasonable period, subject to legal retention requirements and our Privacy Policy.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMISSIBLE BY LAW: THE APP IS FURNISHED “AS IS,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPLICITLY STATED, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR QUIET ENJOYMENT.
We do not warrant that recipes or ingredient data are accurate, complete, safe, or suitable for any particular diet or health condition. We offer no warranty that AI, OCR, or parsing features will invariably produce correct, complete, or appropriate outputs. Your use of the App is entirely at your own risk. You are personally responsible for verifying ingredient quantities, cooking methods, and any other information before relying upon it.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMISSIBLE BY LAW, IN NO EVENT SHALL Rares Soponar, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR PARTNERS BE HELD LIABLE FOR:
ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
ANY DAMAGES ARISING FROM OR IN CONNECTION WITH:
Your use of or inability to use the App;
Any content or information obtained through the App;
Unauthorized access to or use of your account or content.
Certain jurisdictions prohibit specific limitations of liability; in such cases, the aforementioned limitations shall apply solely to the extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Rares Soponar and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or in any way connected with:
Your use of the App;
Your violation of these Terms;
Your violation of any rights of another person or entity;
Your content or misuse of AI/OCR features.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without reference to its conflict of law principles. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in [Jurisdiction], unless otherwise required by applicable consumer-protection laws.
17. Changes to these Terms
We may periodically revise these Terms. Upon revision, we will update the “last updated” date and, where deemed appropriate, furnish additional notification (for example, via an in-app notice or app store update notes). Your continued utilization of the App subsequent to the effective date of the changes signifies acceptance of the updated Terms. If you do not concur with the changes, you must discontinue using the App.
