FutureSelf: AI Therapy Planner Terms and Conditions of Use

Welcome to FutureSelf’s Terms and Conditions of Use (these “Terms”). This is a contract between you and FutureSelf (the “FutureSelf: AI Therapy Planner Operator”, “we”, or “us”), and we want you to know your and our rights before you use the FutureSelf website or application (“FutureSelf” or the “App”). Please take a few moments to read these Terms before enjoying the App, because once you access, view, or use the App, you are legally bound by these Terms. Please also read our Community Guidelines (which form part of these Terms) and our Privacy Policy at https://sites.google.com/view/batherapy/page.

Please be aware that if you subscribe to services for a term (the “Initial Term”), the terms of your subscription will be automatically renewed for additional periods of the same duration as the Initial Term at FutureSelf’s then-current fee for such services, unless you cancel your subscription in accordance with Section 5 below.

You should also note that Section 13 of these Terms contains provisions governing how claims that you and the FutureSelf Operator have against each other are resolved. In particular, it contains an arbitration agreement that will, with limited exceptions, require disputes between us to be submitted to binding and final arbitration. You have a right to opt out of the arbitration agreement pursuant to Section 13 below. If you do not opt out, (1) you will only be permitted to pursue claims against us on an individual basis only; and (2) you are waiving your right to seek relief in a court of law and to have a jury trial on your claims.

Notice to California subscribers: You may cancel your subscription and request a refund at any time prior to midnight of the third business day following the date you subscribed. If you subscribed using your Apple ID, refunds are handled by Apple, not FutureSelf. To request a refund, please visit Apple Support.

1. FutureSelf RULES

Before you can use the App, you will need to register for an account (“Account”). To create an Account, you must:

• Be legally permitted to use the App by the laws of your home country.

• Provide accurate information during registration.

You can create an Account via manual registration using an email address or by using your Google or Apple login details. If you create an Account using Google or Apple login details, you authorize us to access, display, and use certain information from your Google or Apple account (e.g., name, email address). For more information about what information we use and how we use it, please check out our Privacy Policy.

You may not use another person’s FutureSelf Account or share your Account with any other person without permission. You are responsible for ensuring that any use of your Account complies with these Terms.

You can delete your Account at any time by going to the ‘Settings’ page when logged in and selecting the ‘Delete account’ option. Your Account will be deleted immediately, but it may take a little while for Your Content (defined below) to be completely removed from the App. Your profile information will be treated in accordance with our Privacy Policy. If you delete your Account and try to create a new Account within this time period using the same credentials, we may re-activate your Account for you.

We use a combination of automated systems and a team of moderators to monitor and review Accounts and content to identify breaches of these Terms. We reserve the right, at our sole discretion, to terminate or suspend any Account, restrict access to the App, or use any operational, technological, legal, or other means to enforce the Terms (including blocking specific IP addresses). For users in the European Union (“EU”), we will notify you when we take action against your Account or Your Content unless it is not appropriate to do so (e.g., if prohibited by law enforcement). For all other users, we may take such action without prior notice. We may terminate or suspend your Account without notice for: (1) violating these Terms; (2) inappropriate conduct on the App; or (3) any reason we deem justifies termination. If your Account is terminated or suspended, you will not receive a refund for any paid services or features already charged.

If you believe we’ve made a mistake in taking action on your Account or Your Content, you may appeal our decision within six months. To appeal, please contact us at batherapyapp@gmail.com, explaining why you are appealing and providing as much detail as possible. For EU users, you have additional rights under the Digital Services Act, including access to out-of-court dispute settlement processes, remedies in EU courts, and the ability to lodge complaints with your local EU regulatory authority.

You may not access, tamper with, or use non-public areas of the App or our systems. Certain portions of the App may not be accessible if you have not registered for an Account.

2. TYPES OF CONTENT

There are three types of content you can access on the App:

• Content you upload and provide (“Your Content”);

• Content that members provide (“Member Content”); and

• Content that the FutureSelf Operator provides (including databases and software) (“Our Content”).

Content We Can’t Allow on FutureSelf

Our Community Guidelines form part of these Terms and outline what content and conduct are acceptable. You agree to comply with our Community Guidelines, as updated from time to time.

We encourage users to express themselves through FutureSelf, but we impose restrictions on certain content that:

• Is illegal or encourages, promotes, or incites illegal activity;

• Is harmful to minors;

• Is defamatory or libelous;

• Infringes any third party’s rights (e.g., intellectual property or privacy rights);

• Contains language or imagery that could be deemed offensive or is likely to harass, upset, embarrass, alarm, or annoy others;

• Is obscene, pornographic, violent, or otherwise offends human dignity;

• Is abusive, insulting, threatening, discriminatory, or promotes racism, sexism, hatred, or bigotry;

• Relates to commercial activities (e.g., sales, competitions, advertising, links to other websites);

• Involves “junk” mail or “spam”;

• Impersonates or intends to deceive or manipulate a person;

• Contains spyware, adware, viruses, or other malicious code; or

• Violates our Community Guidelines.

Your Content

Your Content includes text, images, and recordings you upload for personal use (e.g., diary notes, emotion tracking, or AI-generated plans), which are not visible to other users. You may also share public YouTube links under emotional categories, viewable through the App’s internal web view. Shared YouTube links must comply with our Community Guidelines, emphasizing music to resonate with emotions and the community. Shared links are automatically deleted after 60 days, and you can only delete your own shared links.

You are responsible and liable for Your Content and will indemnify, defend, and hold us harmless from any claims made in connection with Your Content. You may not display personal contact or banking information in Your Content. If you reveal personal information to others, it is at your own risk.

By uploading Your Content, you represent and warrant that you have all necessary rights and licenses to do so and grant us a non-exclusive, royalty-free, perpetual, worldwide license to use Your Content in any way (e.g., editing, copying, modifying, distributing). We may assign or sub-license this license to our affiliates without further approval from you. We are not obligated to store Your Content, so you should keep copies of important content.

Member Content

Member Content includes public YouTube links shared by other users under emotional categories. Member Content belongs to the user who posted it and is stored on our servers, displayed via the App’s internal web view. You may only use Member Content to view and engage with shared links as intended by the App’s functionality. You may not use Member Content for commercial purposes, harassment, or unlawful activities. We reserve the right to terminate your Account if you misuse Member Content.

Our Content

All other text, graphics, user interfaces, trademarks, logos, sounds, artwork, and intellectual property on FutureSelf, as well as the FutureSelf software and databases, are owned, controlled, or licensed by us and protected by copyright, trademark, and other intellectual property laws. We grant you a non-exclusive, limited, personal, non-transferable, revocable license to access and use Our Content, subject to these Terms. You shall not use, sell, modify, distribute, or create derivative works from Our Content except as permitted by the App’s functionality.

No Obligation to Pre-Screen Content

We do not assume any obligation to pre-screen Your Content or Member Content but reserve the right to review, refuse, or remove any content that violates these Terms.

AI-Generated Content

The FutureSelf App includes features that use artificial intelligence (“AI”) to generate content, such as personalized suggestions, progress analyses, action items, or other outputs (collectively, “AI-Generated Content”), available through the Pro Service. AI-Generated Content is provided as a tool to assist you in your self-improvement and personal growth journey. However, AI-Generated Content is not professional advice, and its accuracy, appropriateness, or suitability is not guaranteed.

You are responsible for carefully reviewing and evaluating all AI-Generated Content before acting on or relying on it. You should use your own judgment and, where necessary, consult with qualified professionals (e.g., mental health professionals, financial advisors) to ensure that any actions you take based on AI-Generated Content are appropriate for your circumstances.

To the fullest extent permitted by law, we are not liable for any damages, losses, or consequences arising from your use of or reliance on AI-Generated Content. By using the AI features of the App, you acknowledge that you understand the limitations of AI-Generated Content and agree to use it at your own risk.

3. RESTRICTIONS ON THE APP

You agree to:

• Comply with all applicable laws, including privacy, intellectual property, and anti-spam laws;

• Use your real name and accurate information when creating your Account;

• Use the App in a safe, inclusive, and respectful manner, adhering to our Community Guidelines.

You agree that you will not:

• Act in an unlawful or disrespectful manner, including being dishonest, abusive, or discriminatory;

• Misrepresent your identity or affiliations;

• Disclose information without consent;

• Use the App for deceptive, inauthentic, or manipulative purposes (e.g., scams, spam);

• Submit false or unfounded appeals, reports, or complaints;

• Develop or use software, scripts, or other means to scrape or copy data from the App.

You can report abuse or complain about Member Content by contacting us at batherapyapp@gmail.com, outlining the issue. We reserve the right to investigate violations and may terminate your Account or remove unauthorized content without prior notice.

You are solely responsible for your interactions with the App and other users. You release the FutureSelf Operator from any claims, demands, losses, or damages arising from your use of the App, except for claims related to our fraud or fraudulent misrepresentations.

Scraping or replicating any part of the App without our consent is prohibited, except through our published interfaces.

4. COMMUNITY GUIDELINES

Our Community Guidelines govern the sharing of public YouTube links under emotional categories, viewable through the App’s internal web view. The primary purpose is to share music to better understand emotions and resonate with the community. You agree to:

• Share YouTube links that are primarily music-focused and appropriate for emotional reflection;

• Ensure shared links do not contain illegal, offensive, pornographic, violent, discriminatory, or commercial content;

• Only share links you have the right to share;

• Understand that shared links are automatically deleted after 60 days and can only be deleted by you.

We use automated systems and moderators to monitor shared YouTube links. We may remove links or suspend Accounts that violate these Guidelines without notice. If you believe a shared link violates these Guidelines, please report it to batherapyapp@gmail.com.

5. PAYMENT TERMS

Generally

FutureSelf offers subscription-based premium features (“Premium Services”) for purchase through the App (“In-App Purchase”). Premium Services include advanced AI features (e.g., AI chat, actionable plans, emotion visualization) and cloud storage. If you choose to make an In-App Purchase, additional terms disclosed at the point of purchase may apply and are incorporated herein by reference.

You may make an In-App Purchase through the Apple App Store (“Third Party Store”). Once you have made an In-App Purchase, you authorize us to charge your chosen Payment Method. If payment is not received, you agree to promptly pay all amounts due upon demand.

Subscriptions and Auto-Renewal

FutureSelf offers Premium Services as automatically renewing subscriptions (e.g., one-week, one-month, three-month, or one-year subscriptions). IF YOU PURCHASE AN AUTOMATICALLY RENEWING SUBSCRIPTION, YOUR SUBSCRIPTION WILL RENEW AT THE END OF THE PERIOD, UNLESS YOU CANCEL, AT FUTURESELF’S THEN-CURRENT PRICE. To avoid charges for a new subscription period, you must cancel before the end of the then-current subscription period. Deleting your Account or the App does not cancel your subscription.

You will be notified of changes in Premium Services pricing and given an opportunity to cancel. If you do not cancel, you agree to be charged at the then-current pricing.

Cancelling Subscriptions

If you purchased a subscription through the Apple App Store, you must access your Apple account and follow instructions to change or cancel your subscription. If you cancel, you may use your subscription until the end of the paid period, but you will not be eligible for a prorated refund (except as noted below), and your subscription will not renew.

Refunds

Generally, all charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods. However, for subscribers in Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, and Wisconsin:

• YOU MAY CANCEL YOUR SUBSCRIPTION, WITHOUT PENALTY, AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY FOLLOWING THE DATE YOU SUBSCRIBED (EXCLUDING SUNDAYS AND HOLIDAYS).

• If you die before the end of your subscription period, your estate is entitled to a refund for the unused portion.

• If you become disabled and unable to use FutureSelf before the end of your subscription period, you are entitled to a refund for the unused portion by providing notice.

To request a refund: If you subscribed using your Apple ID, refunds are handled by Apple. Go to iTunes, click your Apple ID, select “Purchase history,” find the transaction, and select “Report Problem” or submit a request at Apple Support.

Taxes

Payments do not include Sales Tax. If we are legally obligated to collect Sales Tax, it will be added to the payments required under this Section 5. You are responsible for any Sales Tax not remitted to us, including penalties or interest.

6. SAFETY AND MODERATION

Safety is a priority at FutureSelf. We use automated systems and moderators to monitor Accounts and shared YouTube links for content that violates our Community Guidelines or these Terms. If you encounter content that makes you uncomfortable or violates our Guidelines, please report it via the App or at batherapyapp@gmail.com.

When determining actions for violations, we may:

• Remove the content;

• Issue a warning;

• Suspend or terminate the offending Account.

You may not submit false reports or complaints. If you believe we’ve made a mistake in taking action on your Account or content, you may appeal within six months by contacting batherapyapp@gmail.com.

7. PRIVACY

For information about how the FutureSelf Operator collects, uses, and shares your personal data, please check out our Privacy Policy at https://sites.google.com/view/batherapy/page. By using FutureSelf, you acknowledge that we may use your data in accordance with our Privacy Policy.

8. PUSH NOTIFICATIONS

We may provide push notifications, emails, or other messages related to the App, such as updates, offers, or reminders. After downloading the App, you will be asked to accept or deny push notifications. If you accept, notifications will be sent automatically. You can opt out by changing your device’s notification settings. For other communications (e.g., emails), you can unsubscribe by following the instructions in the communication or emailing batherapyapp@gmail.com.

9. DISCLAIMER

THE APP, OUR CONTENT, AND MEMBER CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE ACCURACY OR EFFECTIVENESS OF AI-GENERATED PLANS, EMOTION TRACKING, OR OTHER FEATURES.

IF APPLICABLE LAW DOES NOT PERMIT THE EXCLUSION OF WARRANTIES, WE GRANT THE MINIMUM WARRANTY REQUIRED BY LAW. YOUR USE OF THE APP IS AT YOUR OWN RISK. THE FUTURESELF OPERATOR IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER OR THE ACCURACY OF MEMBER CONTENT.

10. LIMITATION OF LIABILITY

NEITHER THE FUTURESELF OPERATOR NOR ANY OWNER WILL BE LIABLE FOR ANY DAMAGES, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE, INCLUDING LOSS OF DATA, INCOME, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, OUR CONTENT, OR MEMBER CONTENT, WHETHER BASED ON CONTRACT, TORT, OR OTHERWISE.

IF YOU ARE DISSATISFIED WITH THE APP, YOUR SOLE REMEDY IS TO STOP USING IT. OUR AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). THESE LIMITATIONS DO NOT APPLY TO LIABILITY FOR FRAUD OR FRAUDULENT MISREPRESENTATIONS OR OTHER LIABILITY THAT CANNOT BE LIMITED BY LAW.

11. INDEMNITY

You agree to indemnify, defend, and hold the FutureSelf Operator harmless from any third-party claims, damages, losses, or expenses (including legal fees) arising from:

• Your negligent acts or willful misconduct;

• Your use of the App;

• Your Content;

• Your breach of these Terms;

• Your violation of any law or third-party rights.

We retain the right to settle or compromise claims without your consent. You will cooperate fully if requested.

12. PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT

If you believe content on FutureSelf infringes your copyright, please submit a DMCA Takedown Notice to our Copyright Agent at batherapyapp@gmail.com. The notice must include:

• Your signature;

• Identification of the copyrighted work;

• Identification of the infringing material;

• Your contact information;

• A statement of good faith belief that the use is unauthorized;

• A statement, under penalty of perjury, that the information is accurate.

13. DISPUTE RESOLUTION

Arbitration Agreement

Unless you opt out as described in Section 13(10), this Arbitration Agreement requires you and the FutureSelf Operator to resolve disputes by binding arbitration instead of in court.

1. Applicability: This Arbitration Agreement applies to all disputes arising from these Terms, your use of the App, or your relationship with the FutureSelf Operator, except for small claims or intellectual property disputes.

2. Notice and Informal Resolution: Before arbitration, you must notify us of the dispute in writing at least 60 days in advance at: FutureSelf, Attn: Disputes, batherapyapp@gmail.com. We will meet via teleconference to attempt informal resolution. 

3. Starting Arbitration: If unresolved, either party may file a claim with an arbitration provider by submitting a demand to: FutureSelf, Attn: Arbitration, batherapyapp@gmail.com.

4. Rules: The Federal Arbitration Act governs. Arbitration will be administered by ADR Services, Inc. (California residents) or National Arbitration and Mediation (others), under their current rules. Filing fees are paid by the initiating party, but you may qualify for a waiver.

5. Arbitrator’s Authority: The arbitrator can award monetary and non-monetary relief, issuing a written decision. Awards are final and binding.

6. No Jury Trials: You waive your right to a jury trial.

7. Individual Basis: Claims must be arbitrated individually, not as a class action, except as provided in mass filing protocols.

8. Mass Filings: If 30 or more similar claims are filed, bellwether arbitrations, global mediation, and batch arbitration protocols apply to increase efficiency.

9. Offer of Judgment: Parties may make settlement offers before arbitration hearings.

10. Opt-Out: You may opt out within 31 days of becoming subject to this Agreement by emailing batherapyapp@gmail.com with your name, username, email/phone, and a clear opt-out statement.

11. Severability: If any part of this Arbitration Agreement is invalid, it will be severed, and the remainder will apply.

12. Survival: This Agreement survives the termination of your relationship with FutureSelf.

14. TERMINATION AND REMEDIES

These Terms commence when you accept them and continue until terminated. You can delete your Account via the ‘Settings’ tab. Subscriptions continue until the end of the paid period, with no refunds except as stated in Section 5.

If we determine you have breached these Terms or engaged in inappropriate conduct, we may:

• Warn you via email;

• Delete Your Content;

• Terminate your Account;

• Discontinue your subscription without refund;

• Cooperate with law enforcement;

• Pursue other appropriate actions.

Terminated Accounts lose access to all related information. Provisions such as the Arbitration Agreement, disclaimers, and liability limitations survive termination.

15. MISCELLANEOUS

These Terms constitute the entire agreement between you and the FutureSelf Operator, superseding prior agreements except the Privacy Policy. We may amend these Terms, posting updates on this page with the Effective Date. Your continued use after changes constitutes acceptance.

The App is provided “as is.” We are not responsible for viruses, errors, or damages from your use. Communications may occur electronically, satisfying any legal requirement for written communication.

If any Term is invalid, it will be severed, and the remainder will remain enforceable. You warrant that you are not subject to U.S. embargoes or listed on prohibited party lists.

The App operates globally, and your data may be transferred to countries like the United States. Third-party links are at your own risk, and we are not responsible for their content.

16. GOVERNING LAW AND FORUM

Subject to Section 13 and mandatory local laws, these Terms and your use of the App are governed by Texas law. Claims not subject to arbitration will be litigated in the federal or state courts of Travis County, Texas, where you consent to jurisdiction and venue.

17. THE FUTURESELF OPERATOR

The FutureSelf Operator is FutureSelf, a sole proprietorship.
