1. Introduction
Welcome to Chirp: AI for Apple Watch ("Chirp" or "the app"), developed by Jonathon Lau ("the developer," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the app and its related services. By downloading, installing, or using Chirp, you agree to comply with these Terms. If you do not agree with these Terms, you must discontinue use of the app immediately.

Inaccuracies in AI-generated responses.
Third-party service failures (Google Gemini, OpenPerplexity, etc.).
User reliance on AI-generated content.
4. Intellectual Property Rights
The app, including its design, features, content, and trademarks, is the exclusive property of the developer. You are granted a limited, non-exclusive, non-transferable license to use Chirp solely for personal and non-commercial purposes. You may not:
Copy, modify, or distribute any part of the app without prior written consent.
Use the app's trademarks or branding without authorization.
All third-party trademarks referenced in Chirp belong to their respective owners.
By using Chirp, you agree not to:
Use the app for unlawful or harmful purposes.
Misuse AI-generated content.
Attempt to reverse engineer or tamper with the app.
5. Subscriptions and Refunds
Chirp offers subscription-based features through the Apple App Store. By subscribing, you agree to Apple's subscription terms, including automatic renewals unless canceled. Refunds are subject to Apple's refund policy and must be requested directly through the App Store. We do not handle or process refund requests.
6. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, we disclaim liability for any direct, indirect, incidental, special, or consequential damages arising from:
Inaccuracies or errors in AI-generated responses.
Third-party service failures (Google Gemini, OpenPerplexity, etc.).
User reliance on AI-generated content.
Loss of data or unauthorized access to user information.
We do not guarantee uninterrupted, error-free, or secure operation of Chirp.
We reserve the right to update these Terms. Continued use of the app constitutes acceptance of any changes.
7. Third-Party Services and Dependencies
Chirp relies on third-party services such as Google Gemini, Firebase, OpenPerplexity, and Apple iCloud. These services operate under their own privacy policies and terms. We are not responsible for service interruptions, changes, or terminations by these providers. Continued availability of Chirp's features depends on these third-party services, and we are not liable for any impact resulting from changes to their functionality.
8. Termination
We reserve the right to terminate or suspend your access to Chirp at our sole discretion if you violate these Terms or engage in any activity that we deem harmful to the app or its users. Termination may occur without prior notice.
9. Compliance with Data Protection Laws
Users in certain jurisdictions (e.g., EU, California) may have rights under data protection laws such as GDPR and CCPA. Since Chirp does not store personally identifiable information (PII), requests related to data access or deletion should be directed to the third-party services that process user data. We recommend reviewing their respective privacy policies for details.
10. Indemnification
You agree to indemnify and hold harmless the developer, its affiliates, and service providers from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
Your misuse of Chirp or AI-generated content.
Violations of these Terms.
Infringement of third-party rights, including copyright, trademarks, or privacy laws.
