Welcome to Birthday Reminder & AI Wishes ("we," "our," or "us"). By downloading, installing, or using our mobile application ("App"), you agree to comply with and be bound by the following Terms of Use. If you do not agree, please do not use the App.
1. Use of the App
Birthday Reminder & AI Wishes is intended for personal, non-commercial use only.
You agree to:
Use the App only in accordance with applicable laws.
Not interfere with or disrupt the App or its services.
Not attempt to reverse engineer, modify, or gain unauthorized access to any part of the App.
2. Licence to Use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and the Usage Rules of the Apple App Store. This licence is for your own personal, non-commercial use.
You may not:
copy, modify, translate, or create derivative works of the App;
reverse engineer, decompile, or disassemble the App, except to the extent this restriction is prohibited by applicable law;
rent, lease, lend, sell, sublicense, or redistribute the App;
remove or obscure any copyright, trademark, or other proprietary notices;
use the App to break any law, infringe anyone’s rights, or send unsolicited messages (spam);
use automated means to access, scrape, or overload the App or the servers that deliver its content.
3. What the App Does
The App helps you keep track of birthdays and celebrate them. Features include birthday reminders and countdowns, importing birthdays from your Contacts and Calendar, exporting birthdays to your Calendar, generating birthday wish text, gift suggestions, photo frames, slideshow video creation, birthday stickers, a digital candle, zodiac information, and statistics about the birthdays you have saved.
4. Your Data and Content
Your birthday data stays on your device. The birthdays, names, photos, notes, phone numbers, and email addresses you add are stored locally on your device. We do not operate user accounts and we do not upload your personal data to our servers.
You keep full ownership of the photos, videos, text, and other content you create with the App (“Your Content”). We claim no ownership over it. Because Your Content is stored only on your device, you are solely responsible for backing it up — uninstalling the App, resetting your device, or losing your device may permanently delete Your Content, and we cannot recover it.
5. Device Permissions
Some features ask for your permission to access parts of your device. You can grant or revoke each permission at any time in the iOS Settings app; features that depend on a permission will not work without it.
We do not share, sell, or transfer your personal data to any third party or our servers. All information accessed through these permissions remains on your device.
Notifications — to deliver birthday reminders.
Contacts — to import birthdays you choose to import.
Calendar — to import birthdays and to add birthday events you choose to export.
Photos — to let you choose photos for frames and videos, and to save what you create.
Microphone — to detect you blowing out the digital candle. Audio is processed on your device in real time and is not recorded, stored, or transmitted.
Speech Recognition — to let you search the language list by voice.
6. Subscriptions and Payment
The App offers auto-renewable subscription plans:
Weekly: $5.99
Monthly: $17.99
Yearly: $29.99
Payment will be charged to your Apple ID (App Store account) at the time of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours before the end of the current period, at the same price unless otherwise stated.
You can manage or cancel your subscription at any time in your App Store account settings after purchase.
If you cancel, your subscription will remain active until the end of the current billing cycle.
We do not provide refunds for unused portions of a subscription period, except where required by law.
7. Intellectual Property
All rights, title, and interest in the App (including design, features, and content) are owned by us.
You may not copy, modify, distribute, or reverse-engineer any part of the App without our prior written consent.
8. Disclaimer of Warranties
To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will meet your requirements, be uninterrupted, secure, or error-free, or that reminders will be delivered.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing here limits any non-waivable consumer rights you have under the law of your country of residence.
9. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any damages arising out of your use of the App, including loss of data, device issues, or other indirect or incidental damages.
10. Termination
We may suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms.
11. Changes to Terms
We may update these Terms from time to time. Any changes will be effective when posted within the App. Continued use of the App after changes means you accept the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of your country of residence, without regard to its conflict of law principles.
