By downloading, installing, or using **BioGuard AI** (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App.

BioGuard AI is a mobile application that uses AI-powered image analysis to help users identify plants, insects, and assess potential safety risks. The App also provides plant care tracking and an AI garden chat assistant.

## 3. Important Safety Disclaimer

- BioGuard AI is **NOT** a substitute for professional medical, veterinary, horticultural, or toxicological advice.
- **Do NOT** consume, touch, or otherwise interact with any plant or insect based solely on this App's identification or recommendations.
- AI identifications may be incorrect. Always verify with qualified professionals before making health-related decisions.
- The confidence scores provided are estimates — they do not guarantee accuracy.
- **We assume no liability** for any harm, injury, or loss resulting from actions taken based on the App's output.

## 4. Eligibility
You must be at least **13 years old** to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you must have the consent of a parent or guardian.

## 5. Subscriptions and In-App Purchases
### 5.1 Free Tier
The App offers a limited number of free scans per week. Free users may access additional scans through premium subscriptions.
### 5.2 Premium Subscriptions
- Subscriptions are offered on a **weekly** or **yearly** basis and are managed through the Apple App Store or Google Play Store.
- Subscription payments are charged to your App Store / Google Play account at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage and cancel subscriptions in your device's account settings.
### 5.3 Refunds
Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.
### 5.4 Restore Purchases
If you reinstall the App or switch devices, you can restore previous purchases using the "Restore Purchases" option in the App.

## 6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or tamper with the App.
- Circumvent scan limits or subscription restrictions through technical means.
- Submit images containing illegal content, nudity, or material that violates third-party rights.
- Use the App in a way that could harm, disrupt, or overload our services.

## 7. Intellectual Property
All content, design, code, logos, and trademarks within the App are owned by or licensed to BioGuard AI. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
You retain ownership of any photos you submit. By submitting photos, you grant us a limited license to transmit them to our AI analysis providers solely for the purpose of generating identification results.

## 8. Third-Party Services
The App integrates with third-party services including Google Firebase (Analytics and Crashlytics), Adapty (subscriptions), and OpenRouter (AI models including Gemini and Grok). Your use of the App is also subject to the terms of these third-party providers. We are not responsible for the practices or content of third-party services.

## 9. Disclaimer of Warranties
The App is provided **"as is"** and **"as available"** without warranties of any kind, either express or implied, including but not limited to:
- Accuracy or completeness of AI identifications.
- Uninterrupted or error-free operation.
- Fitness for any particular purpose.

## 10. Limitation of Liability
To the maximum extent permitted by applicable law, BioGuard AI and its developers shall not be liable for:
- Any indirect, incidental, special, or consequential damages.
- Personal injury, property damage, or death resulting from reliance on the App.
- Loss of data or unauthorized access to your device.
Our total liability to you for any claim arising from use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

You agree to indemnify and hold harmless BioGuard AI and its developers from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.
