Welcome to Caption It – AI Photo Captions (“App”), developed by Victoria Seniuk (“we,” “our,” “us”). By using our App, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the App.

1. Eligibility

The App is intended for users aged 4 years and older. By using the App, you confirm that you meet this age requirement.

2. Accounts and Access

You can use the App anonymously and no account is required.

3. Subscriptions and Payments

• The App provides a free version with limited usage: 7 captions for 1 photo per day for 2 days.

• Premium subscriptions allow 7 captions per photo for up to 30 photos per day. New subscribers who subscribe to a monthly plan receive a 3-day premium trial.

• All payments are processed via Apple App Store subscriptions. Refunds and cancellations are subject to Apple’s policies.

4. Content and Ownership

• Users can upload photos or take pictures within the App.

• Captions are generated by OpenAI.

• Users own the rights to captions generated using the App and may share them publicly, including on social media platforms like Instagram.

4.1 AI Processing and Photo Handling

• Photos uploaded or taken in the App are temporarily processed by AI services (OpenAI) to generate captions.

• To comply with OpenAI API requirements, photos may be stored briefly on servers.

• All photos are automatically deleted after processing.

• By using the App, you consent to this temporary processing and storage.

5. Acceptable Use

• The App will not process photos that fail OpenAI moderation.

• Users must not use the App for illegal, offensive, or harmful purposes.

6. Disclaimers and Liability

• Captions are generated by AI. We are not responsible for inaccurate, inappropriate, or offensive captions.

• The App is provided “as-is,” and we do not guarantee that it will be uninterrupted or error-free.

• You agree to use the App at your own risk.

7. Termination

We may suspend or terminate access if a user violates these Terms or engages in prohibited behavior.

8. Governing Law and Apple App Store Compliance

• These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles.

• For users who access the App via the Apple App Store, your use is also subject to Apple’s Terms and Conditions.

• Depending on your location, local laws may provide additional rights or obligations. By using the App, you agree to comply with both these Terms and applicable laws.

9. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes indicates your acceptance of the updated Terms.

10. Fonts and Intellectual Property

All fonts used in the App are free or licensed for commercial use. We do not knowingly infringe on anyone’s intellectual property.
