1. Acceptance of Terms

By downloading, accessing, or using any application within the "Charlie's Voice" ecosystem—including the Charlie's Voice Communication App and the Charlie's Guard Safety App—you agree to these Terms of Service. If you do not agree to these terms, please do not use our applications.

2. Purpose & Critical Disclaimers

Our applications serve different purposes, and you acknowledge the specific limitations of each:

A. Charlie's Voice (Communication App)

• Communication Aid Only: This app is a communication support tool designed to assist individuals with limited speech.

• Not Medical Advice: This app is not a medical device and is not a substitute for professional speech therapy, medical diagnosis, or treatment. Always seek the advice of qualified health providers for conditions regarding speech or development.

B. Charlie's Guard (Safety & Tracking App)

• Not a Guaranteed Life-Saving Device: Charlie's Guard relies entirely on third-party hardware (your tablet and smartwatch), battery life, active internet/cellular connections, and GPS satellite availability. We cannot and do not guarantee 100% uptime, immediate data delivery, or pinpoint GPS accuracy.

• Not a Substitute for Supervision: This application is designed as an assistive tether and alert system. It is strictly not a replacement for active, physical parental or carer supervision.

• System Failures: You acknowledge that alerts may be delayed or fail to trigger due to network dropouts, device sleep states, operating system restrictions, or hardware malfunction.

3. User Responsibilities

• Hardware and Connectivity: You are solely responsible for ensuring that all paired devices are adequately charged, properly configured (including granting necessary permissions like background location), and connected to an active cellular or Wi-Fi network.

• Your Data and Content: You retain ownership of any photos, names, or medical details you upload to the apps. You are solely responsible for ensuring you have the legal right to use any uploaded images. Charlie's Voice does not monitor your local content.

• Account Security: You are responsible for keeping your pairing codes and physical devices secure to prevent unauthorised access to your child's location data.

4. User Licence

We grant you a personal, non-exclusive, non-transferable licence to use our applications for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or attempt to extract the source code of our applications.

5. Limitation of Liability

To the maximum extent permitted by Australian consumer law, all Charlie's Voice applications are provided strictly on an "as is" and "as available" basis. We expressly disclaim any liability for:

• Any direct, indirect, or consequential damages, injuries, or losses arising from the use or inability to use the apps.

• The failure of Charlie's Guard to accurately locate a device or trigger an alert during an emergency.

• Data loss, app crashes, or software glitches occurring at critical moments.

6. Governing Law

These terms are governed by and construed in accordance with the laws of New South Wales, Australia.
