Acceptance of Terms
By downloading, installing, accessing, or using the Bloomy mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms apply to all users of Bloomy, regardless of age, location, or subscription status. By using the App, you represent that you understand and accept all provisions herein.
Description of Service
Bloomy is a wellness application designed to provide daily affirmations, inspirational quotes, and positive content to support your mental well-being and personal growth.
The App provides:
A vertical-scrolling feed of affirmations and quotes across six categories: Self Esteem, Anxiety, Motivation, Gratitude, Self Love, and Abundance
- The ability to save favorite affirmations locally on your device
- Daily streak tracking to monitor your engagement
- Optional push notifications for daily reminders
- Premium subscription features
- Support for eleven languages: English, Spanish, French, German, Portuguese, Italian, Japanese, Korean, Swedish, Norwegian, and Danish
- Widget functionality for quick access to daily affirmations
All user data, including favorites and streak information, is stored locally on your device. Bloomy does not maintain user accounts, require login credentials, or sync data to our servers.
Premium Subscription & Billing
3.1 Free vs. Premium Features
The App offers both free and premium subscription tiers. The free version provides access to the core affirmation feed and basic features. Premium subscription unlocks additional content and enhanced functionality.
3.2 Subscription Plans
Bloomy offers the following premium subscription options:
Monthly Plan: $9.99 USD per month (or equivalent in your local currency)
- Yearly Plan: $39.99 USD per year (or equivalent in your local currency)
- Lifetime Plan: A one-time purchase granting permanent access to all premium features
Pricing is subject to change with 30 days' notice, though changes will not apply to existing subscriptions during their current billing period.
3.3 Free Trial
New users are eligible for a complimentary three-day trial of Bloomy Premium. The trial begins when you initiate the trial subscription through the App. At the end of the trial period, your subscription will automatically renew at the standard subscription rate unless you cancel before the trial ends.
You are responsible for canceling the trial subscription before the trial period ends if you do not wish to be charged.
3.4 Auto-Renewal and Billing
Premium subscriptions automatically renew at the end of each billing cycle unless you cancel. Renewal charges will be applied to the payment method associated with your App Store or Google Play account.
We will send you a reminder notification before each renewal date. You are responsible for maintaining accurate billing information in your App Store or Google Play account.
3.5 Cancellation Policy
You may cancel your subscription at any time through the settings in the App or through your App Store or Google Play account. Cancellation must be completed before the renewal date to avoid being charged for the next billing period.
Refund Policy: Refunds for cancelled subscriptions are governed by the refund policies of Apple App Store and Google Play. Bloomy does not process refunds directly. For refund requests, contact the respective app store:

Intellectual Property
4.1 App Ownership
Bloomy, including all software, design, graphics, user interface elements, text, and affirmation content, is owned by or licensed to Bloomy ("we," "us," "our"). All intellectual property rights are reserved.
4.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Bloomy on your personal mobile device for personal, non-commercial purposes.
4.3 Restrictions
You agree not to:
Reverse engineer, decompile, or attempt to derive the source code of the App
- Modify, adapt, translate, or create derivative works based on the App
- Copy, reproduce, or distribute the App or its content, except as permitted by law or these Terms
- Remove or alter any copyright, trademark, or other proprietary notices
- Use the App to compete with Bloomy or for commercial purposes
- Attempt to gain unauthorized access to any portion of the App
4.4 Affirmation Content
All affirmation and quote content provided in the App is the intellectual property of Bloomy. You may view and use this content for your personal benefit through the App. You may not scrape, republish, redistribute, or use the content outside the App without written permission.
User Conduct
You agree to use Bloomy in compliance with all applicable laws and these Terms. Specifically, you agree not to:
Use the App for any illegal, harmful, or unethical purpose
- Harass, threaten, defame, or harm any individual
- Violate any third-party intellectual property rights
- Introduce viruses, malware, or harmful code into the App
- Attempt to disrupt or compromise the security or functionality of the App
- Impersonate any person or entity
- Use the App in any manner that could damage, disable, overburden, or impair Bloomy's servers or networks
Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. BLOOMY MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP, ITS CONTENT, OR FUNCTIONALITY.
SPECIFICALLY, BLOOMY DISCLAIMS ALL WARRANTIES, INCLUDING:
IMPLIED WARRANTIES OF MERCHANTABILITY
- IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
- IMPLIED WARRANTIES OF NON-INFRINGEMENT
- WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF CONTENT
BLOOMY DOES NOT WARRANT THAT:
THE APP WILL BE ERROR-FREE OR UNINTERRUPTED
- THE APP WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS
- BUGS OR DEFECTS WILL BE CORRECTED
- THE APP WILL REMAIN AVAILABLE OR UNCHANGED
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOOMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF BLOOMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL BLOOMY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID BLOOMY IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS LESS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF LIABILITY FOR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

The App is designed for general wellness, motivation, and daily inspiration only. It is not intended to diagnose, treat, prevent, or cure any medical condition or mental health disorder.

Children's Privacy and COPPA Compliance
Bloomy is rated 4+ and is designed for all ages. We are committed to complying with the Children's Online Privacy Protection Act (COPPA) and all applicable child protection laws.
Data Collection Policy:
Bloomy does not collect, store, or use any personal information from any user, regardless of age
- We do not require registration, account creation, or the provision of any identifying information
- No email addresses, phone numbers, names, or other personal data are collected
- Bloomy does not use cookies or tracking technologies
- We do not sell, rent, or share user data with third parties
Parental Notification: If you are a parent or guardian and believe your child has provided personal information to Bloomy, please contact us immediately at legal@bloomapp.io.
Changes to Terms
Bloomy reserves the right to modify these Terms at any time. Changes will be effective upon posting to the App or our website, with a new "Effective Date" noted above.
Your continued use of the App after changes to the Terms constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically. If you do not accept changes to the Terms, you should discontinue use of the App.
Termination
We may, at our discretion, suspend or terminate your access to Bloomy without notice if we believe you have violated these Terms or applicable laws. Upon termination, your right to use the App ceases immediately.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflicts of law principles.
Any legal action or proceeding related to these Terms or your use of the App shall be brought exclusively in the state and federal courts located in California, and you consent to the personal jurisdiction of those courts.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if modification is not possible, that provision shall be severed. The remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between you and Bloomy regarding your use of the App and supersede all prior and contemporaneous agreements, understandings, and negotiations, whether written or oral.
