These Terms of Use ("Terms") govern your access to and use of the CarMod mobile application ("CarMod," "the App," "we," "our," or "us"), operated by GD MOBIL VE YAZILIM TEKNOLOJILERI LIMITED SIRKETI.
By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the App.
CarMod is a mobile application that provides car customization, car modification preview, AI-powered car design, and related creative features.
We may update, modify, suspend, or discontinue any part of the App or Service at any time, with or without notice, to the extent permitted by applicable law.
You must be at least 13 years old or the minimum legal age required in your country or region to use the App.
If you are under 18, you should use the App only with the consent and supervision of a parent or legal guardian.
By using the App, you represent that you meet these eligibility requirements.
You are responsible for keeping your device, account access, and App usage secure.
You agree not to:
Use the App for any illegal, fraudulent, harmful, or unauthorized purpose.
Violate applicable laws, regulations, or third-party rights.
Reverse engineer, decompile, disassemble, modify, or attempt to extract the source code of the App.
Circumvent security features, technical restrictions, payment systems, or usage limits.
Use automated tools, bots, scripts, scraping systems, or similar technologies to misuse the App.
Distribute malware, spam, harmful code, or abusive content through the App.
Harass, threaten, abuse, defame, or harm other individuals.
Interfere with or disrupt the normal operation, security, or performance of the App.
Use the App in a way that may damage, overload, or impair our systems or third-party services.
Certain features of CarMod may require a paid subscription, one-time purchase, credits, or other in-app purchase.
If you purchase a subscription or other in-app product:
Payment will be processed through the applicable platform, such as the Apple App Store or Google Play.
The payment platform's own terms, billing rules, and payment policies apply.
Subscriptions may automatically renew unless cancelled according to the applicable platform's rules.
You are responsible for managing and cancelling your subscription through your Apple App Store or Google Play account settings.
Deleting the App does not automatically cancel an active subscription.
Refund requests are handled by the applicable platform according to its refund policies.
We may change subscription terms, prices, features, or duration where permitted by law and platform rules.
Nothing in these Terms limits any mandatory refund or consumer rights available to you under applicable law.
The App, including its software, design, interface, text, graphics, logos, branding, trademarks, features, and original content, is owned by or licensed to GD MOBIL VE YAZILIM TEKNOLOJILERI LIMITED SIRKETI.
The App is protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the App or its content except as expressly permitted by these Terms or applicable law.
Using the App does not transfer any ownership rights to you.
If you create, upload, submit, or share content through the App, including car photos, prompts, designs, generated images, or related materials:
You retain ownership of your original content.
You grant us a limited, non-exclusive, royalty-free license to host, process, display, modify, and use that content only as necessary to operate, provide, maintain, and improve the App.
You represent that you have the necessary rights and permissions to upload and use such content.
You agree that your content will not infringe third-party rights or violate any applicable law.
You are responsible for the content you upload, create, generate, publish, or share.
We may remove, restrict, or refuse to process content that we reasonably believe violates these Terms, applicable law, platform rules, or the rights of others.
CarMod may include AI-powered features that generate, modify, enhance, or transform car-related images and designs.
You acknowledge that:
AI-generated results may be inaccurate, unexpected, incomplete, or visually inconsistent.
Generated content may not always match your expectations.
AI-generated content may be similar to content generated for other users.
We do not guarantee that generated content is unique.
You are responsible for reviewing generated content before using, publishing, or sharing it.
You are responsible for ensuring your use of generated content complies with applicable laws and third-party rights.
You agree not to use the App to upload, create, generate, process, publish, or share content that:
Is illegal, fraudulent, misleading, harmful, abusive, hateful, threatening, or defamatory.
Infringes copyright, trademark, privacy, publicity, or other rights of any person or entity.
Contains malware, viruses, spyware, or harmful technical components.
Promotes violence, terrorism, exploitation, or criminal activity.
Harasses, threatens, or targets individuals or groups.
Violates Apple App Store, Google Play, or other applicable platform policies.
Is intended to deceive users or unlawfully impersonate another person or brand.
Your use of the App is also governed by our Privacy Policy.
The Privacy Policy explains how information may be collected, processed, stored, and protected when you use CarMod.
By using the App, you acknowledge the practices described in the Privacy Policy.
CarMod may integrate with or rely on third-party services, including:
App marketplaces
Payment and subscription providers
Analytics services
Crash reporting services
Push notification services
Cloud or technical infrastructure providers
AI processing infrastructure
Third-party services are governed by their own terms, policies, and privacy practices.
We are not responsible for third-party services that are independently operated by third parties, except where required by applicable law.
The App is provided on an "as available" basis.
We do not guarantee that:
The App will always be available.
The App will be uninterrupted or error-free.
All features will remain available permanently.
Generated results will always be successful or accurate.
The App will be compatible with every device or operating system.
We may update, change, suspend, restrict, or discontinue parts of the App where necessary for technical, business, legal, or security reasons.
To the maximum extent permitted by applicable law, the App is provided on an "as is" and "as available" basis.
We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted availability.
Nothing in these Terms limits consumer rights that cannot legally be excluded.
To the maximum extent permitted by applicable law, GD MOBIL VE YAZILIM TEKNOLOJILERI LIMITED SIRKETI, its owners, operators, employees, representatives, affiliates, and service partners shall not be liable for:
Indirect, incidental, special, consequential, exemplary, or punitive damages.
Loss of data, revenue, profit, business opportunity, or goodwill.
Damages arising from your use or inability to use the App.
User-generated content.
AI-generated content.
Third-party services.
Service interruptions, technical failures, or unauthorized access.
Where liability cannot legally be excluded, our liability shall be limited to the maximum extent permitted by applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless GD MOBIL VE YAZILIM TEKNOLOJILERI LIMITED SIRKETI, its owners, operators, employees, representatives, affiliates, and service partners from any claims, damages, losses, liabilities, costs, or expenses arising from:
Your use or misuse of the App.
Your violation of these Terms.
Your violation of applicable law.
Your content or generated content.
Your violation of third-party rights.
We may suspend, restrict, or terminate your access to the App at any time if we reasonably believe that:
You violated these Terms.
You misused the App or its AI features.
Your use may create legal, technical, security, or business risk.
Your activity is fraudulent, abusive, or harmful.
Suspension or termination is required by law, regulation, or platform policy.
You may stop using the App at any time.
Upon termination, your right to use the App will cease.
Sections that by their nature should survive termination will remain in effect, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution provisions.
We may update these Terms from time to time.
When we update these Terms, we will revise the "Last Updated" date at the top of this page.
Where required by applicable law, important changes may be communicated through the App, our website, or another appropriate method.
Continued use of the App after updated Terms become effective means that you accept the updated Terms, to the extent permitted by applicable law.
If you do not agree to the updated Terms, you must stop using the App.
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles.
To the extent permitted by applicable law, any dispute arising from or relating to these Terms or the App shall be subject to the jurisdiction of the competent courts and enforcement offices of İstanbul, Türkiye.
Mandatory consumer protection rights and jurisdiction rules available under applicable law remain unaffected.
Nothing in these Terms limits, excludes, or restricts any mandatory consumer rights available to you under applicable law.
If you are a consumer, you may have additional rights depending on your country or region.
We are not responsible for delays, interruptions, or failures caused by circumstances beyond our reasonable control, including:
Natural disasters
Internet or telecommunications failures
Power outages
Cyberattacks
Government actions
Legal restrictions
War, civil unrest, or similar events
Failures of third-party infrastructure or service providers
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
The invalid or unenforceable provision will be interpreted or modified to the minimum extent necessary to make it valid and enforceable where permitted by law.
We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, corporate restructuring, asset transfer, or other lawful business transaction.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
Our failure or delay in enforcing any right or provision of these Terms does not constitute a waiver of that right or provision.
Any waiver must be made expressly and in writing where required by applicable law.
These Terms, together with our Privacy Policy and any additional terms presented within the App, constitute the entire agreement between you and GD MOBIL VE YAZILIM TEKNOLOJILERI LIMITED SIRKETI regarding your use of CarMod.
GD Mobile operates CarMod - Car Modification AI, an AI-powered car modification and visual creation application that allows users to upload vehicle photos, digitally customize cars, and generate AI-powered automotive images and videos.
Although our application does not feature user-to-user communication, chat rooms, public profiles, dating services, or community features, we are fully committed to maintaining a safe digital environment and strictly adhere to Google Play’s Child Safety Standards policy.
We maintain a strict, zero-tolerance policy against any form of Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). Users are strictly prohibited from uploading, generating, editing, transforming, or attempting to create any content involving the sexual abuse, exploitation, or endangerment of minors.
Any attempt to misuse CarMod's AI-powered image or video generation, vehicle modification, or editing features for illegal activities, CSAE, CSAM, or other serious policy violations may result in immediate and permanent restriction or termination of access to our services. Where required by applicable law, we may also take appropriate reporting and compliance actions.
