These Terms of Service ("Terms") govern your use of the ColourMe mobile application ("App") operated by ColourMe Apps ("we," "us," or "our"). By downloading or using the App, you agree to these Terms.
1. ABOUT THE APP
ColourMe is a mobile application that converts personal photos into line art colouring pages using artificial intelligence. The generated pages are designed for printing and colouring with real crayons. The App is intended for use by families, with children using the App under parental supervision.
2. ELIGIBILITY AND CHILDREN'S USE
The App is designed for families with children. All purchases and account-related decisions must be made by a parent or legal guardian aged 18 or older. Children should use the App under the supervision of a parent or guardian. We do not knowingly collect personal information from children without parental consent.
3. FREE TRIAL AND SUBSCRIPTIONS
The App offers 5 free colouring pages upon download. After the free pages are used, a paid subscription is required to generate additional pages.
We offer the following subscription plans:
Monthly: $5.99 per month (25 pages per month)
Yearly: $22.99 per year (250 pages per year)
Subscriptions are billed through Google Play and automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Google Play account settings.
Prices may change from time to time. We will notify you of any price changes before they take effect.
4. REFUNDS
Refunds are handled by Google Play in accordance with their refund policies and applicable consumer protection laws, including the Australian Consumer Law. If you are unsatisfied with the App, you may request a refund through Google Play.
5. AI-GENERATED CONTENT
The colouring pages generated by the App are created using artificial intelligence. Results may vary between uses, even with the same input photo. We do not guarantee specific outcomes or consistent quality for every image generated.
Your photos are sent to a third-party AI service for processing. Photos are processed in real time and are not stored by us or our AI provider after the colouring page has been generated.
6. YOUR CONTENT
You retain ownership of any photos you provide to the App. By using the App, you grant us a limited licence to process your photos solely for the purpose of generating colouring pages. We do not store, share, or use your photos for any other purpose.
The generated colouring pages are yours to print, share, and use for personal, non-commercial purposes.
7. ACCEPTABLE USE
You agree not to use the App for any unlawful purpose, attempt to reverse-engineer, modify, or tamper with the App, use the App to generate content that is harmful, offensive, or inappropriate, resell, redistribute, or commercially exploit the generated colouring pages without our permission, or share your subscription credentials with others.
8. INTELLECTUAL PROPERTY
The App, including its design, branding, code, and logo, is owned by ColourMe Apps. You may not copy, modify, or distribute any part of the App without our written permission.
9. DISCLAIMER OF WARRANTIES
The App is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, uninterrupted, or free of harmful components. AI-generated content may not always meet your expectations.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, ColourMe Apps shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability for any claim related to the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.
11. CHANGES TO THESE TERMS
We may update these Terms from time to time. The updated version will be indicated by an updated date at the top of these Terms. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
12. TERMINATION
We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App and cancel your subscription at any time through Google Play.
13. GOVERNING LAW
These Terms are governed by the laws of Western Australia, Australia. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Western Australia.
