1. What types of identification do I need for notarization in Florida?
Accepted IDs:
Valid Florida driver’s license or ID card
U.S. passport or passport card
Military ID
Other state-issued photo IDs (if current)
Secondary Proof: If the ID lacks a photo/signature, you’ll need a second ID (e.g., credit card, Social Security card).
Florida Statute §117.05(5)(b) requires notary to verify identity.
2. Can you notarize for a minor or someone with limited capacity?
Minors: Only if they’re legally emancipated or have court-appointed guardianship documents.
Mental Capacity: The signer must understand the document and act willingly (FS §117.107). I cannot notarize if the signer appears confused or coerced.
3. Do you provide witnesses for documents?
Yes, for an extra fee ($25/witness, max 2). subject to availability
Florida requires witnesses for:
Wills (FS §732.502)
Some real estate deeds
Power of attorney (if specified in the document)
Witnesses must:
Be unrelated to the document.
Have valid photo ID.
4. Can you notarize a document without the signer present?
No. Florida law (FS §117.107) mandates that the signer must appear in person before the notary. Video notarization (RON) is allowed only if you’re a Florida Online Notary (I’m currently a traditional mobile notary).
5. What’s the difference between an acknowledgment and a jurat?
Acknowledgement: Confirms the signer’s identity and that they signed willingly (common for deeds, contracts).
Jurat: Requires the signer to swear/affirm the truthfulness of the document (common for affidavits).
FS §117.03 defines notarial acts.
6. Can you backdate or predate a notarization?
No. Florida law (FS §117.107(9)) prohibits dating a notarization earlier than the actual signing date.
7. Do you notarize wills or living wills?
Yes, but with caveats:
I cannot draft or advise on the content (FS §117.105).
Florida requires 2 witnesses for wills (I can arrange for a fee).
8. What if my document is in a foreign language?
Yes, but:
The document must include an English notarial certificate.
You must understand what you’re signing.
I cannot translate the document (only certify signatures).
9. How long does a notarization take?
Most appointments take 15–30 minutes, depending on:
ID verification.
Number of signatures.
Complexity (e.g., jurats require an oath).
10. Can you refuse to notarize a document?
Yes, if:
The signer lacks proper ID (FS §117.05).
The document is incomplete or suspicious.
The signer seems coerced or unaware of the document’s purpose.
11. Are your fees regulated by Florida law?
No. Florida does not set maximum fees for mobile notaries (FS §117.04). My travel fees reflect time/distance.
12. Do you offer electronic notarization (eNotarization)?
Not currently. Florida allows eNotarization, but it requires separate registration with the state.
I am a Florida Notary Public commissioned by the state. I am not an attorney and cannot draft legal documents, provide legal advice, or charge fees for legal advice under Florida law.
