 BIAAPA stands for Bangalore International Airport Area Planning Authority. It is a government body responsible for planning and development of the area surrounding Kempegowda International Airport in Bengaluru, India. It was formed in 1961 under the KARNATAKA TOWN AND COUNTRY PLANNING ACT 1961. The agency is responsible for the overall development of the airport area, including land use, transportation, infrastructure, and environmental management. Its main objective is to ensure that the airport area is developed in a sustainable and planned manner, while also protecting the rights and interests of local residents and businesses.

The high court has said that lands held by the planning authority for roads as per the master plan would not lapse even after five years and the landowners would have no right to reclaim the land or seek realignment.

On the other hand, the planning authority claimed that once the land is earmarked for the purpose of road formation in the master plan in terms of Section 12 of KTCP Act, it would not lapse, but continue to be so unless it is deleted in the subsequent master plan.

Next is the Bangalore Metropolitan Region Development Authority. Also known as the BMRDA, it is an autonomous body in charge of planning, coordinating, and supervising the systematic development of areas falling under the Bangalore Metropolitan Region.

This is a tricky one. Wondering why? Well, as mentioned above, the main role of the BMRDA is to bring changes in the policies related to urban development. It does not provide approval for the layouts directly. The layout approvals should come from the local planning authorities.

Next, we have the Department of Town and Country Planning. Commonly known as DTCP, this is involved in the task of preparing master plans and their enforcement. Also, it sanctions the layout plan in the state, where the planning bodies like BMRDA, BDA, BIAAPA, etc do not exist.

The airforce station in Yelahanka, which is a sensitive installation, has upped its guard with a direction to BIAAPA not to permit or sanction building plans without its concurrence or approval within a radius of 10 kilometers.

Till now, BIAAPA, which has a jurisdiction area of 750-odd sq km around the international airport, used to forward every construction proposal/application to BIAL for approval. Ground-plus-three or 15 meters is called a high-rise in the BIAAPA masterplan. All the building plan applications within 10 km radius will be submitted to BIAL for its NOC.

* THE YELLOW ZONE: Development in areas beyond 10-20 km from the aerodrome reference point are marked in yellow. Local municipal authorities can approve building plans only up to a height of 120 m above aerodrome elevation. But the cases must be forwarded to the AFS Yelahanka to cross-check the clearances

* THE GREEN ZONE: Areas beyond 20 km of the aerodrome reference point and area outside the purview for issuance of NOC by IAF are marked green. For any construction here, applications need not be processed for infrastructure up to a maximum height of 150 m above aerodrome elevation. Local municipal authorities can approve the building plan without NOC from IAF.

Bangalore Mysore Infrastructure Corridor Area Planning Authority (BMICAPA)-for facilitating planned development of the corridor between Bangalore and Mysore known as Local Planning Area comprising of a total area of about 701 sqkm including 140 revenue villages, 54 part villages and Maddur town.

Development of private layouts is going on in full swing around Bengaluru city since the inception of BMRDA as per BMRADA Act, 1985. The BMRDA and its local planning authorities have so far sanctioned more than 1500 layouts.

(1) Private layout developers can no longer release sites to the buyers without completing all necessary infrastructure work. The process of releasing 60% of sites for sale at the now existing plan approval stage will be discontinued.

(2) Section 17-sub-sections (2), (2A) and (2B) of KTCP Act that deal with layout approvals will be tweaked. The end result of this change in the rule book would mean: developers of private layouts will have to complete all necessary infrastructure work like roads, water supply and sewerage lines, electricity connection, relinquishment of parks and open spaces to the planning authorities, only after which the site allotments will be allowed. The developer has to create the infrastructure in a manner where buyers can go in for immediate construction after registration of sites.

(3) After the amendment of section 17, the LPA will first sanction the provisional layout plan, so as to enable the developer of a layout to take up various works and other procedures to be followed for development of layout as stipulated in sub-section (2A) of section 17.

The Bangalore metropolitan area includes Bangalore urban and rural districts falling under the jurisdictions of Bangalore Development Authority (BDA), Bangalore International Airport Planning Authority (BIAPA), Bangalore Mysore Infrastructure Corridor Area Planning Authority (BMICAPA), Magadi planning authority, Nelamangala Planning Authority, Kanakapura planning authority, Ramanagara-Channapatna urban development authority and Bangalore Metropolitan Region Development Authority (BMRDA).

With the government making the issuance of release certificate - the authorisation given by a competent authority to a private developer to sell the property - mandatory for the private layouts, the defining of the jurisdiction has been timely. The BDA, which is empowered to sanction layouts, building plans and issue release certificates has under its jurisdiction as many as 533 villages, towns and hoblis including the city and town municipal councils around Bangalore. Similarly, the BIAPA has under it 248 towns and villages which fall under he jurisdiction of Devanahalli, Bangalore north and Doddaballapur taluks. As many as 193 villages coming under Bangalore urban and rural, Mandya and Mysore districts fall under the BMICAPA. This includes 140 villages falling all along the expressway. Magadi planning area has 170 villages coming under its jurisdiction, Nelamangala planning area has 40 villages, Kanakapura planning area has 16 villages and Ramanagara-Channapatna urban development authority has 26 villages and taluks.

As per law, it is either the competent authorities like BDA/BMRDA/BMICAPA/BIAPA have powers to approve the layouts and building plans. Hence the the Government has declared that all Residential Layouts having clear property titles should take approvals from any of these competent authorities as mentioned above.

The Department of Town Planning in the State was established in the year 1959 with the main purpose of promoting planned physical development of urban and rural areas. The activities of the department have been multifarious. The scope of town planning which was limited to preparation of small layouts, town extension / improvement schemes has widened to embrace all developmental activities. The primary functions of the Department of Town Planning is the preparation of physical plans to achieve organised and co-coordinated developments at all levels i.e. regional, town and rural levels.

Bangalore Development Authority (BDA) was created under special statute, viz. Bangalore Development Authority Act, 1976 for the metropolitan area of Bangalore (1,279 sq km). BDA acts as Planning Authority under the Karnataka Town and Country Planning Act (KTCP Act) and discharge the duties of preparation of development plan and enforce its proposals under the same Act. BDA also acts as development agency. This authority is having Town Planning Wing headed by a Town Planner Member (Joint Director of Town Planning).

The Planning Authority is a body corporate having perpetual succession with a Chairman appointed by the State Government and certain other members and elected representatives of the concerned local bodies as its members. There are 24 Planning Authorities constituted under the KTCP Act, for which the Assistant Director of Town Planning (ADTP) of the concerned unit office of the department is functioning as Member-Secretary of the Planning Authority and for Bangalore-Mysore Infrastructure Corridor Area Planning Authority (BMICAPA), the Joint Director of Town Planning, Head office, Bangalore, is the Member-Secretary. The main functions of these Planning Authorities are to prepare development plans (ODP/CDP/RCDP), planning schemes and to enforce the plan proposals.

 

 At present the Department of Town Planning is fully assisting the Planning Authorities in the preparation of development plans (ODP/CDP/RCDP) and in enforcing proposals of ODP/CDP/RCDP.

 Preparation of town and village extension schemes for Urban Local Bodies and local authorities. 

 

 Preparation of project related to rehabilitation and resettlement schemes. 

 

 Preparation of traffic management plans. 

 

 The department is also extending technical support to the various Urban Development Authorities, Planning Authorities, Urban Local Bodies and Local Authorities, in the preparation; enforcement and implementation of Master plans.
