Deposit (CAD/USD):
For real-world currency orders (CAD/USD), a 50% non-refundable deposit* is due immediately upon your commission being accepted. Work will not begin until this payment is received.
Final Payment (CAD/USD):
The remaining 50% balance is due within one (1) week of me notifying you of completion, regardless of when you viewed my message.
In-Game Currency Orders:
I may occasionally offer art sales on a sim website (ex. FP, HOFA, etc.) for in-game currency. A deposit is not required for in-game currency payments and payment is only due upon completion of the artwork, unless otherwise specified in the posting.
If no in-game currency payment is offered on the advertisement, the art is only available for CAD.
All other clauses not relating to deposits also apply to purchases made with in-game currency.
Pricing and Quotes:
While approximate price ranges for custom orders are provided on the website, the final price is determined by the specific quote provided. I reserve the right to adjust the final price from the initial estimated ranges advertised depending on complexity of the request.
Unpaid Artwork:
All rights and ownership of unpaid artwork remain solely with me. You may not use it for any purpose until paid for. If the balance is not paid within the one (1) week window, I may opt to repurpose the art and you will need to organize a new contract with me to purchase it; do not just send the late payment without discussing first, as the art may no longer be available for sale.
If repurposed outside my portfolio, unique traits (unique tattoos, unique brands, unique scars, unique accessories) of any characters you own the rights to will be removed. Generic traits that can reasonably apply to other characters will not be removed.
Delivery:
High-resolution, unwatermarked digital files are provided only after final payment has cleared. There is no physical product.
Agreement:
By paying the deposit, you automatically agree to all terms listed in this document.
Final Sale:
All payments, including deposits, are non-refundable*.
*Deposit Exception:
In special cases, a refund of the deposit is may be requested only if I have provided one (1) or no (0) version(s) of the sketch and you opt not to proceed. This exception will be accepted or denied at my discretion.
Conditions: The sketch must contain no more than one (1) character and two (2) minor character add-ons. This applies even if no sketch has been provided yet, as work may have already begun. You also must not have used this exception in the past.
Timeline: Requests to cancel must be made within three (3) days of the sketch being provided (regardless of when it was viewed) OR within three (3) days of your payment if no sketch has been provided yet.
Exclusions: You are not eligible for consideration if you have requested any changes, or if you wish to start a new sketch with a different design. See Custom Order Revisions below for more information.
Rights: All rights to a refunded sketch remain with me. You may not use it for any purpose. I will remove unique traits for any characters you have ownership of (unique tattoos, unique brands, unique scars, unique accessories) before repurposing art for uses other than my portfolio. Generic traits that can reasonably apply to other characters will not be removed.
Recolours: This exception does not apply to lineart recolours (“your character here” compositions, typically sold as profile tags), which are entirely non-refundable.
Sketch Phase:
One (1) large revision is included for free during the sketch stage. The number of free small adjustments allowed is at my discretion.
Post-Sketch:
Any adjustments requested after the sketch is approved or after completion will potentially incur additional fees. I reserve the right to reject edits.
Errors:
Clear errors (not artistic choices) will be fixed free of charge within one (1) week of the final upload. After one week, edits depend on file accessibility. I reserve the exclusive right to determine what constitutes an error.
This does not apply to recolours, as you will have seen the line art prior to purchase.
Complexity:
Significant changes to the original scope may be denied or require a new commission at full price. This clause does not include the one (1) large revision permitted during the sketch phase.
I, the Artist, retain all exclusive rights to the artwork. This includes the right to use unedited versions for my portfolio, social media, or promotion.
Where you CAN use the art: You are granted a license for Personal Use. This includes using the art as avatars, profile tags, headers, and banners on any website/social media platform, or for personal physical prints. If you purchased the art through a post on a sim site, you are not limited to only using the art on that site.
Where you CANNOT use the art: You may not use the art for any commercial purpose (making money). This includes:
Selling or exchanging the art (digitally or physically).
Using the art for NFTs, Blockchain, or AI training/Generators.
Using the art in any published material (books, games, etc.), even if distributed for free.
No Alterations: You may not edit, filter, or alter the artwork in any form without my express written permission. Layered files (.PSD, .KRA, etc.) will not be provided.
Signature: My signature must never be removed. If you are unhappy with the image version of my signature (a ⭐🍓 accessory somewhere in the image), you may request a text version instead. Please note that signature styles may vary depending on the platform of purchase.
Art Resale: You are permitted to resell the artwork for personal use at a price not exceeding the original purchase price.
Character Designs: If the commission includes an original character design by the Artist, the character may be resold. If the resale price is higher than the original purchase due to the inclusion of additional commissioned artwork (complimentary pieces), you must contact the Artist for verification of these additions.
Completion Estimates:
Completion may take up to 90 days, though typical turnaround times are significantly shorter. Please consult the 'Waitlists' section under the 'Info' menu on the website for the most current service estimates.
Termination of Service:
I reserve the right to deny any commission for any reason.
I reserve the right to terminate any project at any time. Should termination occur through no fault of the Client, all deposit fees shall be refunded.
For the purposes of these Terms, "Client Fault" includes, but is not limited to:
Non-Responsiveness: Failure to respond to communications or approval requests for more than 14 consecutive days.
Harassment: Use of abusive, threatening, or highly unprofessional language toward the Artist.
Scope Creep: Persistent requests for features or changes that fall significantly outside the original agreed-upon quote without a willingness to adjust the price.
Breach of Terms: Any violation of the usage rights or signature policies outlined above.
