1. Binding Agreement

These Terms of Service (“TOS”) constitute a legally binding agreement between Beastly Creations (“the Maker,” “we,” “us”) and the commissioning party (“the Client,” “you”).

By submitting payment, signing an invoice, checking an agreement box, or otherwise commissioning services from Beastly Creations, you explicitly agree to these Terms of Service in full.

2. Eligibility

• Clients must be 18 years of age or older.
  
  

• Commissions for or on behalf of minors are strictly prohibited, excluding parental consent.
  
  

• Misrepresentation of age constitutes a breach of contract and voids any refund eligibility.
  
  

3. Custom Nature of Work

All items produced by Beastly Creations are custom-made, handmade goods created specifically for the Client based on provided references and measurements.

As custom goods, commissioned items are not eligible for return or refund except under the limited circumstances outlined in Section 7.

4. Quotes, Pricing, and Payment

• All prices are provided by quote and are not final until confirmed in writing.
  
  

• Prices are listed in United States Dollars (USD) unless otherwise stated.
  
  

• Payment plans, if offered, are binding agreements and must be completed according to the agreed schedule.
  
  

• Work does not begin until a payment or a deposit is received.
  
  

• Failure to submit payment by the agreed deadline constitutes abandonment of the commission and may result in cancellation without refund.
  
  

5. Artistic Discretion

The Client acknowledges that Beastly Creations operates as an independent artist and maker, not a mass-production service.

Reference images and descriptions are interpretive guides only. Exact replication is not guaranteed. Minor variations in color, texture, proportions, symmetry, expression, or construction are normal characteristics of handmade work and do not constitute defects, misrepresentation, or grounds for dispute or refund.

Beastly Creations reserves the right to make reasonable artistic, structural, or material adjustments to ensure safety, durability, wearability, and quality.

Requests that are unsafe, impractical, or inconsistent with the Maker’s capabilities or standards may be declined or modified at the Maker’s discretion.

6. Client Responsibilities

The Client is solely responsible for:

• Providing accurate references, measurements, and design information
  
  

• Reviewing updates and responding within a reasonable timeframe
  
  

• Verifying details prior to final approval
  
  

Beastly Creations is not liable for errors, fit issues, or dissatisfaction resulting from incorrect or incomplete information supplied by the Client.

7. Refunds, Cancellations, and Dispute Policy

No-Refund Policy for Custom Work

Due to the custom-made nature of all items, all sales are final once work has begun.

• Deposits are non-refundable under all circumstances once work has started.
  
  

• Payments for completed or partially completed work are non-refundable.
  
  

• Cancellation by the Client does not entitle the Client to a refund.
  
  

Dispute and Chargeback Policy

The Client agrees to contact Beastly Creations directly to attempt resolution before initiating any chargeback or payment dispute.

Initiating a chargeback or dispute:

• Constitutes a breach of this agreement
  
  

• May result in immediate termination of service
  
  

• May result in refusal of future commissions
  
  

• Does not override the custom nature of the goods provided
  
  

Documentation, including progress photos, communications, invoices, and this TOS, may be submitted as evidence in dispute resolution.

8. Limited Refund Exceptions

Refunds may be issued only at the sole discretion of Beastly Creations and only under the following conditions:

1. Maker-Canceled Commission (Pre-Production Only)
   If Beastly Creations cancels a commission before substantial work has begun, payments beyond a non-refundable deposit may be refunded.
   
   

2. Inability to Complete
   If the Maker is unable to complete the commission due to serious illness, injury, or emergency, a proportional refund will be issued based on uncompleted work.
   
   

3. Material and Irreparable Deviation
   In the rare event of a significant, irreparable deviation from the agreed design that cannot be corrected, a partial or full refund may be issued.
   
   

Refunds will not be issued for:

• Artistic interpretation or stylistic differences
  
  

• Minor imperfections inherent to handmade work
  
  

• Changes in personal preference
  
  

• Delays within a reasonable timeframe
  
  

• Wear, damage, or misuse after delivery
  
  

9. Timelines

All timelines are estimates only. Delays may occur due to material availability, health, personal circumstances, or workload.

Delays do not constitute breach of contract and are not grounds for refunds or disputes.

10. Shipping and Risk of Loss

• Shipping costs are the responsibility of the Client unless stated otherwise.
  
  

• Risk of loss transfers to the Client upon shipment.
  
  

• Beastly Creations is not responsible for carrier delays, loss, or damage.
  
  

• Shipping insurance is recommended and may be required for high-value items.
  
  

11. Modifications and Repairs

Post-completion modifications or repairs may incur additional fees. Normal wear, damage, or misuse is not covered.

12. Intellectual Property

Beastly Creations retains the right to photograph and display commissioned work for promotional and portfolio use unless otherwise agreed in writing.

The Client may not claim authorship of the construction or craftsmanship of the item.

13. Limitation of Liability

To the fullest extent permitted by law, Beastly Creations is not liable for injuries, allergic reactions, improper use, or indirect damages.

All items are used at the Client’s own risk.

14. Right to Refuse Service

Beastly Creations reserves the right to refuse or terminate service for harassment, nonpayment, policy violations, or abusive behavior.

15. Acceptance

Payment, commission submission, or acceptance of services constitutes full agreement to these Terms of Service.
