Terms of Use

Introduction

These Terms of Use ("Terms") govern your use of the application for Apple Watch and iPhone ("App"). The App is owned and operated by an independent developer ("I", "me", or "my").

By downloading or using Cardiac Alarm, you agree to these Terms. If you do not agree, please do not use the App.

About Cardiac Alarm

Cardiac Alarm reads your heart rate on your Apple Watch and sounds a siren when it crosses a low or high threshold that you set. You can add up to three Guards, whose iPhones sound an alarm at the same moment.

Important medical disclaimer

The App is intended for informational and monitoring purposes only. Cardiac Alarm is NOT a medical device and is not a substitute for professional medical advice, diagnosis or treatment. It does not replace emergency services or clinical monitoring, and it does not contact emergency services for you. Always seek the advice of your physician about any medical condition. In an emergency, contact your local emergency services immediately.

No guarantee that the alarm will sound

The App depends on things I do not control: the heart rate sensor in your watch, how the watch is worn, battery level, device settings, notification permissions and the internet connection. I therefore cannot guarantee that every critical heart rate will be detected, that the siren will sound, or that an alarm will reach your Guards. Do not rely on the App as your only safeguard, and test the alarm and your Guards regularly.

Guards

A Guard is a person you choose. A Guard uses the App for free and agrees in the App before being connected to you. Whether and how a Guard responds to an alarm is up to that person. I am not responsible for what a Guard does or does not do.

License

I grant you a non-transferable, non-exclusive, revocable license to use the App on devices you own or control, in accordance with these Terms and the App Store terms of service.

You may not:

Rent, lease, lend, sell, redistribute or sublicense the App

Copy, modify, reverse-engineer or create derivative works from the App

Acceptable use

You agree not to use the App:

For any unlawful purpose

To distribute malware or disrupt the App

In a way that infringes my or anyone else's intellectual property rights

Subscriptions and payments

All payments are handled by Apple. I do not process or store any payment information. A subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it at any time in your Apple account settings, and access continues until the end of the paid period. Refunds are handled by Apple under its own rules.

Privacy

Your use of the App is also governed by the Privacy Policy.

Updates and availability

The App may be updated from time to time to improve performance or functionality. I do not guarantee that the App will always be available or error-free.

Intellectual property

All intellectual property rights in the App and its content belong to me. You do not acquire ownership rights by using the App.

Limitation of liability

To the fullest extent permitted by law, I am not liable for any direct, indirect, incidental or consequential damages, including injury or death, arising from the use of or inability to use the App, including any failure to detect a heart rate event, sound the siren or alert your Guards. Nothing in these Terms limits liability that cannot be limited under applicable law.

Termination

I may terminate or suspend your access to the App if you breach these Terms. Upon termination, you must delete the App.

Changes to these Terms

I may update these Terms. The new version will be published on this page with a new effective date.

Governing Law

These Terms are governed by the laws of Croatia, and disputes will be resolved in the competent courts of Croatia. If you are a consumer in another EU country, you keep the protection of the mandatory consumer laws of your country.
