The Bail Act 2023, which will reform the country’s bail framework in the criminal justice system, was passed in the House of Representatives on Tuesday (July 25) 2023.
The legislation, which will repeal and replace the existing Act of 2000 was approved with 20 amendments.
Another ammendment and clause within the ACT is as follows:
“If the identification parade is not held within that time, the matter is then to be referred to a judge no later than 48 hours after that 120-hour period has elapsed and the time lapse is provided to ensure that administrative issues are speedily dealt with and completed,” the Minister said.

🏹That it removes the discretionary powers of judges to grant or deny bail. The Act does not take away the judicial discretion, but rather provides guidelines and criteria for the deciding official to consider when making a bail decision.
🏹That it denies bail to anyone charged with murder or gun offences. The Act does not impose a blanket ban on bail for these offences, but rather creates a presumption against bail unless the defendant can show exceptional circumstances that justify his or her release.
🏹That it violates the constitutional right to liberty and the presumption of innocence. The Act does not infringe on these fundamental rights, but rather balances them with the interests of public safety and justice.
