Please read these Terms and Conditions ("Terms") carefully before using the Bunni mobile
application ("App") operated by Gaudas Palubaitis ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you
do not agree to these Terms, do not use the App.
1. DEFINITIONS
"App" means the Bunni mobile application available on the Apple App Store.
"Service" means all features and functionality provided by the App, including focus
timers, app blocking, screen time monitoring, habit tracking, AI-generated messages,
and daily insights.
"User" or "You" means any individual who downloads, installs, or uses the App.
"Content" means all text, graphics, images, animations, and other materials displayed
within the App, including the Bunni mascot character and AI-generated messages.
"Subscription" means a paid plan that grants access to premium features within the App.
"Focus Session" means a timed period during which the App blocks selected applications
on your device.
"Screen Time Data" means approximate device usage information collected via Apple's
Device Activity framework.
2. ELIGIBILITY
You must be at least 13 years of age to use the App. If you are between 13 and 18 years of
age, you must have the consent of a parent or legal guardian to use the App. By using the
App, you represent and warrant that you meet these eligibility requirements.
3. DESCRIPTION OF SERVICE
Bunni is a screen time management and focus productivity application that provides:
- Focus Sessions: Timed sessions (5 to 120 minutes) during which selected apps are
blocked at the system level using Apple's Screen Time API.
- Screen Time Monitoring: Approximate tracking of daily device usage via Apple's Device
Activity framework.
- Habit Scheduling: Recurring schedules to automatically block distracting apps during
designated time windows.
- Block Lists: Customizable groups of apps to block during focus sessions and habits.
- Daily Insights: Statistics, trends, and wellness metrics based on your usage patterns.
- AI-Powered Messages: Personalized motivational messages generated by artificial
intelligence (OpenAI GPT-4o-mini).
- Streak Tracking: Consecutive-day tracking to encourage consistent focus habits.
- Spoken Affirmations: Optional voice-based affirmation feature using speech recognition.
The App requires iOS and specific system permissions (Screen Time access, and optionally
microphone and speech recognition) to function properly.
4. ACCOUNT AND REGISTRATION
The App does not currently require account creation or registration. All data is stored
locally on your device. If we introduce account features in the future, these Terms will
be updated accordingly.
5. SUBSCRIPTIONS AND PAYMENTS
5.1 Subscription Plans
The App may offer premium features through paid subscription plans. Details of available
plans and pricing are displayed within the App.
5.2 Auto-Renewal
IMPORTANT: Subscriptions automatically renew at the end of each billing period unless you
cancel at least 24 hours before the end of the current period. The renewal charge will be
applied to your Apple ID account within 24 hours prior to the end of the current period at
the same price as the original subscription, unless the price has changed (in which case
you will be notified in advance).
5.3 Payment Processing
All payments are processed by Apple through the App Store. We do not directly collect or
store your payment information (credit card numbers, bank details, etc.). All transactions
are governed by Apple's terms and conditions for in-app purchases.
5.4 How to Cancel
You can cancel your subscription at any time through:
- iPhone Settings > [Your Name] > Subscriptions > Bunni > Cancel Subscription
- Or through the App Store app > your profile > Subscriptions
Cancellation takes effect at the end of the current billing period. You will retain access
to premium features until the end of the period you have already paid for.
5.5 Refunds
Refund requests are handled by Apple in accordance with their refund policy. To request a
refund, visit https://reportaproblem.apple.com or contact Apple Support. We do not process
refunds directly.
5.6 Free Trials
If a free trial is offered, it will convert to a paid subscription at the end of the trial
period unless cancelled at least 24 hours before the trial ends. Any unused portion of a
free trial is forfeited upon purchasing a subscription.
5.7 Price Changes
We reserve the right to change subscription pricing. You will be notified of any price
changes before they take effect, and you will have the option to cancel before the new
price applies.
6. LICENSE AND INTELLECTUAL PROPERTY
6.1 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to download,
install, and use the App on a device that you own or control, strictly in accordance with
these Terms.
6.2 Intellectual Property
All rights, title, and interest in and to the App, including but not limited to:
- The Bunni brand name, logo, and mascot character (all visual representations)
- App design, user interface, and user experience
- Source code, algorithms, and underlying technology
- Graphics, animations, fonts, and visual elements
- Marketing materials and promotional content
are and shall remain the exclusive property of Gaudas Palubaitis. These Terms do not grant
you any rights to our intellectual property except for the limited license described above.
6.3 Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or disassemble the App
- Attempt to extract the source code of the App
- Remove or alter any proprietary notices or labels on the App
- Use the App for any commercial purpose without our written consent
- Create derivative works based on the App
- Use automated systems or bots to interact with the App
7. USER CONDUCT
You agree to use the App only for its intended purpose and in compliance with all applicable
laws. You agree not to:
- Use the App for any unlawful purpose
- Attempt to circumvent, disable, or interfere with any security features of the App
- Interfere with or disrupt the App's functionality or connected services
- Attempt to gain unauthorized access to any systems or networks connected to the App
- Use the App in any way that could damage, disable, or impair the App
- Misrepresent your identity or affiliation when using the App
8. SCREEN TIME AND APP BLOCKING
8.1 System-Level Blocking
The App uses Apple's Screen Time API (Family Controls and Managed Settings frameworks) to
block selected applications at the system level during focus sessions and scheduled habits.
By enabling this feature, you acknowledge and agree that:
- Selected apps will be inaccessible during active focus sessions
- You may miss notifications, calls, messages, or alerts from blocked apps
- Blocking effectiveness depends on Apple's Screen Time API and may vary
- System updates or changes to iOS may affect blocking functionality
8.2 Screen Time Accuracy
Screen time estimates provided by the App are approximate and calculated in 5-minute
intervals. These estimates may not exactly match other screen time tracking tools or
Apple's built-in Screen Time reports. We do not guarantee the accuracy of screen time
measurements.
8.3 User Responsibility
You are solely responsible for choosing which apps to block and when. We are not liable for
any consequences arising from blocked apps, including but not limited to missed
communications, delayed responses, or inaccessible emergency services. We recommend that
you do not block essential communication or emergency apps.
9. AI-GENERATED CONTENT
9.1 Nature of AI Content
The App uses OpenAI's GPT-4o-mini model to generate personalized motivational messages
from the Bunni mascot character. You acknowledge and agree that:
- AI-generated messages are for entertainment and general motivation only
- Messages may occasionally contain inaccurate, inappropriate, or unexpected content
- AI responses are generated automatically and are not reviewed by a human before display
- Message quality and tone may vary
9.2 Not Professional Advice
AI-generated messages do NOT constitute:
- Medical, psychological, or therapeutic advice
- Professional counseling or mental health treatment
- Clinical recommendations for screen time management
- Any form of professional guidance
If you are experiencing mental health concerns, screen addiction, or related issues, please
consult a qualified healthcare professional.
9.3 Data Usage for AI
To generate personalized messages, aggregated and anonymized usage statistics are sent to
OpenAI's API. No personally identifiable information is included. See our Privacy Policy
for full details on what data is shared.
10. HEALTH AND WELLNESS DISCLAIMER
10.1 Not a Medical Device
The App is a productivity and focus tool. It is NOT a medical device, therapeutic tool, or
clinical intervention. The App does not diagnose, treat, cure, or prevent any medical
condition or mental health disorder.
10.2 No Guaranteed Outcomes
We do not guarantee that using the App will:
- Reduce your screen time by any specific amount
- Improve your focus, productivity, or wellbeing
- Change your habits or behavior patterns
- Produce any particular health or wellness outcome
Results vary by individual and depend on many factors outside our control.
10.3 Professional Help
If you are struggling with screen addiction, compulsive device use, or related mental
health issues, we encourage you to seek help from a qualified professional. The App is a
supplementary tool and should not replace professional treatment.
11. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND,
EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- THE RESULTS OBTAINED FROM THE APP WILL BE ACCURATE OR RELIABLE
- ANY ERRORS IN THE APP WILL BE CORRECTED
- THE APP WILL BE COMPATIBLE WITH ALL DEVICES OR OPERATING SYSTEM VERSIONS
- THE APP BLOCKING FEATURE WILL WORK PERFECTLY IN ALL SCENARIOS
- THIRD-PARTY SERVICES (OPENAI, APPLE APIS) WILL REMAIN AVAILABLE OR UNCHANGED
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
12.1 WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR
PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF
GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
12.2 OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS
OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR THE APP IN THE
TWELVE (12) MONTHS PRECEDING THE CLAIM.
12.3 WE ARE NOT LIABLE FOR:
- Missed communications or notifications during focus sessions
- Data loss resulting from device failure, App uninstallation, or system updates
- Changes to Apple's Screen Time API that affect App functionality
- Interruptions to third-party services (OpenAI, Superwall, Apple)
- Actions taken based on AI-generated messages
- Any consequences of your chosen app blocking configurations
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Gaudas Palubaitis and any affiliated
parties from and against any claims, liabilities, damages, losses, costs, and expenses
(including reasonable attorney fees) arising out of or relating to:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your violation of any third-party rights
14. THIRD-PARTY SERVICES
14.1 The App relies on third-party services, including:
- Apple's Screen Time API (Family Controls, Device Activity, Managed Settings): For
system-level app blocking and screen time monitoring
- OpenAI API: For generating AI-powered motivational messages
- Superwall: For subscription and paywall management
- Apple App Store: For app distribution and payment processing
14.2 These third-party services are governed by their own terms and conditions and privacy
policies. Changes to these services may affect the App's functionality, and we are not
responsible for the actions, availability, or policies of third-party providers.
14.3 We are not responsible for any content, accuracy, or practices of third-party services
linked to or integrated within the App.
15. TERMINATION
15.1 By You
You may stop using the App at any time by uninstalling it from your device. If you have an
active subscription, you must cancel it separately through Apple's subscription management
(see Section 5.4).
15.2 By Us
We reserve the right to suspend or terminate your access to the App at any time, with or
without notice, for any reason, including but not limited to violation of these Terms.
15.3 Effect of Termination
Upon termination:
- Your license to use the App is immediately revoked
- All locally stored data remains on your device until you uninstall the App
- Active subscriptions may continue until the end of the current billing period, subject
to Apple's policies
- Sections of these Terms that by their nature should survive termination shall continue
to apply (including Sections 6, 11, 12, 13, and 17)
16. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. If we make material changes, we will
notify you by:
- Posting the updated Terms within the App
- Updating the "Last Updated" date at the top of these Terms
Your continued use of the App after any modifications constitutes acceptance of the updated
Terms. If you do not agree to the modified Terms, you should stop using the App.
17. GOVERNING LAW AND DISPUTE RESOLUTION
17.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic
of Lithuania, without regard to its conflict of law provisions.
17.2 Dispute Resolution
Any dispute arising from or relating to these Terms or the App shall first be attempted to
be resolved through good-faith negotiation. If the dispute cannot be resolved informally
within 30 days, either party may pursue resolution through the competent courts of
Lithuania.
17.3 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision
shall be limited or eliminated to the minimum extent necessary, and the remaining provisions
shall remain in full force and effect.
17.4 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver
of such right or provision.
18. GENERAL PROVISIONS
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you
and us regarding the App and supersede all prior agreements and understandings.
18.2 Assignment
You may not assign or transfer your rights under these Terms without our prior written
consent. We may assign our rights and obligations under these Terms without restriction.
18.3 Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to
circumstances beyond our reasonable control, including but not limited to natural disasters,
government actions, internet or telecommunications failures, or changes to third-party
APIs or services.
18.4 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
