The Difference Between An Exemptee Versus A Designated Representative
There is often confusion between the two.
A 2006 California law change started the confusion. This snippet comes from an old 2012 version of the California Designated Representative application:
"Note: Under California law, the name used to describe any individual who is in charge of any wholesale drug premises (in California or elsewhere) will change on January 1, 2006, from the former name, exemptee, to designated representative. For conventional use, the board will refer to such an individual as a designated representative throughout this application."
Therefore, the California State Board of Pharmacy uses the current name, Designated Representative.
The California Department of Public Health HMDR Exemptee
To add more confusion, an Exemptee personal license does exist.
However, it is administered by the California Department of Public Health (CDPH) - Food and Drug Branch (FDB) and applies to home medical device retailers (HMDR). An HMDR facility typically needs to employ an individual(s) holding an Exemptee personal license.
