AGREEMENT TO TERMS

Welcome to Biology AI: Homework Helper. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Biology AI ("Company," "we," "us," or "our") governing your access to and use of the Biology AI: Homework Helper mobile application (the "App") and all related services.

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not download, install, access, or use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

ELIGIBILITY

The App is intended for users of all ages, including students. If you are under 18 years of age, you represent that you have your parent's or legal guardian's permission to use the App. Parents and guardians are responsible for supervising their children's use of the App.

By using the App, you represent and warrant that you have the legal capacity to enter into these Terms and that your use of the App will not violate any applicable law or regulation.

DESCRIPTION OF SERVICE

Biology AI: Homework Helper is an educational mobile application that uses artificial intelligence technology to assist users with biology-related questions, homework, and learning. The App provides features including but not limited to:

- AI-powered question answering for biology topics

- Photo scanning and analysis of biology problems

- AI tutoring and interactive conversations

- Flashcard and quiz generation

- Text summarization and simplification

- YouTube video summarization

- Audio transcription and summarization

- Lab report and experiment assistance

The App is designed as a learning aid and study companion. It is not intended to replace formal education, professional tutoring, or academic instruction.

ACCOUNT REGISTRATION

Certain features of the App may require you to create an account. When creating an account, you agree to:

- Provide accurate, current, and complete information

- Maintain and promptly update your account information

- Keep your login credentials secure and confidential

- Accept responsibility for all activities that occur under your account

- Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or in violation of these Terms.

USER CONTENT AND CONDUCT

Content You Submit

When you submit content to the App (including photos, images, text, audio, and other materials), you represent and warrant that:

- You own or have the necessary rights to submit the content

- The content does not infringe upon the intellectual property rights of any third party

- The content does not contain any unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable material

- The content is submitted for legitimate educational purposes

Prohibited Uses

You agree NOT to use the App to:

- Violate any applicable local, state, national, or international law or regulation

- Submit content that infringes on the intellectual property rights of others

- Submit content containing viruses, malware, or other harmful code

- Attempt to gain unauthorized access to the App, other users' accounts, or our systems

- Use the App for any commercial purpose without our prior written consent

- Use the App to cheat on exams, tests, or academic assessments in violation of your educational institution's policies

- Misrepresent your identity or affiliation with any person or entity

- Interfere with or disrupt the App or servers or networks connected to the App

- Use automated systems, bots, or scripts to access or interact with the App

- Reverse engineer, decompile, or disassemble any portion of the App

Academic Integrity

While Biology AI is designed to help you learn and understand biology concepts, you are responsible for using the App in accordance with your school's or institution's academic integrity policies. The App should be used as a learning tool to understand concepts, not as a means to submit AI-generated content as your own original work without proper attribution or in violation of academic policies.

INTELLECTUAL PROPERTY RIGHTS

App Ownership

The App, including all content, features, functionality, design, graphics, logos, and trademarks, is owned by Biology AI and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written permission.

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial, educational use.

Your Content

You retain ownership of any content you submit to the App. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and analyze your content solely for the purpose of providing the App's services to you. We do not claim ownership of your content.

AI-GENERATED CONTENT

Nature of AI Responses

The App uses artificial intelligence (specifically Google Gemini AI) to generate responses to your questions. You acknowledge and agree that:

- AI-generated content is provided for educational and informational purposes only

- AI responses may contain errors, inaccuracies, or incomplete information

- AI-generated content should not be relied upon as the sole source of information for critical decisions

- You are responsible for verifying the accuracy of any AI-generated content before using it

No Guarantee of Accuracy

While we strive to provide accurate and helpful information, we do not warrant or guarantee the accuracy, completeness, or reliability of any AI-generated content. Biology is a complex and evolving field, and AI responses may not always reflect the most current scientific understanding.

Educational Use Only

AI-generated content is intended to supplement your learning and should be used in conjunction with textbooks, class materials, and guidance from teachers or tutors. It is not a substitute for professional educational instruction.

SUBSCRIPTIONS AND PAYMENTS

Free and Premium Features

The App offers both free features and premium features that require a paid subscription. Free features may have limitations on usage, functionality, or access.

Subscription Terms

If you choose to purchase a subscription:

- Payment will be charged to your Apple ID account at confirmation of purchase

- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period

- Your account will be charged for renewal within 24 hours prior to the end of the current period

- You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase

- Any unused portion of a free trial period will be forfeited when you purchase a subscription

Pricing

Subscription prices are displayed in the App and may vary by region. We reserve the right to change subscription prices at any time. Price changes will not affect existing subscriptions until the next renewal period.

Refunds

All purchases are processed through Apple's App Store. Refund requests must be directed to Apple in accordance with their refund policies. We do not have the ability to process refunds directly.

DISCLAIMERS

AS-IS BASIS

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NO GUARANTEE OF AVAILABILITY

We do not guarantee that the App will be available at all times or that it will be free from errors, bugs, or interruptions. We may modify, suspend, or discontinue the App or any part thereof at any time without notice.

EDUCATIONAL TOOL DISCLAIMER

The App is an educational tool and learning aid. It is NOT a substitute for:

- Professional tutoring or academic instruction

- Medical, scientific, or professional advice

- Formal education or accredited courses

- Verification of scientific facts for research purposes

Always consult appropriate educational resources, professionals, or experts for important decisions.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIOLOGY AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR USE OF THE APP DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Biology AI and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

- Your use of the App

- Your violation of these Terms

- Your violation of any third-party rights, including intellectual property rights

- Any content you submit to the App

THIRD-PARTY SERVICES

The App may integrate with or contain links to third-party services, including but not limited to:

- Google Gemini AI (for AI processing)

- RevenueCat (for subscription management)

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, accuracy, or practices of any third-party services.

TERMINATION

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

- Your license to use the App will immediately cease

- You must stop all use of the App

- Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability

You may terminate your use of the App at any time by uninstalling it from your device and canceling any active subscriptions.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Biology AI regarding the use of the App and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.
