Welcome to Bass Booster and Equalizer (the "App"), developed and operated by Vishal Kumar ("we", "us", or "our"). Please read these Terms and Conditions ("Terms", "Terms of Use") carefully before using the App.
By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not download, access, or use the App.
1. License and Permitted Use
We grant you a personal, non-exclusive, non-transferable, revocable, and limited license to download, install, and use the App on mobile devices owned or controlled by you, solely for your personal, non-commercial entertainment and audio enhancement purposes, in strict accordance with these Terms.
You agree not to:
• Decompile, reverse engineer, disassemble, decrypt, or attempt to derive the source code of the App.
• Modify, adapt, improve, enhance, translate, or create derivative works from the App.
• Violate any applicable local, national, or international laws or regulations in connection with your use of the App.
• Distribute, license, sell, rent, lease, or commercially exploit the App or any part thereof to any third party.
2. Audio Safety & Hearing Health Disclaimer
⚠️ IMPORTANT HEALTH & HARDWARE WARNING:
Listening to audio at high volumes, or using excessive bass and volume amplification for prolonged periods, can cause permanent hearing damage, tinnitus, or hearing loss. Extreme amplification may also potentially damage your device’s internal speakers or connected headphones/earphones.
User Responsibility: You acknowledge and agree that you use the App's amplification, equalizer, volume boost, and bass boost features at your own discretion and risk.
Volume Caution: You are strongly advised to increase volume and bass gradually, keep listening levels within safe, moderate thresholds, and take regular listening breaks.
Limitation of Liability: In no event shall Vishal Kumar be held responsible or liable for any hearing impairment, personal injury, device hardware failure, speaker distortion, or headphone damage resulting from the use or misuse of the App.
3. Subscriptions, Free Trials, and In-App Purchases
The App offers optional premium features ("Bass Booster Pro" / "VIP Access") through Google Play Billing:
A. 3-Day Free Trial
We may offer a 3-day free trial for the Monthly subscription plan.
Automatic Conversion: Unless you cancel the trial at least 24 hours before the 3-day trial period expires, your free trial will automatically convert into a paid monthly subscription at the price indicated at checkout.
Trial Eligibility: Free trials are available only to first-time subscribers as determined by Google Play.
B. Paid Subscriptions (Monthly & Yearly)
Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless auto-renew is turned off or the subscription is canceled at least 24 hours before the current period ends.
Your Google Play account will be charged for renewal within 24 hours prior to the end of the current billing cycle.
C. Lifetime Access (One-Time Purchase)
The "Lifetime Access" option is a single, non-recurring, one-time in-app purchase that permanently unlocks all Pro features for your Google account on supported devices.
D. Cancellation and Subscription Management
You can manage or cancel your subscriptions at any time directly through your Google Play Store Account Settings (Google Play > Profile Icon > Payments & Subscriptions > Subscriptions).
Uninstalling the App does not automatically cancel your active subscription.
E. Refunds
All purchases, transactions, and refund requests are processed and governed strictly by Google Play's standard refund policies.
To request a refund, please refer to Google Play Refund Support.
4. Audio Visualizer and Device Permissions
Microphone (RECORD_AUDIO) Permission: The App requests permission to access the audio stream exclusively to perform real-time frequency calculations for the visualizer.
No Recording or Storage: We do not record, store, capture, or transmit any audio signals or conversations. All audio processing is executed strictly in real-time in your device's temporary memory (RAM) and is discarded immediately.
5. Third-Party Advertisements and Services
The free version of the App displays third-party advertisements served by Google AdMob.
We do not endorse, guarantee, or assume responsibility for any products, services, or websites advertised by third parties within the App.
Your interactions with third-party advertisers are solely between you and the respective third party.

6. Intellectual Property
All intellectual property rights, trademarks, visual interfaces, graphics, icons, presets, code, algorithms, and design elements within the App are the exclusive property of Vishal Kumar or our licensors.
Nothing in these Terms grants you any right, title, or interest in or to our trademarks, logos, or brand identity.
7. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
• THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS;
• THE APP WILL OPERATE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
• AUDIO EFFECTS WILL OPERATE UNIFORMLY ACROSS ALL HARDWARE CONFIGURATIONS, CHIPSETS, OR THIRD-PARTY MEDIA PLAYERS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VISHAL KUMAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, DEVICE DAMAGE, HARDWARE WEAR, SPEAKER BLOWOUT, OR HEARING IMPAIRMENT) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Modifications to the App and Terms
We reserve the right, at our sole discretion, to modify, update, suspend, or discontinue any feature, preset, or service in the App at any time without prior notice.
We may revise these Terms from time to time. Any changes will be posted on this page with an updated "Last Updated" date.
Continued use of the App following the posting of changes constitutes your acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
