Terms of Use and End User License Agreement

Introduction

This Terms of Use and End User License Agreement (collectively, the “Agreement”) is a legally binding agreement between you, a natural person (“you”, “your” or “user”), and The Call Recorder App (“we,” “us” or “our”). This Agreement, along with all referenced documents, governs your access to and use of The Call Recorder App software application for mobile devices (the “App”). Note that the App’s title may vary in countries outside the U.S. and is subject to change without notice.

Please read this Agreement carefully before downloading, installing, or using the App. By doing so, you acknowledge that you have read, understood, and agreed to the terms of this Agreement. If you do not agree with any part of this Agreement, you are not authorized to access, download, install, or use the App and must promptly remove it from any device under your control.

Changes to This Agreement

We reserve the right to modify this Agreement at any time and for any reason at our sole discretion. We will inform you of any changes by updating this Agreement, and you waive the right to receive specific notice of each change. It is your responsibility to periodically review this Agreement to stay informed of updates. Continued use of the App after the revised Agreement is posted constitutes your acceptance of the changes.

Restrictions on Who Can Use the App

To use the App, you must be at least eighteen (18) years of age. Minors aged thirteen (13) to seventeen (17) must have parental or guardian consent and supervision to use the App. Anyone under the age of thirteen (13) is prohibited from using the App. By using the App, you affirm that you meet these age requirements and have the capacity to enter into this Agreement.

General Terms

The App is a utility designed to enhance your device experience by allowing you to record calls, manage recordings, and convert audio to text. The App is for personal, non-commercial use only.

Privacy Policy

Your privacy is important to us. Our Privacy Policy outlines how we process, use, and store information, including personal data. By using the App, you accept the terms of the Privacy Policy. If you disagree with any part of the Privacy Policy, you must stop using the App immediately. Please ensure you comply with privacy laws by notifying call participants before recording.

End User License Agreement

By using the App, you agree to respect our intellectual property rights and those of third parties. We grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the App as per this Agreement. All rights, title, and interest in the App and its content remain with us and our partners.

Prohibited Behavior

You agree not to use the App in any manner that is unlawful, defamatory, obscene, offensive, or infringes on the rights of others. You shall not modify, distribute, or create derivative works from the App. Unauthorized use of our intellectual property is prohibited. We reserve the right to take legal action against violations.

Specific Requirements and Legal Considerations for Call Recordings

You must comply with all applicable laws regarding call recording. Laws vary by jurisdiction, and it is your responsibility to ensure compliance. You must obtain explicit consent from all call participants before recording.

Availability of the App, Security, and Accuracy

The App requires a compatible device and internet access. We do not guarantee compatibility with all devices or uninterrupted access to the App. The App may be updated or suspended at any time without notice. You are responsible for ensuring the accuracy of any information you provide.

Charges

The App offers basic features for free. Access to premium features requires a paid subscription. Subscription details and pricing are available on the App’s page. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Charges from your mobile service provider may apply.

Third-Party Websites and Resources

The App may link to third-party sites. We are not responsible for the content or services of linked sites. Your use of third-party sites is at your own risk.

Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. We are not responsible for the accuracy of transcriptions or the quality of recordings.

Limitation of Liability

We are not liable for any direct, indirect, incidental, or punitive damages arising from your use of the App. You are solely responsible for compliance with call recording laws.

Legal Compliance

You represent and warrant that you are not located in a country subject to U.S. Government embargo or listed as a prohibited party.

Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce its terms.

Governing Law and Claims

This Agreement is governed by the laws of the State of New York, USA. Any disputes will be resolved in the courts of New York, NY, USA. You waive the right to pursue class action.

Termination

We may terminate this Agreement at any time. Upon termination, you must cease all use of the App.

Severability

If any provision of this Agreement is found to be illegal or unenforceable, it will be modified or deleted to the extent necessary to be enforceable. The remaining terms will continue in full force.
