Introduction
Bippy ("Company", "we", "us", or "our") welcomes you, our user ("User" or "you"). These Terms of Use ("Terms") govern your use of the Bippy: Your BP companion ("App"), which is available on the Apple App Store.
These Terms, together with our Privacy Policy, constitute the entire legally binding agreement between us and our users, governing your access to and use of the App ("Agreement").
By using the App, you acknowledge and agree that:
You have read and understand these Terms and agree to be legally bound by them;
You have full legal capacity (you have reached the legal age of majority and are not otherwise restricted);
If you are under 18, you may use the App only with the involvement and consent of a parent or guardian;
You are duly authorized to act on behalf of any legal entity you represent (if applicable);
According to your local jurisdiction, you are eligible to enter into this agreement and have no legal restrictions preventing you from accessing or using the App;
You comply with these Terms and all applicable laws and regulations.
Our Privacy Policy describes our collection and use of personal data in connection with your access to and use of the App.

1. ABOUT US

Our support team is available to assist you. You can contact us via the email address provided above. We respond to users as quickly as possible, typically within 24-48 hours. Please note that we may not respond to abusive, threatening, or offensive communications.
2. SERVICES AND FEATURES
The App provides blood pressure tracking, health monitoring, and wellness management tools. The App includes both free and premium features.
Free Features:
Blood pressure tracking and manual data entry
Basic statistics and charts
30-day reading history
Health data visualization
Apple Health integration (read/write)
Limited reminders (up to 3 active)
Step counter tracking
Premium Features (Subscription Required):
Unlimited reading history
Unlimited medication reminders
PDF export of health reports
CSV data export
Advanced analytics and trends
Priority customer support
Ad-free experience
All future premium features
We reserve the right to modify features, add new features, or discontinue features at any time with or without notice. Material changes affecting premium subscribers will be communicated in advance when possible.
3. ACCOUNT MANAGEMENT
3.1 Account Creation
You do not need to create an account to use the basic features of the App. All data is stored locally on your device.
3.2 Account Security
If you create an optional account for cloud features (if implemented), you are responsible for:
Maintaining the confidentiality of your login credentials
All activities that occur under your account
Immediately notifying us of any unauthorized access
3.3 Account Deletion
You may delete all your data at any time by:
Using the "Delete All Data" function in the App settings
Deleting the App from your device (permanently removes all local data)
Contacting us for assistance
If you have an active subscription, canceling it does not automatically delete your data. You must separately delete your data or the App.
4. PAYMENTS AND SUBSCRIPTIONS
4.1 Subscription Plans
To access premium features, you must subscribe to one of our paid plans:
Monthly subscription
Annual subscription (discounted rate)
Lifetime purchase (one-time payment)
Current pricing is displayed in the App and on the App Store. Prices may vary by region and are subject to applicable taxes.
4.2 Free Trial
New users may be eligible for a free trial period (typically 3-7 days) with full access to premium features. The free trial is available once per user/device.
Important: If you do not cancel before the trial ends, you will automatically be charged for the subscription according to the plan you selected. To avoid charges, cancel at least 24 hours before the trial period ends.
4.3 Payment Terms
All payments are processed through Apple's In-App Purchase system
Payment will be charged to your Apple ID account upon confirmation of purchase
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours before the current period ends
The renewal cost will be clearly identified

4.5 Subscription Management
You can manage and cancel subscriptions through your Apple ID account settings:
On iPhone/iPad:
Open Settings app
Tap your name
Tap "Subscriptions"
Select Bippy: Your BP Companion
Tap "Cancel Subscription"
On Mac:
Open App Store
Click your name in the sidebar
Click "View Information"
Scroll to "Subscriptions" and click "Manage"
Select Bippy: Your BP Companion and click "Cancel"
On Apple's Website:
Go to appleid.apple.com
Sign in with your Apple ID
Go to "Subscriptions"
Select Bippy: Your BP Companion
Click "Cancel Subscription"
4.6 Subscription Changes
You may upgrade or downgrade your subscription plan at any time through your Apple ID settings. When changing plans:
Upgrades take effect immediately, and you'll be charged the prorated difference
Downgrades take effect at the end of your current billing period
4.7 Refund Policy
All purchases are handled by Apple. Refund requests must be submitted directly to Apple through:

Your Apple ID account settings, or
Apple Support
Refund eligibility is determined by Apple's refund policies, not by us. We cannot process refunds directly.
If you request a refund, please note:
Your usage data may be shared with Apple to verify the refund claim
Approved refunds may result in loss of premium access
We reserve the right to limit or deny future access if refund abuse is detected
4.8 Price Changes
We reserve the right to modify subscription prices at any time. For existing subscribers:
You will be notified at least 30 days before any price increase
The new price will apply at your next renewal unless you cancel
You may cancel your subscription before the price change takes effect
5. USER RESPONSIBILITIES
5.1 Acceptable Use
When using the App, you agree to:
Provide accurate health information
Use the App for personal, non-commercial purposes only
Comply with all applicable laws and regulations
Not attempt to reverse engineer, decompile, or disassemble the App
Not use automated systems (bots, scrapers) to access the App
Not interfere with or disrupt the App's functionality
5.2 Prohibited Activities
You may not:
Share your account credentials with others
Use the App to store or transmit malicious code
Attempt to gain unauthorized access to our systems
Violate any intellectual property rights
Use the App for any illegal purpose
Impersonate any person or entity
Harass, abuse, or harm others
Collect or store personal data of other users without consent
Circumvent any security features or access controls
Use the App in any way that could damage, disable, or impair it
5.3 Consequences of Violations
If you violate these Terms, we may:
Suspend or terminate your access to the App
Delete your data
Report illegal activities to law enforcement
Take legal action to recover damages
6. CONTENT AND INTELLECTUAL PROPERTY
6.1 Our Intellectual Property
The App, including all content, features, functionality, software, text, graphics, logos, icons, images, audio clips, and other materials ("Content"), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
Your License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
Download and install the App on your personal device(s)
Use the App for personal, non-commercial purposes
Access and view Content for personal use
You may not:
Modify, copy, distribute, transmit, display, reproduce, or create derivative works from the App
Reverse engineer, decompile, or disassemble the App
Remove any copyright, trademark, or other proprietary notices
Use the App or Content for commercial purposes without our written permission
Rent, lease, lend, sell, sublicense, or transfer the App
6.2 Your Health Data
You retain ownership of all health information you enter into the App, including:
Blood pressure readings
Pulse measurements
Medication records
Personal notes
Any other health data you input
Our Limited Rights: By using the App, you grant us a limited, non-exclusive license to:
Store your data locally on your device
Process your data to provide App functionality (charts, statistics, exports)
Use anonymized, aggregated data for analytics and App improvement (with your consent)
Important: We do NOT claim ownership of your personal health data. We do NOT sell or share your health data with third parties (except as required by law or with your explicit consent).
6.3 Exported Data
When you export your health data (PDF or CSV):
The exported files are yours to keep
You may use, share, or distribute exported files as you wish
We have no rights to or control over exported files
You are responsible for securing exported files
6.4 User Feedback
If you provide feedback, suggestions, or ideas about the App:
We may use your feedback to improve the App without compensating you
You grant us a perpetual, irrevocable, royalty-free license to use your feedback
We are not obligated to implement your suggestions
7. THIRD-PARTY SERVICES
7.1 Apple Health Integration
The App integrates with Apple Health with your explicit permission. When you grant Health access:
We can read blood pressure and activity data from Health
We can write blood pressure readings to Health
Your Health data is governed by Apple's Privacy Policy
You can revoke Health permissions at any time in iOS Settings
7.2 Apple In-App Purchases
All purchases and subscriptions are processed by Apple. Apple's Terms and Conditions and Privacy Policy apply to all transactions.
7.3 Third-Party Links
The App may contain links to third-party websites or resources for educational purposes. We are not responsible for:
The content, accuracy, or availability of third-party sites
Any damages or losses caused by third-party sites
The privacy practices of third-party sites
Your use of third-party services is at your own risk and subject to their terms and policies.
8. MEDICAL DISCLAIMER
CRITICAL NOTICE: THIS APP IS NOT A MEDICAL DEVICE
The App:
Does NOT measure blood pressure directly
Does NOT diagnose any medical conditions
Does NOT provide medical advice, treatment, or professional healthcare services
Is NOT a substitute for professional medical care
Is for informational and tracking purposes only
You acknowledge and agree that:
All health data is manually entered by you or imported from Apple Health
We cannot guarantee the accuracy of data from third-party sources
The App's calculations, statistics, and insights are for reference only
You should always consult qualified healthcare professionals for medical decisions
In case of medical emergency, call emergency services immediately (911 in the US)
The App should not be relied upon for critical health decisions
Blood Pressure Readings:
Must be obtained using properly calibrated medical devices
Should be validated by healthcare professionals
May not reflect your actual health status if entered incorrectly
Are subject to user error and device limitations
You use this App entirely at your own risk. We assume no responsibility for any health outcomes, medical decisions, or consequences resulting from your use of the App.
Always follow your doctor's instructions and seek professional medical advice for any health concerns.
9. WARRANTIES AND DISCLAIMERS
9.1 "AS IS" Basis
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
9.2 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:
Merchantability: We do not warrant that the App is suitable for any particular purpose
Fitness for Purpose: We do not warrant that the App will meet your specific requirements
Non-Infringement: We do not warrant that the App does not infringe third-party rights
Accuracy: We do not warrant that data, content, or functions are accurate, complete, or current
Reliability: We do not warrant uninterrupted, timely, secure, or error-free operation
Quality: We do not warrant that defects will be corrected
9.3 No Guarantee of Availability
The App may be unavailable due to:
Maintenance and updates
Technical failures
Network or connectivity issues
Force majeure events
Cyberattacks or security incidents
Third-party service disruptions
9.4 Data Loss
WE ARE NOT RESPONSIBLE FOR:
Loss of data due to device failure, deletion, or corruption
Inability to export or backup your data
Loss of access to your data
Incompatibility with future iOS versions
Recommendation: Regularly export your data and maintain backups.
9.5 Third-Party Data
We do not guarantee the accuracy, completeness, or reliability of data imported from:
Apple Health
Other third-party sources
Automated data retrieval
9.6 Geographic Limitations
Some features may not be available in all countries or regions. Medical information may not be applicable to your jurisdiction.
10. LIMITATION OF LIABILITY
10.1 Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF:
(a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (b) $100 USD
10.2 Excluded Damages
IN NO EVENT SHALL WE BE LIABLE FOR:
Indirect Damages: Lost profits, revenue, business opportunities, goodwill, or reputation
Consequential Damages: Any damages flowing from the initial harm
Incidental Damages: Costs of procurement of substitute services
Special Damages: Unusual or extraordinary damages
Punitive Damages: Damages intended to punish
This applies even if we have been advised of the possibility of such damages.
10.3 Health-Related Liability
WE ARE NOT LIABLE FOR:
Any health outcomes, medical complications, or injuries
Delays in seeking medical treatment
Reliance on App data for medical decisions
Inaccurate readings or calculations
Medication errors or missed doses
Any harm resulting from use or inability to use the App
10.4 Third-Party Actions
We are not liable for:
Actions or omissions of third-party service providers (Apple, Apple Health, etc.)
Loss or corruption of data stored by third parties
Security breaches of third-party systems
Unauthorized access to your device by third parties
10.5 Limitations by Jurisdiction
Some jurisdictions do not allow exclusion or limitation of certain warranties or damages. In such cases:
These limitations apply to the maximum extent permitted by law
If any limitation is found unenforceable, our liability shall be limited to the smallest amount permitted by law
10.6 Essential Purpose
You acknowledge that the limitations in this section reflect a reasonable allocation of risk and are a fundamental basis of our agreement. We would not provide the App without these limitations.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless us, our officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
Your violation of these Terms
Your use or misuse of the App
Your violation of any laws or regulations
Your violation of any rights of third parties
Your health data or any data you provide
Your medical decisions or health outcomes
Any content you submit or transmit through the App
Your negligence or willful misconduct
We reserve the right to:
Assume exclusive defense and control of any matter subject to indemnification
Require you to cooperate with our defense efforts
Approve any settlement that affects our rights or obligations
This indemnification obligation survives termination of these Terms.
12. TERMINATION
12.1 Termination by You
You may stop using the App at any time by:
Deleting the App from your device
Canceling your subscription (if applicable)
Contacting us to request data deletion
Important: Deleting the App does NOT automatically cancel your subscription. You must cancel your subscription separately through your Apple ID settings.
12.2 Termination by Us
We may suspend or terminate your access to the App immediately, without notice, for:
Violation of these Terms
Fraudulent activity or payment disputes
Abusive behavior toward our support team
Suspected illegal activity
Repeated refund abuse
Threats to security or integrity of the App
Legal or regulatory requirements
Discontinuation of the App
12.3 Effects of Termination
Upon termination:
Your license to use the App immediately ends
You must stop using the App and delete it from your devices
We may delete your data (though data stored on your device may remain)
Subscription fees paid are generally non-refundable (subject to Apple's refund policy)
Provisions that by their nature should survive will remain in effect (including indemnification, disclaimers, and limitations of liability)
12.4 Data After Termination
After termination:
Data stored locally on your device remains until you delete the App
We are not obligated to retain your data
You should export important data before terminating
We may retain anonymized data for analytics and legal compliance
13. GENERAL PROVISIONS
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.
13.2 Dispute Resolution

If any provision of these Terms is found to be invalid, illegal, or unenforceable:
The remaining provisions remain in full force and effect
The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable
13.5 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.
13.6 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign or transfer these Terms to:
An affiliate or subsidiary
A successor in interest (e.g., in a merger or acquisition)
Any other party with or without notice to you
13.7 Amendments
We reserve the right to modify these Terms at any time. Changes will be effective:
Immediately upon posting in the App, or
On a specified future date stated in the notice
For material changes:
We will provide at least 7 days' notice
Continued use of the App after changes take effect constitutes acceptance
If you don't agree to changes, you must stop using the App and cancel your subscription
13.8 Electronic Communications
By using the App, you consent to receive electronic communications from us, including:
Push notifications
In-app messages
Emails (if you provide an email address)
Updates to Terms and Privacy Policy
You may opt out of marketing communications but cannot opt out of essential service communications.
13.9 Export Control
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce.
13.10 Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including:
Acts of God, natural disasters
War, terrorism, civil unrest
Government actions or restrictions
Epidemics or pandemics
Internet or telecommunications failures
Cyberattacks or hacking
Labor disputes or strikes
13.11 Language
These Terms are prepared and executed in English. If translated, the English version prevails in case of any discrepancy.
13.12 Survival
The following sections survive termination: Medical Disclaimer, Warranties and Disclaimers, Limitation of Liability, Indemnification, Intellectual Property, and General Provisions.
