These Terms of Use (“Terms”) govern your access to and use of the mobile application “Been Pwned? Breach Checker” (the “App”), operated by ELGAR SOLUTIONS LTD (“Company”, “we”, “us”, or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the App.
Been Pwned? Breach Checker is a security utility designed to help users identify whether login identifiers, passwords, or credentials may appear in known breach or compromised-data databases.
The App may provide functionality including:
Checking email addresses and usernames against known breach information;
Checking passwords against compromised-password databases;
Displaying information about potential data exposures;
Generating stronger passwords;
Allowing users to save passwords or credentials;
Managing saved security information.
The App is intended solely as a security-assistance and informational tool.
The App does not guarantee that all breaches, leaks, compromised accounts, or exposed credentials will be detected.
Breach databases may be incomplete, delayed, inaccurate, unavailable, or contain duplicate information.
A result indicating that information was not found does not mean that the information has never been compromised.
Similarly, a detected result does not necessarily establish that a particular account is currently compromised.
You should take appropriate security measures regardless of the results provided by the App.
You are responsible for:
Providing accurate information when using the App;
Using the App only for lawful purposes;
Protecting your device and Apple account;
Protecting passwords and credentials stored in the App;
Reviewing breach results and taking appropriate security measures;
Changing compromised passwords when appropriate;
Avoiding password reuse across different services.
You should never use the App to obtain, investigate, or monitor credentials belonging to another person without lawful authorization.
You agree not to use the App to:
Access accounts belonging to other people without authorization;
Test credentials that you do not have permission to test;
Attempt to gain unauthorized access to systems or services;
Conduct credential stuffing, password spraying, brute-force attacks, or similar activities;
Facilitate hacking, fraud, identity theft, or other unlawful activity;
Circumvent security controls;
Abuse or overload third-party APIs;
Reverse engineer, interfere with, or disrupt the App or its infrastructure;
Use the App in violation of applicable laws or regulations.
The App is intended for personal security, awareness, and authorized security purposes only.
The App relies on third-party services to provide certain breach and credential-checking functionality.
These services may include:

Enzoic — https://console.enzoic.com/
Your use of functionality provided through third-party services may also be subject to the applicable third-party terms and policies.
Enzoic's published API documentation states that its services provide checks for exposed passwords, compromised credentials, and exposure information.
Enzoic also requires applications integrating its services to provide users with appropriate privacy notices and to inform users when usernames, passwords, login information, or other personal information may be available to the application and Enzoic.
The App may provide functionality allowing you to save passwords and credentials.
You remain solely responsible for the security of information that you choose to save.
Where the App stores credentials locally on your device, you are responsible for maintaining the security of the device, device passcode, Apple account, and any other security mechanisms used to access the device.
We strongly recommend using unique and strong passwords for every online account.
You retain ownership of information that you submit to or store in the App.
By using the App, you grant the Company only the limited rights necessary to process your information for providing the requested functionality, operating the App, maintaining security, and complying with applicable law.
We do not claim ownership of your passwords, usernames, or other personal information.
Although we take reasonable measures to protect the App and information processed through it, no service can guarantee absolute security.
The Company does not guarantee that:
The App will always be available;
Third-party services will always be available;
All breaches will be detected;
All breach information will be accurate;
Your information will never be exposed;
The App will be free from errors or vulnerabilities.
You use the App at your own risk.
The App provides informational security results and recommendations.
The App does not provide professional cybersecurity, legal, financial, or other professional advice.
If you believe that your account has been compromised, you should contact the affected service provider and take appropriate security measures, including changing passwords and enabling multi-factor authentication where available.
The App, including its software, interface, design, branding, text, graphics, functionality, and other original materials, is owned by or licensed to ELGAR SOLUTIONS LTD and is protected by applicable intellectual-property laws.
You may not copy, reproduce, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the App except where expressly permitted by applicable law.
“Been Pwned? Breach Checker” and associated branding may not be used without authorization from the Company.
The App may be distributed through Apple's App Store.
Your use of the App is also subject to Apple's applicable terms and policies.
Apple is not responsible for the App, its maintenance, support, or content.
To the extent permitted by applicable law, Apple has no obligation to provide maintenance or support services for the App.
We may modify, update, suspend, or discontinue any part of the App at any time.
We may introduce new features, remove existing features, change functionality, or modify third-party integrations.
We are not responsible for losses resulting from the unavailability or modification of third-party services.
You may stop using the App at any time by deleting it from your device.
We may restrict or terminate access to the App if you violate these Terms, misuse the App, engage in unlawful activity, or create a security or operational risk.
Upon termination, provisions that by their nature should survive termination will remain effective.
To the maximum extent permitted by applicable law, ELGAR SOLUTIONS LTD and its directors, officers, employees, affiliates, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the App.
This includes, without limitation, losses resulting from:
Compromised accounts;
Password theft;
Data breaches;
Inaccurate breach information;
Missed breach information;
Third-party service interruptions;
Unauthorized access to your device;
Loss of stored credentials;
Reliance on information provided by the App.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless ELGAR SOLUTIONS LTD and its affiliates, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from:
Your misuse of the App;
Your violation of these Terms;
Your violation of applicable laws;
Your unauthorized use of another person's information;
Your violation of third-party rights.
Your use of the App is also governed by our Privacy Policy.
The Privacy Policy explains how information may be collected, processed, stored, and shared in connection with the App.
By using the App, you acknowledge that you have reviewed the Privacy Policy.
We may update these Terms from time to time.
When changes are made, we will update the Effective Date at the beginning of these Terms.
Your continued use of the App after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
These Terms shall be governed by and interpreted in accordance with the laws applicable to ELGAR SOLUTIONS LTD, without regard to conflict-of-law principles, except where mandatory consumer-protection laws provide otherwise.
Nothing in these Terms is intended to deprive consumers of rights that cannot legally be waived under the laws of their country or place of residence.
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified or removed only to the extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy and any additional terms presented within the App, constitute the entire agreement between you and ELGAR SOLUTIONS LTD regarding your use of the App.
