These Terms and Conditions of Use (“Terms”) apply to your access to and use of the CareRoad application (the “CareRoad App” or the “App”) and related services provided by CarePal Inc. (“CareRoad”), including any related software applications or websites (together, the “Services”). These Terms form a legal agreement between you and CareRoad, a company based in Montréal, Québec.
Who we are
CareRoad is a peer support platform designed to connect individuals who share the same health condition. Whether you have recently received a diagnosis or have been navigating your health journey for years, CareRoad offers a space to connect, share, and find support from others who truly understand.
Through the CareRoad App, you may connect with other users who share similar diagnoses (“CarePals”), create or join condition-specific support groups ("CareGroups"), exchange private messages with your CarePals, share stories, resources and personal experiences, customize your profile by selecting applicable health conditions, and receive real-time updates and notifications.
CareRoad is founded on the belief that connection and community are powerful tools for well-being. For clarity, CareRoad does not provide medical advice, diagnosis, or treatment of any kind, and nothing shared within the CareRoad App should be interpreted as such.
For more information, please visit https://careroad.ca. In these Terms, “we,” “us,” and “our” refer to CareRoad. “You” and “your” refer to the individual accessing or using the Services.
PLEASE READ THESE TERMS CAREFULLY.
By accessing or using the Services, or otherwise indicating your consent, you agree to be bound by these Terms and the documents referred to, which are hereby incorporated by reference therein, including, without limitation, our Privacy Policy found here: https://sites.google.com/view/careroad-privacy/home. If you do not agree with or accept any of these terms, you should cease using the Services immediately. If you have any questions or concerns about the website or the Services, please contact support@careroad.ca.
Using our Services
What you can do. You are granted a personal, non-exclusive, non-transferable, revocable right to access and use the Services, provided you comply with these Terms and with all applicable laws. This includes the ability to access the App, participate in CareGroups, interact with CarePals, and share content for personal support and community purposes.
What you cannot do. You agree not to misuse the Services in any way. The Services are provided solely for personal support and community purposes, and any attempt to disrupt, exploit, or use them for unlawful, harmful, or abusive activity is strictly prohibited. For example, you may not:
Misrepresent your identity, health condition, or any information you provide.
Infringe upon or violate the rights, privacy, or security of others.
Post or share content that is harmful, discriminatory, harassing, defamatory, or otherwise inappropriate.
Attempt to harvest, extract, or misuse personal information of other users.
Reverse engineer, copy, modify, sell, or exploit the Services or their underlying technology.
Interfere with, disrupt, or attempt to circumvent security features or protective measures of the Services.
Third party Services. Some features of the CareRoad App may rely on third-party software, platforms, or services (“Third-Party Services”), and may include content generated or transmitted through those services. These may include messaging infrastructure, hosting, or other tools that enable the operation of the App. Third-Party Services are subject to their own terms and conditions, and we are not responsible for them in any way. If you use the CareRoad App through external platforms, you understand that technical issues may result in delays, errors, or failed transmissions. You are responsible for managing your communication preferences, including compliance with any applicable opt-in or opt-out requirements.
Accuracy of Information and Limitations of Use. The CareRoad App is a community-based platform powered by technology that may evolve over time. While we make reasonable efforts to maintain stable and secure functionality, we do not guarantee that the Services will always be accurate, complete, uninterrupted, or free from errors.
By using the App, you understand and agree that:
Information shared within the App is provided by other users and reflects their personal experiences only. It should not be relied upon as medical advice or as a substitute for consultation with qualified healthcare professionals.
We do not verify the accuracy, completeness, or reliability of information shared by users, and we are not liable for any reliance you place on such information.
CareRoad does not provide professional medical, financial, legal, or technical advice.
We are not responsible for any decisions you make based on content or interactions within the App.
While we strive to make the Services available and functional at all times, we do not warrant uninterrupted or error-free operation. Access may be suspended or terminated without notice in cases of maintenance, technical issues, or updates. Service availability may also be affected by factors beyond our control, including temporary disruptions, slower response times, or data flow errors. Although updates and improvements are regularly implemented, scheduled maintenance may temporarily impact access.
CareRoad relies on secure cloud infrastructure provided by third-party providers, including Firebase (Google Cloud), in accordance with our Privacy Policy (https://sites.google.com/view/careroad-privacy/home). While reasonable efforts are made to maintain stability and data integrity, service availability may be impacted by technical events or disruptions beyond our control.
Liability. Certain legal provisions, including those under the Quebec Consumer Protection Act, CQLR c P-40.1, may limit or prohibit the exclusion or limitation of liability. Nothing in these Terms shall be interpreted as limiting or excluding any right or remedy to which you are entitled under applicable consumer protection laws.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TECHNOLOGIES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT ANY WARRANTIES, REPRESENTATIONS, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, CAREROAD DOES NOT WARRANT THAT (I) THE SERVICES WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS; (II) ACCESS TO THE SERVICES WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE; OR (III) THE INFORMATION OR CONTENT MADE AVAILABLE WILL BE ACCURATE, COMPLETE, OR RELIABLE.
You acknowledge and agree that any content or information shared by other users (including CarePals and CareGroups) reflects personal experiences only and is not verified or endorsed by CareRoad. CareRoad assumes no responsibility for the accuracy, completeness, or usefulness of such content.
TO THE EXTENT PERMITTED BY LAW, CAREROAD SHALL NOT BE LIABLE FOR ANY DAMAGE WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, SUCH AS LOSS OF PROFITS, LOSS OF DATA, LOSS OF REPUTATION, OR LOSS OF OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
User Responsibility and Indemnification. You are solely responsible for any content or information you share through the Services and for your interactions with other users. You agree to indemnify, defend, and hold harmless CareRoad, its affiliates, directors, employees, and service providers from any claims, damages, liabilities, losses, or expenses (including reasonable legal fees) arising out of or related to:
· Your use or misuse of the Services.
· Any violation of these Terms.
· Any User Content you provide or share through the Services.
Intellectual Property. All rights, title, and interest in and to the App, the Services, and all related content, features, and technology (including logos, designs, text, graphics, and software) are owned by CareRoad or its licensors. Nothing in these Terms transfers any intellectual property rights to you.
You retain ownership of the content you post, submit, or share through the Services (“User Content”). By posting or sharing User Content, you grant CareRoad a non-exclusive, royalty-free, worldwide licence to host, use, reproduce, display, and transmit such User Content solely for the purpose of operating and providing the Services.
CareRoad does not claim ownership of your personal data or your User Content.
Confidentiality. Protecting your privacy and personal information is a priority for us. As such, any personal information you provide through your use of the App will only be collected, stored and processed in compliance with applicable data protection laws, including, but not limited, to the Act respecting the protection of personal information in the private sector, CQLR c P-39.1. Please review our Privacy Policy (https://sites.google.com/view/careroad-privacy/home) to understand how, and for what purposes, we collect, use, and safeguard your information.
Use of Services. You must have the legal capacity to use the Services responsibly. If you are under 18 years of age (the age of majority in the province of Quebec), you may not use the services without the explicit consent and supervision of a parent or legal guardian.
Termination of Accounts. CareRoad reserves the right to prevent, restrict, or suspend your access to the Services for any reason, without notice and at any time (unless otherwise required by law), including, without limitation, your failure to comply with these Terms or with any applicable law, or if your conduct is otherwise harmful to the community or to the operation of the Services.
You may terminate your account at any time by following the account deletion process in the App or by contacting us at support@careroad.ca. Termination does not affect any obligations or rights accrued prior to termination.
Severability. If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect.
Entire Agreement. These Terms constitute the entire agreement between you and CareRoad regarding your use of the Services, and, except as otherwise stated herein, supersede any prior versions of these Terms.
Applicable Law. These Terms shall be construed in accordance with and governed by the laws of the Province of Québec, Canada, including, but not limited to, the Act respecting the protection of personal information in the private sector, CQLR c P-39.1, and the Consumer Protection Act, CQLR c P-40.1.
Notices and Communications. By using the Services, you agree that we may send you notices and communications electronically, including through the App or by email to the address associated with your account. Such notices are deemed received when sent. It is your responsibility to keep your contact information accurate and up to date.
Modification of the Services and Terms. We may update, suspend, or modify the Services from time to time, including changes to features, functionality, or content. We may also limit access to all or parts of the Services when necessary. While we make every effort to provide continuity, these changes may occur without prior notice.
WE MAY ALSO REVISE OR REPLACE THESE TERMS FROM TIME TO TIME. WHEN WE DO, WE WILL POST THE UPDATED VERSION ON OUR WEBSITE (https://sites.google.com/view/careroad-terms/home) AND INDICATE THE DATE OF THE MOST RECENT UPDATE AT THE TOP OF THE PAGE. UNLESS OTHERWISE REQUIRED BY LAW, ANY CHANGES WILL TAKE EFFECT 30 DAYS AFTER THEY ARE POSTED. IT IS YOUR RESPONSIBILITY TO REVIEW THE TERMS PERIODICALLY, ESPECIALLY BEFORE USING THE SERVICES. BY CONTINUING TO USE THE SERVICES AFTER THE CHANGES TAKE EFFECT, YOU AGREE TO BE BOUND BY THE UPDATED TERMS. IF YOU DO NOT ACCEPT THE REVISED TERMS, IN WHOLE OR IN PART, YOU MUST IMMEDIATELY STOP USING THE SERVICES, SINCE THE REVISED TERMS WILL APPLY TO YOU NONETHELESS.
