These Terms of Use (“Terms”) govern your use of BrainPearl (“BrainPearl,” “the App,” “we,” “us,” or “our”).
Please read these Terms before using the App. By downloading, installing, accessing, or using BrainPearl, you agree to these Terms. If you do not agree, do not use the App.
1. About BrainPearl
BrainPearl is an English-language word-category puzzle game.
The App may include:
• Standard word-grouping levels
• Different bubble interaction modes
• Experimental challenges
• Tutorials
• Hints
• Local challenge records
• Sound effects
• Haptic feedback
• Locally stored gameplay progress
The App is currently provided without advertising, subscriptions, or in-app purchases.
2. Eligibility
You may use BrainPearl only if you are legally permitted to use the App under the laws applicable to you.
If you are not legally able to agree to these Terms on your own, you may use the App only with the involvement and permission of a parent or legal guardian.
Parents and legal guardians are responsible for supervising use of the App by children under their care.
3. Limited License
Subject to these Terms, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use BrainPearl on devices that you own or control, solely for personal and non-commercial entertainment.
This license does not transfer ownership of the App or any content within it.
4. Acceptable Use
You agree not to:
• Copy, redistribute, sell, rent, lease, sublicense, or commercially exploit the App
• Reverse engineer, decompile, disassemble, or attempt to derive the App’s source code except where applicable law expressly permits it
• Modify the App or create unauthorized derivative works
• Circumvent gameplay restrictions, security measures, or technical protections
• Interfere with the normal operation of the App
• Use automated systems to extract content or assets from the App
• Misrepresent your relationship with the App or its developer
• Use the App for unlawful, fraudulent, abusive, or harmful purposes
• Reproduce or distribute the App’s artwork, audio, level content, text, visual design, or other protected material without permission
• Attempt to introduce malicious code, corrupted data, or other harmful material
5. Gameplay Content
BrainPearl contains word-category puzzles intended for entertainment and general cognitive engagement.
Although we try to make word relationships clear and accurate:
• Some words may have more than one meaning
• Categories may depend on common usage or context
• A puzzle answer may not represent every possible interpretation of a word
• Difficulty and clarity may vary between levels
• Experimental challenges may contain unfinished or less-polished mechanics
The App does not provide professional educational, medical, psychological, diagnostic, or therapeutic services.
No particular improvement in intelligence, memory, vocabulary, academic performance, or cognitive ability is promised or guaranteed.
6. Experimental Features
BrainPearl may include experimental gameplay modes or challenges designed to test new interactions.
Experimental features:
• May behave differently from standard levels
• May change or be removed in later versions
• May contain visual, balancing, or interaction limitations
• May not preserve progress in the same way as standard levels
• Are provided for entertainment and testing purposes
Your feedback about experimental features is welcome, but we are not obligated to implement suggestions or maintain a particular experimental feature.
7. Local Progress and Device Storage
Gameplay progress and settings are stored locally on your device.
You acknowledge that locally stored information may be lost if:
• You uninstall the App
• You reset your progress
• You clear the App’s storage
• Your device is lost, damaged, replaced, or reset
• Your operating system removes or corrupts stored data
• An update, device issue, or software error affects local storage
We do not operate a gameplay account or cloud-save service and cannot remotely restore lost progress.
You are responsible for maintaining any device backups available through your operating-system provider.
8. Sound and Haptic Feedback
The App may produce sound effects and device vibrations during gameplay.
You can disable sound and haptic feedback through the App’s Settings page. You may also control sound, vibration, and accessibility settings through your device.
Use the App at a comfortable sound level and in a manner appropriate for your surroundings.
9. Intellectual Property
BrainPearl and its associated software, gameplay systems, artwork, graphics, interface designs, animations, audio, text, level structures, branding, and other content are owned by or licensed to the developer and are protected by applicable intellectual-property laws.
“BrainPearl,” the BrainPearl icon, and related visual identity may not be used in a way that suggests endorsement, affiliation, or ownership without permission.
No rights are granted except for the limited right to use the App under these Terms.
10. Feedback
If you send suggestions, ideas, bug reports, or other feedback, you permit us to use that feedback to evaluate and improve the App without an obligation to compensate you.
You retain ownership of any original material contained in your feedback. Do not submit confidential information or material that you do not have the right to provide.
11. Updates and Changes
We may release updates that:
• Add, change, rebalance, or remove levels
• Modify gameplay mechanics
• Correct errors
• Improve compatibility
• Change visual or audio content
• Improve security or accessibility
• Change experimental features
• Update legal or policy information
Some updates may be necessary for continued compatibility with supported operating systems or devices.
We do not guarantee that every feature, level, mode, or visual design will remain available permanently.
12. Availability
We aim to keep BrainPearl functional, but we do not guarantee that the App will always be available, uninterrupted, compatible with every device, or free from errors.
Availability may be affected by:
• Device compatibility
• Operating-system changes
• App Store availability
• Technical problems
• Maintenance
• Security requirements
• Legal or regulatory requirements
• Events outside our reasonable control
We may suspend, modify, or discontinue the App or any feature where reasonably necessary.
13. Third-Party Platforms
Your download and use of BrainPearl may also be subject to the rules and terms of the platform through which you obtained the App, including Apple’s App Store terms.
The platform provider is not responsible for gameplay content, local progress, or support provided by the developer, except to the extent required by the platform provider’s own terms or applicable law.
If these Terms conflict with mandatory platform rules, the applicable mandatory platform rules will control to the extent of the conflict.
14. No Purchases or Subscriptions
The current version of BrainPearl does not offer subscriptions, in-app purchases, paid virtual items, or advertising-based rewards.
Nothing in these Terms requires us to add paid features in the future. If commercial features are introduced later, applicable terms, disclosures, and purchase information will be provided before they apply.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, BrainPearl is provided on an “as is” and “as available” basis.
We do not make warranties or guarantees that:
• The App will meet every user’s expectations
• Every puzzle will have only one imaginable interpretation
• The App will operate without interruption or error
• Local progress will never be lost
• Every device or operating-system version will be supported
• Use of the App will produce a particular educational or cognitive result
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
16. Limitation of Liability
To the maximum extent permitted by applicable law, the developer will not be liable for indirect, incidental, special, consequential, or punitive losses arising from or relating to your use of or inability to use the App.
This may include loss of locally stored gameplay progress, interruption of use, device incompatibility, or reliance on gameplay content.
Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.
17. Suspension or Termination
Your right to use the App may end if you materially violate these Terms.
You may stop using the App at any time by uninstalling it.
Sections that by their nature should continue after termination—including intellectual-property provisions, disclaimers, limitations of liability, and applicable legal provisions—will continue to apply.
18. Changes to These Terms
We may update these Terms to reflect:
• Changes to the App
• New features
• Security requirements
• Platform requirements
• Legal or regulatory developments
• Clarifications to existing provisions
The updated Terms will show a revised effective date. Where required, material changes will be communicated through the App or the public page hosting these Terms.
Your continued use of the App after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
An invalid or unenforceable provision will be interpreted or limited only to the extent necessary to make it enforceable, where permitted by law.
20. Entire Agreement
These Terms and the Privacy Policy constitute the agreement governing your use of BrainPearl, except for any mandatory terms imposed by the platform through which you obtained the App.
