Welcome to Conkers Duel ("the Game"). These Terms of Service ("Terms") are an agreement between you and the developer of Conkers Duel ("we", "us", "our"). By downloading, installing or using the Game — and in particular by using its online features — you agree to these Terms. If you do not agree, please do not use the online features.
The Game is intended for players aged 13 and over. If you are under 18, you confirm that a parent or guardian has read and agreed to these Terms on your behalf.
Conkers Duel is meant to be fun and fair for everyone. When using the Game, and especially its online play, leaderboards, tournaments and social features, you agree that you will NOT:
- cheat, exploit bugs, tamper with the game or its network traffic, or use unofficial software to gain an advantage or to falsify scores or rankings;
- choose a display name ("handle") that is offensive, hateful, harassing, obscene, impersonates another person or team, or that a reasonable person would find inappropriate;
- harass, threaten, abuse or bully other players;
- attempt to disrupt, overload, attack or gain unauthorised access to our servers or services;
- use the Game for any unlawful purpose.
Conkers Duel does not require you to create an account or provide personal details. A random player identifier is generated on your device to run online features. You are responsible for the display name you choose and for activity that takes place through your device.
We may, at our discretion and without prior notice, remove content (such as an inappropriate handle), suspend, restrict or permanently ban your access to online features — including leaderboards, tournaments and multiplayer — if we reasonably believe you have breached these Terms or the Fair Play rules, or to protect other players or our service. Removal or banning for a breach of these Terms does not entitle you to any refund (see section 6).
Online features depend on internet connectivity and on our servers, which are provided on a best‑efforts basis. We do not guarantee that online features will always be available, uninterrupted or error‑free, and we may change, suspend or withdraw online features at any time. Offline play against the computer, and local same‑room play, do not require our servers.
The Game may offer optional paid items, such as a Premium upgrade that unlocks additional cosmetics and features. Any purchase is a limited, personal, non‑transferable licence to use that content within the Game — you do not own the content itself. Payments are processed by Google Play, and Google's terms and payment policies also apply to your purchase. All core gameplay is available free of charge; purchases are optional and do not affect the outcome of duels.
Refunds for purchases are handled by Google Play in accordance with Google's refund policies, which apply regardless of these Terms. Beyond any right you have under those policies or under applicable consumer law, purchases are non‑refundable. In particular, if your access is suspended or banned because you breached these Terms, you will not be entitled to a refund for any unused or lost premium content.
The Game, including its design, graphics, code and characters, belongs to us. You are given a personal, non‑exclusive, non‑transferable licence to use the Game for your own entertainment. You may not copy, modify, distribute, reverse‑engineer or create derivative works from the Game except as allowed by law.
The Game is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties not expressly stated here, and we are not liable for any indirect or consequential loss, or for loss of data or progress. Nothing in these Terms limits any liability that cannot be limited by law, including your statutory consumer rights.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and continued use of the online features after a change means you accept the updated Terms.
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the courts of England and Wales, unless mandatory local consumer law in your country of residence provides otherwise.
