IMPORTANT NOTICE: PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING CLOUD ROUTE.
*This Agreement is a legally binding agreement between you (“User” or “you”) and [Developer/Company Name] (“we”, “us”, “Cloud Route” or “our”) regarding the use of the Cloud Route mobile application (including all versions, updates, and related services, collectively the “App”). BY DOWNLOADING, INSTALLING, ACCESSING OR USING THE APP, YOU AGREE TO BE BOUND BY ALL TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE WITH ANY TERM OF THIS AGREEMENT, DO NOT DOWNLOAD, INSTALL OR USE THE APP. *
The App is licensed, not sold, to you.

About Cloud Route
Cloud Route is a travel-assistant application that helps users plan routes, discover destinations, record travel footprints, and provides location-based navigation and recommendations. *The App does not require user registration or account creation. * You may use the App anonymously by simply installing it and granting necessary permissions.

1. Eligibility

By using the App, you represent and warrant that:

• You are at least 13 years of age. If you are under 13, you may only use the App under the supervision of a parent or legal guardian who accepts this Agreement on your behalf.

• You have the legal capacity to enter into a binding agreement.

• You will comply with all applicable laws and regulations when using the App.

2. No Account Required
Cloud Route does not require you to create an account, provide an email address, or set a password. The App functions based on device identifiers and local storage. Because there is no account, Cloud Route cannot recover any data associated with your device if the App is uninstalled or your device is lost. You are solely responsible for maintaining the security of your device and any access codes or biometric locks you have set.

3. Location Information and Permissions
Cloud Route needs access to your location information to provide core travel-related features. By using the App, you acknowledge and agree:

• Location Data Collection：The App periodically accesses your device’s GPS, Wi-Fi, and cellular network information to determine your approximate or precise location. This data is necessary for the App to function.

• Location Use：Your location information is used only for personal purposes such as route planning, nearby place recommendations, and travel logging. The App does not share your location with other users or the public (as there are no user-to-user interaction features).

• Background Location：To provide continuous location updates when you are using navigation or recording travel tracks, the App may continue to access your location even when the App is not actively in use or the screen is off, depending on your device settings and permissions.

• User Control：You may disable location services for the App at any time through your device settings. However, doing so will significantly reduce or eliminate the App’s functionality (e.g., route planning and place recommendations).

• No Guarantee of Accuracy：Cloud Route provides location information on an “as is” and “as available” basis. We do not guarantee the accuracy, completeness, timeliness, or reliability of any location data. Factors such as GPS signal strength, network connectivity, device hardware, and environmental conditions may affect location accuracy.

4. Travel History and Data Storage
Cloud Route allows you to save travel tracks, favorite places, and trip notes. By using these features, you acknowledge and agree:

• Local Storage Primary：Because the App has no account system, all travel data is stored locally on your device by default. You may delete this data at any time through the in-app settings.

• No Account, No Recovery：Uninstalling the App or resetting your device will permanently delete all travel data. Cloud Route cannot recover deleted data for you.

5. User Conduct and Prohibited Activities
You agree not to misuse the App. Prohibited activities include, but are not limited to:

• Using the App to stalk, harass, threaten, or invade the privacy of any person.

• Using the App for any unlawful purpose or in violation of any applicable laws.

• Attempting to interfere with, compromise, or disrupt the App or its servers.

• Reverse engineering, decompiling, or attempting to extract the source code of the App.

• Transmitting any viruses, malware, or other harmful code through the App.

• Collecting or harvesting personal information of other users without their permission (note that the App has no user-to-user interaction, but this prohibition still applies to external means).

Violation of these provisions may result in termination of your access to the App and, where applicable, referral to law enforcement authorities.

6. Intellectual Property
The App, including its code, design, layout, graphics, logos, and text (excluding User Content), is owned by Cloud Route or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial travel-assistant purposes only. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

7. User Content
You may be able to input or upload content to the App, such as trip notes, place labels, custom route names, etc. (“User Content”). You retain ownership of your User Content. By providing User Content through the App, you grant Cloud Route a non-exclusive, worldwide, royalty-free license to store, process, and transmit your User Content solely for the purpose of providing the App’s functionality to you (e.g., storing and displaying your travel records). You are solely responsible for your User Content and for ensuring it does not violate any third-party rights or applicable laws.

8. Third-Party Services
The App may integrate with or rely upon third-party services, such as mapping services (e.g., Apple Maps, Google Maps), notification services, or operating system frameworks. Cloud Route is not responsible for the availability, accuracy, security, or performance of any third-party services. Your use of third-party services may be subject to their own terms and privacy policies.

9. Privacy
Your privacy is important to us. Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy. Key privacy practices include:

• No Account Required: Cloud Route does not collect traditional account registration information such as name, email address, or password.

• Location Data: Cloud Route collects location data as described in Section 3. This data may be stored temporarily to provide route planning and travel logging features. *We do not share your location with any third parties. *

• Children’s Privacy: We do not knowingly collect personal information from children under 13 without parental consent. If you believe your child has provided us with personal information without your consent, please contact us.

10. Disclaimer of Warranties
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOUD ROUTE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
CLOUD ROUTE DOES NOT WARRANT THAT: (A) THE APP WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE APP, INCLUDING LOCATION DATA AND ROUTE RECOMMENDATIONS, WILL MEET YOUR REQUIREMENTS OR BE ACCURATE, COMPLETE, OR RELIABLE
YOU USE THE APP AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA THAT RESULTS FROM YOUR USE OF THE APP.

11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLOUD ROUTE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE APP.
IN PARTICULAR, CLOUD ROUTE SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, OR DAMAGE ARISING FROM RELIANCE ON LOCATION INFORMATION PROVIDED BY THE APP. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW. IN SUCH JURISDICTIONS, CLOUD ROUTE’S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

12. Termination
Cloud Route may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement. Because Cloud Route does not require an account, termination means you will no longer be able to use the App from the affected device(s). All provisions of this Agreement which by their nature should survive termination shall survive, including warranty disclaimers, limitation of liability, and dispute resolution provisions.

13. Governing Law and Dispute Resolution

• Governing Law：This Agreement shall be governed by and construed in accordance with the laws of the People’s Republic of China, without regard to its conflict of law provisions.

• Any dispute arising out of or relating to this Agreement or the App shall be resolved through binding individual arbitration, rather than in court. The arbitration shall be conducted by the China International Economic and Trade Arbitration Commission (CIETAC) in accordance with its arbitration rules in effect at that time. The seat of arbitration shall be Beijing, and the arbitration language shall be Chinese (or English upon one party’s request). There shall be one arbitrator. The arbitral award shall be final and binding upon both parties and may be enforced in any court of competent jurisdiction.

• You agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. You expressly waive your right to file a class action or seek class-wide relief.

• Exception：You or Cloud Route may bring a claim in small claims court if the claim qualifies and is within the court’s jurisdiction, or may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights.

14.  Modifications to the App and Terms
Cloud Route reserves the right to modify or discontinue, temporarily or permanently, the App or any feature of the App with or without notice. We may also update this Agreement from time to time. If we make material changes to this Agreement, we will notify you by: (a) posting the updated Agreement within the App; and/or (b) requiring you to acknowledge the updated Agreement the next time you use the App. Your continued use of the App after any such changes constitutes your acceptance of the new Agreement. If you do not agree to the updated Agreement, you must stop using the App.

15.  Miscellaneous

• Entire Agreement：This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and Cloud Route regarding your use of the App.

• Severability：If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

• Waiver：Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.

• Assignment：You may not assign or transfer this Agreement or any rights or obligations hereunder, whether by operation of law or otherwise, without our prior written consent. We may assign this Agreement without restriction.

• No Agency：No agency, partnership, joint venture, or employment relationship is created as a result of this Agreement.
