Non-compliance with the payment of rent

When a Tenant fails to pay rent, a Landlord can ask the court to evict the Tenant and request money damages for rent, late payments, and court expenses. The Landlord can file a lawsuit immediately after the Tenant defaults on the rent.

Initial steps to follow:

File a Demand for Non-compliance with the Rent to the Landlord. The Complaint must be completed in its entirety and served in the District Court of the county in which the property is located.

Now the summons and complaints are served by mailing or posting if the required action is only the repossession of the property.

Solutions:

Eviction: A landlord must file a “Request for Restitution Order” after a judgment is entered against the Tenant.

Right of foreclosure to rescue it: If the Tenant has a certain number of judgments against him for not paying the rent, the Landlord can evict even if the Tenant wants to pay the rent by issuing an Eviction Notices Dubai.

Breach of the rental agreement

When a Tenant breaches the rental agreement, the Landlord can request that the court evict the Tenant. This process can only be used to seek an eviction.

Notice of rental contract violation: The Landlord must give the Tenant a 30-day written notice before filing the Lawsuit or 14-day written notice for a breach of the rental agreement that causes a clear and imminent danger of serious harm others or property.

If the Tenant does not leave the property within 30 days, the Landlord can file a Complaint and Summons against the Tenant for Breach of the Rental Agreement. A copy of this notice must be attached to the complaint.

The claim must be completed in its entirety and served in the District Court of the county in which the property is located.

Tenant Defense: Landlord threatens to sue, evict, increase rent, or reduce services (electricity, heat, etc.) of the Tenant due to the Tenant's claim for a violation related to the rental property.
