Welcome to BirdieIQ (the "App"), operated by HLB Venture LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have the legal capacity to enter into these Terms. There are no age restrictions for using the App, but if you are under 18, you must have permission from a parent or legal guardian to use the App.

2. Description of Service

BirdieIQ is a mobile application that utilizes artificial intelligence to analyze golf-related statistics to help users improve their golf game. We reserve the right to modify or discontinue the App or any features at any time without notice.

3. User Accounts

To access certain features, you may need to create an account. You may choose to provide your email address, but Apple’s privacy features allow you to hide your email if preferred. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at birdieiqteam@gmail.com if you suspect unauthorized use of your account.

4. Subscriptions and Payments

• BirdieIQ offers two subscription plans: a $5/month plan and a $10/month plan, both renewed monthly. Subscriptions are billed through the Apple App Store in accordance with their payment terms.

• All payments are non-refundable unless otherwise required by law or Apple’s policies.

• You may cancel your subscription through your Apple App Store account settings. Cancellation will take effect at the end of the current billing cycle.

5. User Data and Privacy

We may collect limited personal information, such as your name, email address (optional, as Apple allows email hiding), and location data (when necessary for GPS or weather-based yardage adjustments), as outlined in our Privacy Policy. By using the App, you consent to the collection and use of this data in accordance with our Privacy Policy.

6. User Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose.

• Attempt to reverse-engineer, decompile, or hack the App.

• Interfere with the App’s functionality or servers.

• Violate any third-party rights, including intellectual property rights.

7. Intellectual Property

All content, trademarks, and intellectual property within the App are owned by HLB Venture LLC or our licensors. You may not reproduce, distribute, or create derivative works from the App without our prior written consent.

8. Third-Party Services

The App integrates with third-party APIs, including a golf course API and the OpenAI API. These services are governed by their own terms and privacy policies, which you should review. We are not responsible for the performance or policies of these third-party services.

9. Termination

We may suspend or terminate your access to the App at our discretion if you violate these Terms or for any other reason. Upon termination, your right to use the App will cease immediately.

10. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the App will be error-free, secure, or uninterrupted, or that the AI-generated golf statistics will always be accurate or suitable for your needs.

11. Limitation of Liability

To the fullest extent permitted by law, HLB Venture LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to reliance on golf-related statistics provided by the App.

12. Governing Law
