NON - BREEDING AGREEMENT:
This puppy/dog is sold with a CKC NON-BREEDING AGREEMENT (CKC 201E1/93) which is to be signed in addition to this Agreement of Sale. The puppy/dog is to be purchased as a pet only and is not to be used for breeding.
The buyer understands that:
1) the buyer must provide the seller with a copy of the original certificate of spay/neuter of the above puppy/dog from a veterinarian. Puppy must be fixed before 1 year of age but not earlier than 4 months of age.
Note: The buyer may consult a veterinarian regarding alternate timelines. The buyer must report to the seller if the timeline must be revised as per their veterinarian’s advice. The buyer must provide the seller with a written letter from their veterinarian advising of why the timeline must be changed and advising when the puppy/dog will be spayed/neutered.
2) the buyer must provide the seller with an up to date original or digital photo of puppy at 6 months of age and again at 1 year of age with their up-to-date height and weight measurements.
Note: To measure height of the puppy/dog: Put the puppy on the floor standing on all fours. Measure from the floor to the highest point of the shoulder near the back of neck. Keep measuring tape straight and ensure it does not bend over the dogs back or shoulders.
If the buyer violates the non-breeding agreement and breeds the dam/sire dog sold, the seller can take legal action by suing the buyer for cash reimbursement for the value of the mother and number of offspring, and the seller has the right to seize the dam/sire and the offspring from the buyer immediately and without written notice. The minimum fine is $5,000.00.

GUARANTEES:
Guarantees are valid only to the original buyer(s) named in this Agreement of Sale.
Any violation of this Agreement of Sale (such as violation of the non-breeding agreement, improper care of the puppy/dog, inability to spay/neuter the puppy/dog), will nullify all guarantees.
A. THE FIRST 72 HOURS: The seller has had this puppy/dog examined by their veterinarian prior the puppy/dog being placed with the buyer (please refer to the health record/vet certificate to show your puppy/dog’s up-to-date vaccinations).
i. The buyer has 72 hours to take the puppy to a veterinarian of their own choice for a general health check. All veterinary and travel/shipping/medical expenses incurred after the departure from the seller are the sole responsibility of the buyer.
ii. If the vet determines there is a life-threatening health concern within the first 72 hours of purchase, which is caused by a hereditary or congenital condition, the buyer can return the puppy for a new puppy of equal value at the seller’s discretion and sole decision.
B. THE FIRST YEAR: This puppy is guaranteed for 1 year for the following: hereditary eye diseases causing permanent blindness and hereditary heart diseases causing death. This puppy is guaranteed to be free from hereditary fault which necessitates the puppy to be put to sleep within one (1) year of purchase.
i. The seller/kennel reserves the right to have the puppy/dog re-examined by a veterinarian of the seller’s choosing at the buyer’s expense.
ii. As determined by the seller, the buyer can return the puppy for a new puppy of equal value at the seller’s discretion and sole decision. Under No Circumstances Will Cash Be Refunded.

THE SELLER WARRANTS THAT:
o This puppy/dog is a purebred Toy/Miniature Poodle. This puppy/dog is of typical temperament and structure and embodies the basic standards of the Poodle’s breed.
o The parents of the puppy/dog are registered with the CKC.
o The puppy/dog’s sire and dam are free of hip dysplasia, cataracts, and other health issues common to the Poodle breed. The dog’s sire and dam come from many generations of dogs who are free of health concerns. The puppy/dog is expected to be free of hereditary health concerns. However, no guarantee of such is or can be made, or intended herein.
o The puppy/dog is healthy at the time of sale and has had immunizations enumerated in the attached health record/vet certificate. The seller warrants that the puppy/dog has been examined by a veterinarian before being placed with the buyer(s) and the puppy/dog received a clean bill of health from the veterinarian.
o The seller agrees to provide the buyer(s) with advice and information on grooming, training and after care of the puppy/dog to the best of his/her ability to help the canine to its best potential.
o If the seller determines, by any means, that the puppy/dog is not suitably cared for, or that it has been mentally or physically mistreated and/or neglected, the seller has the right to take full possession of the dog, and, if applicable, its duly signed CKC transfer papers/registration, without compensation. The seller’s opinion is the only authority required to justify this action. Testimony of other people will not supersede the seller’s judgment on this matter. Under such circumstances, all warranties of the contract are then NULL AND VOID.

THE BUYER WARRANTS THAT:
o The buyer(s) are of the legal age of eighteen (18) years or older and have provided the seller(s) with 2 pieces of valid government identification in order to verify their identity, upon request of the seller.
o If at any time the buyer is unable to keep or care for the puppy/dog, it must be returned to the seller with no refund payable to the buyer. The puppy/dog may not be transferred or sold by the buyer under any circumstances without the written consent of the seller(s) listed in this Agreement of Sale. The seller(s) will endeavor to place any returned puppy/dog as advantageously as possible. If a purchase price is obtained for the puppy/dog, it will not be refunded to the original buyer. No veterinary, or other costs of keeping the puppy/dog, or any other costs incurred by the buyer resulting from his/her ownership of the puppy/dog, will be paid by the seller to the original buyer of the puppy/dog under any circumstances. The puppy/dog is not to be surrendered to an animal shelter under any circumstances.
o The buyer agrees to maintain the puppy/dog’s health with yearly vaccinations and check ups as specified by their veterinarian. The buyer agrees to keep the puppy/dog in an appropriate lean weight to maximize the puppy/dog’s soundness and longevity. The buyer agrees to socialize, train, and keep the puppy/dog in a manner acceptable to the seller and as determined by a veterinarian. The buyer acknowledges that special coat care, conditioning, training, and feeding are necessary to produce a healthy, well socialized Poodle and that this care, cost, and training is the sole responsibility of the buyer.
o Should the puppy/dog become ill or unsound, all costs of treatment will be the responsibility of the buyer.
o The buyer agrees to spay/neuter the puppy/dog before the dog reaches the age of one (1) year old but not before the dog reaches 4 months old. The buyer is responsible for all costs associated with this alteration. The buyer will provide the seller with proof of alteration (spay/neuter) as soon as possible and prior to 1 year after the date of signing this Agreement of Sale.
o The buyer agrees that, if a female comes into an estrous cycle or a male becomes sexually mature before alteration occurs, the puppy/dog will NOT be housed with other unaltered puppies/dogs. The buyer(s) must not allow any interactions with unaltered puppies/dogs (i.e. Dog Park, doggy daycare, visits to other pets, etc.) until the heat cycle has finished to prevent any accidental mating or pregnancies. Breeding of a puppy/dog when they are too young can be very dangerous for the health of the dog and its puppies.
o The buyer acknowledges that while the puppy is still rapidly growing for the first year of its life, it is HIGHLY DISCOURAGED to allow your puppy to climb up or down any sets of stairs (or similar strenuous activities such as jumping on/off the couch or extended/strenuous exercise) for the first 1.5 years of the puppy’s life. It is important not to stress the puppy’s growing knees/hips/joints as this can lead to joint issues later in the dog’s life. Any knee or joint issues caused as a result of such strain is not covered by the seller.

No other warranties or guarantees, expressed or implied, are made under this contract except as stated above. Signature of buyer(s) and seller(s) signify that this Agreement of Sale creates a legally binding contract. Signature of buyer(s) and seller(s) is to confirm that I/we understand and agree with the above and previous statements contained in this Agreement of Sale.
