Welcome to Blue Pool Plus (“Company”, “we”, “us”, or “our”). By accessing our services, scheduling appointments, or browsing our website, you agree to the following Terms and Conditions. These terms constitute a legally binding agreement between you ("Client", "you", or "your") and Blue Pool Plus, governing all pool maintenance, cleaning, and treatment services rendered in Central Florida.

1. Scope of Services

Blue Pool Plus provides scheduled and on-demand commercial pool services, including but not limited to:

• Pool cleaning and vacuuming
  
  

• Chemical balancing
  
  

• Filter and pump maintenance
  
  

• Pool inspections and safety checks
  
  

• Minor repairs and water testing
  
  

Services are provided based on availability, site conditions, and compliance with local regulations and health codes.

2. Waiver of Liability

By requesting or receiving any service from Blue Pool Plus, the Client expressly agrees to release and discharge Blue Pool Plus from any and all liability, including but not limited to:

• Property Damage: Blue Pool Plus is not responsible for pre-existing damage or deterioration to pool infrastructure, surfaces, or equipment.
  
  

• Injury or Health Issues: The Client acknowledges the inherent risks of using a swimming pool and releases Blue Pool Plus from liability related to injuries, slips, drowning, or chemical reactions.
  
  

• Force Majeure: We are not liable for delays or damages resulting from weather events, power outages, supply shortages, or other uncontrollable circumstances.
  
  

Legal Reference:

This waiver is executed in accordance with Florida Statutes § 768.28 and applicable federal law. By accepting service, you waive any right to bring claims or lawsuits against Blue Pool Plus for incidental, indirect, or consequential damages arising out of or in connection with our services.

3. Indemnification

You agree to indemnify, defend, and hold harmless Blue Pool Plus, its employees, contractors, and agents from any claims, damages, or legal expenses arising from:

• Misrepresentation or failure to disclose hazardous conditions
  
  

• Use of pool facilities during or after maintenance
  
  

• Third-party injuries on the premises
  
  

4. Scheduling, Access & Cancellations

• Appointments must be scheduled with at least 48 hours' notice.
  
  

• Clients must ensure clear and safe access to the pool area.
  
  

• Cancellations within 24 hours of a scheduled service may incur a $50 cancellation fee.
  
  

• Missed appointments due to inaccessibility will be considered a billable visit.
  
  

5. Image Use, Copyright & Intellectual Property

5.1 Content Ownership

All logos, designs, photography, videos, and text on our website and promotional materials are either owned by Blue Pool Plus or used under free-use licenses from reputable public domain or Creative Commons repositories.

5.2 Legal Basis for Use

All imagery used by Blue Pool Plus complies with the U.S. Copyright Act of 1976, codified under Title 17, United States Code, particularly:

6. Payment and Fees

• All invoices are due upon receipt unless otherwise agreed in writing.

• Overdue accounts (past 15 days) are subject to a 1.5% monthly interest fee and potential service suspension.
  
  

• Returned payments (e.g., bounced checks) are subject to a $35 administrative fee.
  
  

7. Privacy and Data Usage

We collect limited personal and business information necessary for scheduling, invoicing, and communication. Blue Pool Plus does not sell or share client data with third parties without explicit consent, except where required by law.

8. Limitations of Warranty

Services are provided “as-is” and without warranties of any kind, express or implied. Blue Pool Plus disclaims all warranties including:

9. Governing Law

These Terms and Conditions are governed by and construed under the laws of the State of Florida, without regard to conflict of laws principles. Any legal action must be brought in a court located in Orange County, Florida.

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted to our website and become effective immediately upon publication. Continued use of our services constitutes acceptance of these changes.
