I have the right to share finished artwork in my Portfolio or Social medias. The commissioner can ask to keep the piece private, but this needs to be established before ordering the piece! (see Exclusive Content section for more about private commissions.)
I may use a commission to create a timelapse of the art process and upload it to my Patreon. The finished commission piece itself is not used for Patreon and the only person to receive the full resolution is the client. (only exception to this is if the commission is agreed to be private.)
Client alone may use their commissioned art for personal projects, site cosmetics, character's art gallery (such as Toyhou.se, Refsheet,...), Non-profit literature cover (digital fics, OC stories,...), etc...
If the commissioned character changes ownership, any additional bought artwork may be transferred with the character, though this is up to the original Client of the art piece. All pieces of the original adoptable should go with the transfer to the new owner. I understand some attachments to a piece personally ordered to fit a personal idea and not wanting someone else to use it.
For commercial use of the art, the Client may contact me to discuss the intended use, and the fee or royalties of said piece's use.
I do not permit the usage of my personal work (fully original or fan art made for myself) to be used without my permission. Should you wish to use my fan art for a profile picture or banner on social media, that's fine, but I ask you credit me (Boramriel) somewhere.
If my art features any personal characters (by themselves or paired with fan art of other characters) or is mentioned to be for my personal use only, I ask you do NOT use these art pieces for any social media cosmetics or otherwise.
Client may not alter the artwork received* by drawing over it, photobashing, or commissioning someone else to edit it. The piece should be adjusted as needed during the process of making it, by correcting the work-in-progress updates sent to the commissioner. If something is wrong, let me know and I will fix it!
Cosmetic adjustments to fit a profile theme or layout is fine, these adjustments include but are not limited to: Cropping, Overlaying a color hue, making the piece greyscale, blurring, applying texture (grain,...) or otherwise blending a piece to its surroundings/for it's intended purpose.
*Client can ask permission for minor alterations in pieces intended for reference for a character, if the character gets a small change such as eye color, a scar, a tattoo, an accessory, etc. Just let me know, but small edits like these are usually fine to be altered.
Client shall not reproduce and/or otherwise use the Work in any manner for purposes of training artificial Intelligence technologies (AI) to generate work, including without limitation, technologies that are capable of generating works in the same style or genre as the Work. Nor shall Client sublicense others to reproduce and/or otherwise use the Work in any manner for purposes of training artificial intelligence technologies to generate work.
When buying a design (an adoptable) from me, you are buying the rights to use that character non-commercially for personal usage.
You may not use the design in commercial content such as shows, book covers of sold books, or merchandise, but you can make personal visual and physical content for your own use.
If you have plans to make commercial content, reach out to me first to discuss so I am aware of what's happening with the design.
You can do whatever you'd like with the design and character, if you'd like to tweak things about it or give them a tragic story, go ham be free. I just ask you retain credits of the design to me despite these alterations.
I retain my usual artist ownership on the original design artwork and may use it for portfolio or other promotional posts.
All payments are done through PayPal invoice or sent in via Ko-Fi for special smaller payments.
All payments are made via EUR/€ or USD/$, and will be specified which on the applicable sales post.
All payments for commissions are paid in full upfront, but I am open to discuss short-term payment plans. Client will need to request this plan prior to receiving their invoice.
For payment plans, the commission progress will not begin before an initial %50 of the payment is received, after which I will complete the sketch of the piece. The piece will not be finished further before payment is received fully. This initial %50 is *non-refundable!
*For payment plans, after the first %50 payment, if you are unsatisfied, you will receive the sketch you ordered (and any alternative concepts should you ask for them) and you may commission someone else to finish them or finish them yourself.
If you paid in full upfront, you can request a partial %50 refund during the sketch stage, but if I have received your approval to line and finish the piece, I no longer offer refunds. Be certain you're happy with the sketch and do not be afraid to ask for adjustments! If you are unsatisfied with your commission, we can discuss corrections to adjust it, depending on how far along I am. Larger adjustments (poses, changes of clothes, etc) will cost extra. These should always be corrected in the sketch stage!
The time it takes to complete a commission may vary between a week to 3-5 weeks on the norm, unless a life event occurs.
These delays have become slightly more common given my current life goings and responsibilities taking care of another's health, but every commission is always getting completed and any updates can be requested at any time for your comfort! I know I can be a scatterbrain and don't want you to feel anxious over it.
You can request visual snippets of the commission progress and I will provide it at the earlier opportunity, but timezones may vary and I work and study full days so it may take a moment to get back to you! If it ever feels I've been a goldfish just bump me again, it's no hard feelings whatsoever.
This applies to Patreon and Private Commissions
Content viewed on Patreon is not to be used by my Patrons or anyone outside the subscription. It is not to be publicly shared. Only I have permission to share my content and dictate who can see it. This is to keep it fair for those who support me to see that exclusive content.
Once I post a piece publicly, my standard art usage rules apply!
Commissions ordered privately should remain private on both ends, the commissioner's and mine. If the commissioner shares the piece, I have permission to share it on my end as well.
Sharing between friends is fine. Adding to a character's gallery (filtered to be private) is fine. But if the piece is in public for people to view, I no longer consider it private. Credit is still due when a privately commissioned piece is used.
Using the art in a folder linked for references to commission other artists does not qualify as public.
Using privately commissioned art for social media customization counts as showing the piece publicly!
