This Terms of Use Agreement sets forth the standards of use of the Carr Auto Spa Online Service. By using the Carr Auto Spa website you (the “User”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at Carr Auto Spa's website. Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.

1. Description of Service 

Carr Auto Spa is providing visitors with the ability to book a request for mobile detailing services online, through text or over the phone according to the owners needs and specifications. We provide services on a first come first serve basis by appointment. We can accommodate appointments at your home or work at a time that is deemed convenient for the customer and our subcontractors work schedule. Carr Auto Spa will provide you with a qualified and skilled mobile detailing contractor to take care of any service requested. Customers should remove all personal belongings, money and other significant items from their vehicle prior to any type of detailing. Assure that your vehicle is being serviced in a lawful and safe area and if you feel otherwise please communicate your concerns with the technician. All vehicles are cleaned at the customer's own risk and must be able to withstand normal cleaning processes. Please inspect your vehicle after the service is rendered to assure all interior lights, headlights, or running lights have been turned off. We cannot guarantee any firm times when accepting your booking. Our detailing times are an estimate only. Each vehicle is different and may require more or less time to fulfill the detailing type. We reserve the right to use any independent contractor to undertake your auto detailing and may need to change the detailer at short notice without penalty. Whilst every effort will be made to keep scheduled bookings to the requested arrival window, unforeseen circumstances may cause lateness and are done so without voiding our cancellation policy. We reserve the right to alter or move a booking in line with staffing levels and/or weather conditions and /or machinery or equipment failure. All orders placed require address, package, and vehicle condition verification. Service requests are not guaranteed at time of booking and may be canceled at any time at the sole discretion of Carr Auto Spa. Carr Auto Spa reserves the right to refuse service to anyone. Carr Auto Spa reserves the right to refuse or deny customer demands above and beyond the booked detailing. Carr Auto Spa will not tolerate any verbal or physical abuse towards any of its staff under any circumstances and will take the relevant actions should any such behaviors be encountered. By paying for the service you agree that the services were rendered to your satisfaction.

2. Disclaimer of Warranties. 

The site is provided by Carr Auto Spa on an “as is” and on an “as available” basis. To the fullest extent permitted by applicable law, https://sites.google.com/view/carr-auto-spa makes no representations or warranties of any kind, express or implied, regarding the use or the results of this web site in terms of its correctness, accuracy, reliability, or otherwise. Carr Auto Spa shall have no liability for any interruptions in the use of this Website. Carr Auto Spa disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, therefore the above-referenced exclusion is inapplicable.

3. Limitation of Liability 

CARR AUTO SPA SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, AND IN PARTICULAR CARR AUTO SPA SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THIS WEBSITE OR THE INFORMATION CONTAINED IN IT, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE, EVEN IF CARR AUTO SPA   HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SOME OF THE ABOVE LIMITATIONS IS INAPPLICABLE.

4. Indemnification

Customer agrees to indemnify and hold Carr Auto Spa, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Customer’s use of the Service, the violation of this Agreement, or infringement by Customer, or other user of the Service using Customer’s computer, of any intellectual property or any other right of any person or entity.

5. Modifications and Interruption to Service 

Carr Auto Spa reserves the right to modify or discontinue the Service with or without notice to the Customer. Carr Auto Spa shall not be liable to Customer or any third party should Carr Auto Spa exercise its right to modify or discontinue the Service. Customer acknowledges and accepts THAT https://sites.google.com/view/carr-auto-spa does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.

6. Disclaimer Regarding Accuracy of Vendor Information

Product specifications and other information have either been provided by the Vendors or collected from publicly available sources. While https://sites.google.com/view/carr-auto-spa makes every effort to ensure that the information on this website is accurate, we can make no representations or warranties as to the accuracy or reliability of any information provided on this website. https://sites.google.com/view/carr-auto-spa  makes no warranties or representations whatsoever with regard to any product provided or offered by any Vendor, and you acknowledge that any reliance on representations and warranties provided by any Vendor shall be at your own risk.

7. Compliance with Laws

Customer assumes all knowledge of applicable law and is responsible for compliance with any such laws. Customers may not use the Service in any way that violates applicable state, federal, or international laws, regulations or other government requirements. Customer further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation

8. Copyright and Trademark Information 

All content included or available on this site, including site design, text, graphics, interfaces, and the selection and arrangements thereof is the property of Carr Auto Spa and/or third parties protected by intellectual property rights. Any use of materials on the website, including reproduction for purposes other than those noted above, modification, distribution, or replication, any form of data extraction or data mining, or other commercial exploitation of any kind, without prior written permission of an authorized officer of https://sites.google.com/view/carr-auto-spa  is strictly prohibited. Customers agree that they will not use any robot, spider, or other automatic device, or manual process to monitor or copy our web pages or the content contained therein without prior written permission of an authorized officer of https://sites.google.com/view/carr-auto-spa. Carr Auto Spa are proprietary marks of https://sites.google.com/view/carr-auto-spa. Carr Auto Spa may not be used in connection with any product or service that is not provided by Carr Auto Spa in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Carr Auto Spa. All other trademarks displayed on Carr Auto Spa website are the trademarks of their respective owners, and constitute neither an endorsement nor a recommendation of those Vendors. In addition, such use of trademarks or links to the web sites of Vendors is not intended to imply, directly or indirectly, that those Vendors endorse or have any affiliation with Carr Auto Spa.

9. Forever Clean Club Subscription Policy

In In addition to the general Terms of Use, the following policies apply specifically to customers enrolled in the Forever Clean Club, Carr Auto Spa’s monthly vehicle wash subscription plan (hereinafter referred to as the “Subscription”). Enrollment in the Forever Clean Club is available only after the vehicle has received a qualifying Detail Package service from Carr Auto Spa. This Detail Package must be performed by Carr Auto Spa within thirty days prior to the subscription start date. Proof of a comparable service from another provider will not be accepted, and Carr Auto Spa reserves the right to determine whether a vehicle qualifies for enrollment based on its condition. This requirement ensures that all subscription members begin with a clean baseline and allows the business to maintain consistent service standards for all participants. By joining the Subscription, customers agree to pay the full monthly rate at the start of each month via cash, Zelle, or Venmo, before receiving their first wash. Subscriptions run on a calendar-month basis, from the first day to the thirtieth or thirty-first day of each month. Customers who join mid-month will pay the full monthly rate but will receive only the remaining washes available for that month. At its sole discretion, Carr Auto Spa may offer a one-time courtesy wash for new mid-month signups; however, this courtesy is not guaranteed. Each subscription includes two vehicle washes per month and allows one reschedule per month, provided that at least twenty-four hours’ notice is given. Washes do not carry over to the following month, and any unused washes will expire at the end of the calendar month. Same-day cancellations or no-shows result in a forfeited wash. Rescheduled washes must be completed within the same month to ensure scheduling consistency and fairness to all members. Carr Auto Spa reserves the right to reschedule or cancel services due to illness, emergency, equipment failure, or severe weather. In the event of such circumstances, customers will be offered either a replacement wash within the same month or a rollover credit for one wash into the following month. Multiple business-side cancellations in the same month will not result in additional rollover credits. Wash services will proceed under light weather conditions, but severe weather may necessitate rescheduling, which will count as a business-side reschedule rather than the customer’s allowed reschedule.Refunds will not be issued under any circumstances, except as required by law. Subscribers also receive priority scheduling and  discounts on additional services, including wax, interior detailing, and shampoo. By enrolling in the Forever Clean Club, customers acknowledge and agree to these terms in addition to the general Terms of Use. They further understand that the Subscription operates on a month-to-month basis, with no automatic carryover, rollover, or refund of unused services except as explicitly specified herein.

10. Other Terms 

If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by Carr Auto Spa in our sole discretion, to a third party in the event of a merger or acquisition. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Customer. Customer agrees that by accepting this Terms of Use Agreement, Customer is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement.
