CO Driver Training

Terms and Conditions of Driving Tuition

Business: Csaba Ortutay trading as CO Driver Training (sole trader)

Effective from 7 October 2026

These Terms apply to bookings accepted from this date after they have been supplied to you. Existing accepted bookings and prepaid agreements keep their agreed terms unless we expressly agree otherwise.

Please read these Terms before booking. They explain how lessons are booked, paid for, cancelled and supplied. Your statutory consumer rights are not reduced.

Key booking points
Give at least 48 hours' notice to cancel an ordinary lesson without charge. A late-cancelled or missed ordinary lesson will normally be charged at the full lesson price, reduced if I am able to avoid or recover the loss. Use of my car for a practical test is never automatic and must be confirmed. The fixed test-day fee is £100 for test centres within my normal working area; extra travel charges may apply outside that area. A learner-requested test cancellation or change within 48 hours will normally be charged at the full £100 test-day fee. Changes made by DVSA are treated separately. Statutory cancellation rights take priority where the law requires them to.

1 Who the contract is with

1.1 Business. The contract is with Csaba Ortutay, a sole trader trading as CO Driver Training. References to "I", "me" or "my" mean Csaba Ortutay trading as CO Driver Training.

1.2 Professional status. I am registered with the Driver and Vehicle Standards Agency (DVSA) as an Approved Driving Instructor (ADI) and may provide paid driving instruction.

1.3 Learner. "You" means the person receiving tuition. These Terms are intended for driving tuition bought wholly or mainly for personal purposes. Separate written terms may apply to instructor training or other business services.

1.4 Payer. If another person books or pays for tuition and expressly accepts responsibility for payment, that person is the "Payer". A parent or guardian does not become liable merely because the Learner is under 18.

1.5 Learners aged 16 or 17. Under Scots law, a person aged 16 or over generally has legal capacity to contract. I may require an adult Payer where another person is to be responsible for payment or where the Learner does not have legal capacity under the applicable law.

1.6 When a booking is confirmed. A lesson I place in the booking system following your request or agreement is confirmed. If you claim an advertised open slot yourself, that booking confirms the lesson. I may propose a different start time or order of lessons on the same day where travel between pupils would otherwise be unreasonable or impractical. I will tell you as soon as reasonably possible. Any change requires your agreement. If the proposed time does not work for you, the original booking will be honoured or you may cancel without charge and receive a refund or credit. A routing change will not increase your agreed price or remove an agreed discount. The booking record will identify manual or automatic tuition, the duration, applicable price and agreed meeting point. The Terms supplied before acceptance apply. I will provide a copy you can save by email or another durable medium before tuition starts.

1.7 Specific agreement. If a specific booking record or written agreement clearly changes one of these Terms, that change applies only to that booking or matter.

2 Licence, eyesight, health and fitness to drive

2.1 Driving entitlement. You must hold a valid licence that legally permits the tuition and must present it, or permit an appropriate entitlement check, before the first lesson and when reasonably requested. You must promptly tell me if your entitlement is restricted, suspended, revoked or otherwise changes.

2.2 Eyesight. You must meet the legal eyesight standard for driving and wear any required corrective lenses during tuition and a test.

2.3 Health and medication. You must tell me, to the extent reasonably necessary for safe and lawful tuition, about a health condition, disability, injury, fatigue or medication that may affect driving. You remain responsible for notifying DVLA where the law requires it and for following medical advice about driving.

2.4 Impairment. You must not drive while affected by alcohol, illegal drugs, medication, illness, fatigue or any other condition that makes driving unsafe or unlawful.

2.5 Reasonable adjustments. I will discuss reasonable adjustments for a disability or access need. Adjustments cannot remove legal licensing, eyesight, vehicle-safety or driving-test standards.

2.6 Stopping a lesson. I may stop or refuse a lesson where I reasonably believe driving would be unlawful or unsafe. A charge will be made only where permitted by these Terms and will not exceed my reasonable net loss, taking account of the circumstances and any legal duty to make reasonable adjustments.

3 Bookings and lesson arrangements

3.1 Booking channels. Bookings may be made or requested by telephone, text or messaging service, email, social media or any booking system I make available. A booking is confirmed as described in clause 1.6.

3.2 Regular lesson times. I will try to offer continuity, but a regular weekly slot is not guaranteed unless the individual lesson has been accepted. Availability may change.

3.3 Lesson duration. Standard manual tuition is normally booked in two-hour lessons. Standard automatic tuition is normally booked in 90-minute lessons. A one-hour manual lesson is available only in special circumstances and must be agreed by me in advance. Any other lesson duration must be specifically agreed before the booking.

3.4 Meeting point. Lessons start and finish at a meeting point previously agreed between you and CO Driver Training. The location will be confirmed before the booking is accepted and may be a designated local meeting point. Any different start or finish location must be agreed in advance. I may decline a requested change where timing, distance, safety or another accepted appointment makes it impractical. Any additional charge must be disclosed and agreed before the booking or location change is accepted. Reasonable adjustments will be considered under clause 2.5.

3.5 No guarantee of a pass or test date. I will provide tuition with reasonable care and skill, but I cannot guarantee a particular rate of progress, a practical-test appointment or a pass result.

4 Prices, payment and receipts

4.1 Standard lesson prices. Manual tuition is £43 per hour, normally £86 for a two-hour lesson. A prepaid 10-hour manual block is £400. Automatic tuition is £75 for a 90-minute lesson. A prepaid 15-hour automatic block is £720. These prices apply in the eligible time bands in clause 4.7. The applicable lesson type, duration and total price will be clear before booking. The £100 practical-test fee is covered separately in section 10.

4.2 Payment time and method. Payment is due in advance by bank transfer or cash unless I agree otherwise in writing. I do not accept cheques.

4.3 Additional charges. No booking, administration or other mandatory fee will be added unless it was included in the total price disclosed before acceptance.

4.4 Price changes. I may change prices for future, unaccepted bookings by giving at least 14 calendar days' notice. A change will not affect tuition already accepted or prepaid. You may stop making future bookings and obtain a refund of unused prepaid tuition if you do not accept a future price.

4.5 Receipts and outstanding sums. I will provide a receipt on request. I may decline further bookings while an undisputed payment is overdue, but this does not affect your right to dispute a charge.

Student discount

4.6 Student prices and eligibility. Current students may book manual lessons at £70 for two hours or automatic lessons at £65 for 90 minutes. Student prices are available only for weekday lessons starting from 08:00 and before 13:00, subject to available appointments. I may ask for reasonable evidence of current student status before confirming the discount. Student prices are separate from block prices and cannot be combined with another discount or promotional offer. The agreed discount applies for the confirmed booking.

Lesson time bands

4.7 Times and applicable prices. The following bands refer to the scheduled lesson start time, in local UK time. Weekdays are Monday to Friday; weekends are Saturday and Sunday. A start exactly at a boundary belongs to the later band. These bands describe pricing eligibility and do not guarantee that I work or have appointments available on every listed day. The full lesson duration and end time must be agreed before booking.

Peak-time lessons

4.8 Peak-time prices and availability. Peak-time lessons cost £95 for two hours of manual tuition or £85 for 90 minutes of automatic tuition. Peak-time slots are subject to availability. Student discounts, standard block prices and promotional offers do not apply to peak-time slots. Prepaid standard block hours cannot be used for peak-time lessons; any peak-time booking is priced separately and confirmed before acceptance.

Promotional offers

4.9 One promotional offer per learner. Promotional offers vary and are advertised separately. Each learner may claim one promotional offer once in total, rather than once per campaign. Offers must be booked and used during standard working hours: weekday lesson starts from 08:00 and before 18:00, or weekend starts from 08:00 and before 15:00. Peak-time slots are excluded. Any price, included duration, eligibility condition, claim deadline or use-by date will be clearly disclosed before you accept or pay. Offers cannot be combined with student discounts, block discounts or another promotion. Changing or withdrawing an offer does not alter an offer already accepted. Cancellation, refund and statutory rights under these Terms still apply.

4.10 Prepaid hours and records. I will record lessons completed, hours delivered, payments and the remaining prepaid balance, and make those details available to you on request. Advance payments will be accounted for and safeguarded. I will explain your progress and further training needs. Before accepting a block or promotional package I will discuss suitable available appointments; buying a package does not guarantee a particular recurring slot. No expiry or forfeiture of standard block hours is imposed by these Terms.

5 Your cancellations, lateness and missed lessons

5.1 How to cancel. You may cancel by any clear statement sent to my telephone number, messaging channel or email address. You do not need to use special wording. Keep evidence of when you sent it.

5.2 At least 48 hours' notice. If I receive at least 48 hours' notice before the scheduled start, there is no charge. Any payment for that lesson will be refunded or credited, as you choose.

5.3 Less than 48 hours' notice or a missed lesson. If you cancel with less than 48 hours' notice, do not attend, or are more than 15 minutes late without an agreed extension under clause 5.5, the full lesson price will normally be payable because the time has been reserved for you and usually cannot be re-sold at short notice. The charge will not exceed my reasonable net loss.

5.4 If I fill the cancelled time. If I rebook all or part of the cancelled time, or otherwise avoid part of the loss, I will reduce the charge by that amount and refund or credit any overpayment. I will not charge twice for the same reserved time.

5.5 Lateness. The lesson will normally end at the scheduled time if you are late. I will normally wait for up to 15 minutes. If you contact me, I may agree to wait longer where practical, but this does not automatically extend the lesson end time. If you are more than 15 minutes late without an agreed extension, I may treat the lesson as missed.

5.6 Exceptional circumstances. I will consider serious illness, bereavement, emergencies and disability-related circumstances reasonably and consistently. I may ask for proportionate evidence. This clause does not limit statutory cancellation rights or equality-law duties.

6 My cancellations, delay and disruption

6.1 Cancellation by me. I may cancel or reschedule because of illness, vehicle problems, unsafe weather or road conditions, a legal or professional restriction, or another event outside my reasonable control. I will tell you as soon as reasonably possible.

6.2 Your remedy. You will not be charged for tuition I do not provide. You may choose a replacement booking or a prompt refund or credit for the unprovided time.

6.3 Late arrival by me. I will notify you of a material delay where practicable. Lost time will be added to the lesson, rearranged or refunded or credited. If I expect to be 30 minutes or more late, you may cancel without charge and receive a full refund or credit.

6.4 Unavoidable conditions during a lesson. Normal traffic, road closures and weather can affect the route or content but do not reduce the agreed lesson duration. If I end a lesson early, I will refund, credit or rearrange the unprovided time unless the lesson was properly stopped because of your serious safety or conduct breach.

7 Statutory 14-day cancellation rights

7.1 When this section applies. If a consumer contract is made at a distance or off premises and the law gives you a cancellation right, you may cancel without giving a reason during the statutory period. This is separate from the ordinary 48-hour lesson policy.

7.2 Cancellation period. For a service contract, the period normally lasts 14 calendar days beginning on the day after the contract is made.

7.3 How to exercise the right. Send any clear cancellation statement to the contact details at the front of this document before the period ends. You do not need to use special wording or complete a separate form.

7.4 Optional Cancellation Form

To: Csaba Ortutay, trading as CO Driver Training
Email: cort.drivinglessons@gmail.com

I hereby give notice that I wish to cancel my contract for the following service:

Service: [Description of tuition]
Date booked: [Date]
Customer's name: [Full name]
Customer's address: [Address]
Date of cancellation: [Date]

This form is optional. Where a statutory right to cancel applies, you may also cancel by sending a clear statement of your decision to the email address above within the applicable cancellation period.

7.5 Starting within the cancellation period. Before tuition starts within the statutory 14-day cancellation period, I will obtain your separate express request to start early, recorded by email, message or another durable medium. Accepting these Terms or booking alone does not replace that request. I will also ask you to expressly acknowledge that the right to cancel ends when the whole service contract has been fully performed. If you do not request an early start, tuition will start after the cancellation period.

7.6 Cancellation after an early start. If you cancel during the statutory period after expressly requesting an early start, you pay only a proportionate amount for services actually supplied before cancellation, based on the agreed total contract price. No ordinary late-cancellation charge applies to exercising this statutory right. You do not have to pay for services supplied in that period if the required cancellation information was not provided or you did not expressly request the early start.

7.7 Completion of the contract. The statutory right to cancel ends only when the whole service contract has been fully performed, following your express request and acknowledgement described above. Completing one lesson within a prepaid block does not end the right to cancel the remaining block during the statutory period.

7.8 Refund. I will refund sums due after statutory cancellation within 14 calendar days, normally using the original payment method unless we agree otherwise. No administration or processing fee will be deducted.

7.9 Priority. Where this section applies, it takes priority over any inconsistent late-cancellation or termination term.

8 Safety, behaviour and instruction

8.1 My standard of care. I will provide tuition with reasonable care and skill, in line with the National Standard for Driver and Rider Training (NSDRT), and take reasonable steps to protect you, the vehicle and other road users. I will maintain professional boundaries, treat you respectfully, avoid unnecessary physical contact and inappropriate or intimidating conduct, and respond appropriately to safeguarding concerns. I will not use a mobile phone or handheld device or take calls, including hands-free calls, while instructing. Any tablet use will take place only when safely parked with the engine switched off.

8.2 Safety directions and intervention. You must follow lawful and reasonable safety directions. I may give a direct instruction, use dual controls, take physical control where lawful and necessary, or stop the vehicle to manage risk.

8.3 Serious conduct. I may immediately stop a lesson for violence, threats, harassment, discriminatory abuse, deliberate dangerous conduct, serious impairment, or refusal to follow an urgent safety direction.

8.4 Charge after a stopped lesson. If I have to stop a lesson because of the serious conduct in clause 8.3 or another serious breach by you, the full lesson price will normally remain payable because the remaining time cannot reasonably be sold to another learner once the lesson has begun. If I avoid or recover part of that loss, clause 5.4 applies. This clause does not exclude responsibility for my own breach or negligence or any statutory right that cannot lawfully be limited.

9 Vehicles and insurance

9.1 Instructor vehicle. I will provide a vehicle that is roadworthy, taxed, has a valid MOT where required, is insured for paid driving instruction and has appropriate dual controls. Required learner plates, an additional interior rear-view mirror and my instructor badge will be correctly displayed.

9.2 Substitute vehicle. I may use a suitable substitute vehicle and will give notice where reasonably practicable. If a material difference, such as transmission or necessary adaptations, would prevent effective tuition, you may rearrange without charge.

9.3 Your vehicle. Use of a vehicle supplied by you requires my prior agreement. Before the lesson, you must show that it is roadworthy, taxed, has a valid MOT where required, displays required learner plates and is insured for the Learner and for paid professional instruction. Separate proof of insurance for a driving test may be required.

9.4 Refusing an unsuitable vehicle. I may inspect and refuse to use a vehicle that I reasonably consider unsafe, unlawful, uninsured or unsuitable. A charge will apply only where the disclosed requirements were not met and only to the extent of my reasonable net loss.

9.5 Driving offences and penalties. You remain responsible for offences, penalties and legal duties attributable to your own driving, except to the extent that my act, omission, breach or negligence contributed.

10 Practical driving tests

10.1 Booking and managing the test. You must book and manage your own car driving test under current DVSA rules. This includes any permitted change or cancellation. I will advise on readiness and availability, but will not carry out these booking actions for you.

10.2 Instructor availability. Before relying on me or my vehicle, you must obtain written confirmation that I am available for the exact test date, time and test centre. Booking a test, or receiving a test appointment from DVSA, does not by itself reserve my time or vehicle.

10.3 Test details and notice. Send me the complete test details as soon as you book and before asking me to accept a test-day booking. Where reasonably possible, do so at least 10 full working days before the test. For this section, Monday to Saturday count as working days; Sundays and public holidays do not.

10.4 Fixed test-day fee. The fixed test-day fee is £100 for an accepted practical driving test at a test centre within my normal working area. It covers the agreed test-day use of my time and instructor vehicle. Any additional tuition is charged separately unless I expressly include it in the test-day booking. For a test centre outside my normal working area, an additional charge may apply for the extra travel time and distance. Any additional charge will be agreed before I accept the test-day booking. I may require one or more assessment lessons before agreeing to provide the vehicle.

10.5 Changes to the test date, time or test centre. If you or DVSA changes the date, time or test centre after I have confirmed availability, my original confirmation does not automatically transfer to the changed appointment. You must tell me as soon as reasonably possible and obtain fresh written confirmation before relying on me or my vehicle for the replacement appointment.

10.6 Replacement appointment and availability. Before I accept a replacement appointment, I may decline it if the new date, time or test centre conflicts with an existing lesson, instructor training, personal commitment, vehicle availability or another commitment I have already accepted. Declining an unaccepted replacement appointment is not a cancellation by me of that replacement booking. If I confirm the replacement appointment in writing, it becomes a new accepted test-day booking and I will treat it in the same way as any other accepted booking. I do not guarantee availability for a replacement appointment.

10.7 Learner-requested cancellation or change. If, after I have accepted a test-day booking, you choose to cancel the test, change its date, time or test centre, the original test-day booking is treated as cancelled. Tell me as soon as possible. If I receive at least 10 full working days' notice before the original test time, there is no cancellation charge and any prepaid test-day fee will be refunded or credited. A replacement test-day booking is a new booking and requires fresh acceptance.

10.8 Short-notice learner cancellation or change. If I receive less than 10 full working days but at least 48 hours' notice, I will normally try to reorganise the diary. There is no automatic £100 charge; any charge will be limited to reasonable loss that I cannot avoid or recover. If you choose to cancel or change the test with less than 48 hours' notice, the full £100 test-day fee will normally be payable because the reserved test-day time is unlikely to be replaced at that notice. Any charge will still be reduced if I fill the time or otherwise avoid the loss. Clause 5.6 on exceptional circumstances and section 7 on statutory cancellation rights continue to apply. A DVSA change or cancellation is dealt with separately under clause 10.11.

10.9 Permission to use my vehicle. Permission is not automatic. I may refuse or withdraw it where, in my reasonable professional judgement, use would be unsafe or unlawful, the vehicle would not meet test rules, or you have not shown that you can drive it safely without assistance at the standard needed for test conditions. This judgement is about safety and suitability, not a guarantee of the test result.

10.10 Notice of concerns. I will explain material concerns and notify you as early as reasonably possible, normally before the DVSA change deadline where the issue is apparent in time. A new safety issue may require a later decision. You remain responsible for managing the DVSA booking.

10.11 DVSA change or cancellation. If DVSA changes or cancels the test and the original test-day service cannot proceed, you will not be treated as having made a learner-requested cancellation under the two clauses above. I will refund or credit any part of the £100 test-day fee for services not provided. If agreed pre-test tuition, pickup, travel or another part of the confirmed service has already been provided before the DVSA change or cancellation becomes known, I may charge only for the service actually supplied or any other amount that is lawfully due. A replacement date, time or test centre offered by DVSA requires fresh written confirmation of my availability. As at the effective date of these Terms, DVSA may reimburse qualifying instructor-vehicle expenses only up to two hours at the instructor's standard hourly lesson rate and does not reimburse a flat vehicle-use charge, so the £100 test-day fee is not guaranteed to be recoverable from DVSA. Where a claim may be available, I will provide an appropriate receipt; eligibility and payment remain matters for DVSA.

10.12 Instructor-vehicle unavailability. If my vehicle becomes unavailable, I will make reasonable efforts to provide a lawful and suitable alternative. If the test cannot proceed, I will refund my unprovided test-day charges. Any additional liability is governed by section 15 and your statutory rights.

10.13 Problem caused by you. If the test cannot proceed because you are late, do not bring required documents, fail the eyesight check, are unfit to drive or otherwise do not meet DVSA requirements, the accepted test-day booking remains subject to the short-notice test-day cancellation and reasonable-net-loss rules in this section.

11 Ending tuition and refunds

11.1 Your right to end tuition. You may stop tuition at any time. Accepted lessons remain subject to the applicable cancellation rules, including statutory rights.

11.2 Unused prepaid tuition. I will calculate and explain any deduction, then refund the unused balance of prepaid tuition within 14 calendar days after tuition ends. Only charges properly due under these Terms may be deducted. The refund will be based on the amount actually paid for the unused tuition. No administration fee will be deducted. Completed block hours are valued at the paid block rate: £40 per hour for the manual block and £48 per hour for the automatic block. I will not retrospectively reprice them at the standard or peak-time rate. Any different promotional package will have its refund calculation explained before purchase, without limiting statutory rights.

11.3 When I may suspend or end tuition. I may suspend or end the relationship for a material reason, including non-payment, repeated missed lessons, serious or repeated safety breaches, abusive or discriminatory conduct, loss of legal driving entitlement, or a serious breakdown of the professional working relationship.

11.4 Fair process. Unless immediate action is reasonably required for safety or serious conduct, I will explain the concern and give a reasonable opportunity to resolve it. I will not end tuition merely because progress is slower than expected.

11.5 Refund after I end tuition. I will promptly refund unused prepaid tuition, less only a lawful charge for an accepted lesson already supplied or properly cancelled under these Terms.

12 Personal data and privacy

12.1 Data controller. Csaba Ortutay trading as CO Driver Training is the controller of personal data used to manage enquiries, bookings, tuition, safety, payments, records and legal obligations.

12.2 Privacy Notice. I will provide the separate Privacy Notice before collecting personal data, including through a website enquiry form. It explains the purposes and lawful bases for processing, relevant recipients, retention, your rights and how to raise a data-protection concern. Acceptance of these Terms does not itself give marketing or recording consent.

12.3 Health information. I will ask only for health or disability information reasonably necessary for safe, lawful and accessible tuition and will handle it in accordance with data-protection law.

12.4 Photos, testimonials and marketing. Except where disclosure is required or otherwise lawfully permitted for legal, regulatory, insurance, safeguarding or service-administration purposes, I will not share identifiable client information, images or videos with third parties or use them for marketing or publication without explicit written consent. Refusing marketing consent will not affect tuition. Consent may be withdrawn for future use.

12.5 In-car recording. Any dashcam or other in-car recording will be covered by clear separate privacy information and any consent required by law. I will not distribute, circulate or publish identifiable in-car footage without the required consent and will follow the current DVSA rules on filming or recording a driving test.

13 Complaints

13.1 How to complain. Contact me using the telephone number, email or postal address at the front of these Terms and describe the issue and the outcome you seek.

13.2 Response times and records. I will aim to acknowledge a complaint within five working days and provide a substantive response within 14 working days. If more time is reasonably needed, I will explain why and give an updated date. I will keep an appropriate record of complaints and how they were resolved.

13.3 Unresolved complaints and ADR. When I communicate the outcome of a complaint, I will explain any alternative dispute resolution (ADR) or other complaint-resolution arrangement available to you, including any arrangement required by law, contract or professional membership. Where applicable, I will provide the provider or scheme name, website and whether I am required or willing to participate, in a form you can save. Otherwise, either party may propose a suitable voluntary mediation process. Your right to use the courts is unaffected.

13.4 DVSA and independent advice. You may also complain to DVSA about an approved driving instructor's service or behaviour using the GOV.UK service "Complain about a driving instructor" or by emailing instructorconduct@dvsa.gov.uk. DVSA does not recover money on a pupil's behalf. Consumers in Scotland may also obtain independent consumer advice from Advice Direct Scotland. Nothing in this section prevents either party from using a court or another legal remedy.

14 Consumer rights and service remedies

14.1 Reasonable care and skill. The Consumer Rights Act 2015 requires consumer services to be performed with reasonable care and skill. Information I give about the service that you rely on may also become part of the contract.

14.2 Remedies. Where the law applies, you may have rights to repeat performance, a price reduction or other remedies. Nothing in these Terms excludes or restricts those rights.

15 Liability

15.1 Foreseeable loss. I am responsible for loss or damage that is a foreseeable result of my breach of contract or negligence. Loss is foreseeable if it was an obvious consequence or was contemplated by both parties when the booking was accepted.

15.2 Matters not caused by me. I am not responsible for loss caused solely by your act or omission, a third party, or an event outside my reasonable control where I took reasonable care. This does not apply to the extent that my breach or negligence caused or contributed to the loss.

15.3 Personal belongings. You are responsible for looking after personal belongings unless loss or damage is caused by my breach or negligence.

15.4 Business loss. These Terms are for consumer tuition. I am not liable for business losses such as lost profit, lost revenue or loss of a business opportunity.

15.5 Liability that cannot be excluded. Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory consumer rights, or any other liability that cannot lawfully be excluded or limited.

16 Changes to these Terms

16.1 Future bookings. I may update these Terms for future bookings. I will make the updated Terms available before it applies. A change will not retrospectively alter an accepted booking.

16.2 Legal or regulatory change. If an immediate change is reasonably required by law, regulation, safety guidance or a regulator, I will explain the change and its practical effect. If it materially disadvantages you, you may end future tuition without a termination charge and receive a refund of unused prepayments, subject to any unavoidable legal requirement.

17 General legal terms

17.1 Severance. If a court or competent authority finds a provision unlawful or unenforceable, it will not bind you. The remaining provisions continue only to the extent they can operate lawfully without it.

17.2 No waiver. A delay in enforcing a right does not waive it. A waiver on one occasion does not waive the same or another right later.

17.3 Governing law and courts. These Terms are governed by Scots law. A consumer may bring proceedings in any local court available under mandatory consumer-jurisdiction rules. Nothing requires a consumer to use a court outside the part of the United Kingdom in which they live.

17.4 Acceptance. After these Terms have been supplied to you before booking, requesting and accepting a confirmed booking or claiming an advertised open slot means you agree to them. An enquiry, receipt of these Terms or a booking entered without your request or agreement does not by itself create a contract. Any statutory early-start request or consent required for another purpose must be obtained separately.
