Booking & Payment
A $25 non-refundable retainer is required to secure your session date and time. No session is considered booked until the retainer has been received.
The remaining balance is due prior to the start of the scheduled session. If full payment is not received before the session begins, the session may be canceled or rescheduled at the photographer’s discretion.
Mini Sessions & Sessions Requiring Ordered Items:
All mini sessions, as well as any session requiring the photographer to purchase or order items specifically for the client (such as birthday decor, themed props, or other session-specific materials), must be paid in full at the time of booking. The session date and time will not be considered secured until full payment has been received. Payments for these sessions remain subject to the photographer’s cancellation and refund policies outlined in this contract.
Cancellation & Rescheduling
The $25 retainer is non-refundable. If the client needs to reschedule, every effort will be made to accommodate a new date based on availability. Rescheduling requests should be made as soon as possible.
If the photographer must cancel due to illness, emergency, or unsafe weather conditions, the client may choose to reschedule or receive a full refund of any payments made.
Image Delivery
Edited images will be delivered through an online gallery within up to one (1) week of the session date. All galleriees must be downloaded within 24 hours of delievery.
Artistic Style & Creative Control
The Client acknowledges that photography is an artistic service and that the Photographer’s work is based on their individual creative style, artistic judgment, editing techniques, posing, composition, lighting, color grading, and overall aesthetic. By booking a session, the Client confirms that they have reviewed the Photographer’s portfolio and are familiar with and accepting of the Photographer’s artistic style.
The Photographer retains full creative and artistic discretion over the session, including but not limited to posing, lighting, composition, image selection, editing, cropping, color, black and white conversion, and final gallery presentation. The Photographer will make reasonable efforts to accommodate reasonable requests made prior to or during the session; however, specific images, poses, editing styles, or results cannot be guaranteed.
The Client understands that personal aesthetic preferences and subjective opinions regarding the final gallery do not constitute a failure to perform the agreed-upon photography services. Dissatisfaction based solely on personal taste, artistic preference, or a difference in expectations regarding the Photographer’s established style will not entitle the Client to a refund, reshoot, additional images, or other compensation.
RAW images will not be provided.
Copyright & Usage
Carroll Candids retains the copyright to all images. Clients receive a personal-use license to download, print, and share their purchased images. Images may not be altered, filtered, or used for commercial purposes without written permission.
Model Release
Unless otherwise requested in writing by the client, the client grants Carroll Candids permission to use photographs from the session for portfolio, website, social media, advertising, and promotional purposes.
Photographer Liability
The photographer will take the utmost care with respect to the photographs taken. In the unlikely event of equipment failure, loss of images, illness, or other unforeseen circumstances beyond the photographer’s control, liability is limited to the return of any payments received.
Client Cooperation
The client understands that the quality of the final images depends on cooperation during the session. This includes arriving prepared, supervising children when necessary, and following the photographer’s guidance regarding posing and location. While every effort will be made to capture a variety of images, Carroll Candids cannot guarantee specific poses, expressions, or outcomes, particularly with young children.
Respectful Conduct
The Photographer is committed to providing a safe, respectful, and professional environment for all clients. Harassment, threats, intimidation, abusive language, discriminatory conduct, bullying, stalking, excessive or unreasonable communication, or other inappropriate behavior directed toward the Photographer, the Photographer’s family, assistants, vendors, or other individuals involved in providing services will not be tolerated.
The Photographer reserves the right to immediately end a session, terminate communication, refuse future services, or cancel a booking if the Client or anyone associated with the Client engages in such conduct. If a session is terminated due to the Client’s inappropriate or abusive behavior, no refund will be issued, and the Client remains responsible for any applicable balance or costs already incurred.
Late Arrivals
Please arrive on time for your scheduled session. Clients arriving more than 15 minutes late may have their session shortened to avoid affecting other scheduled appointments. If the client arrives more than 30 minutes late without prior communication, the session may be considered canceled, and all payments, including the non-refundable retainer, will be forfeited.
Weather Policy
Outdoor sessions are weather-dependent. If inclement weather (including heavy rain, thunderstorms, high winds, or other unsafe conditions) is expected, Carroll Candids will contact the client to discuss rescheduling. Weather-related reschedules initiated by the photographer will not incur any additional fees, and the client’s retainer will be transferred to the new session date.
Light cloud cover or overcast skies are generally ideal for photography and are not considered grounds for cancellation or rescheduling.
