**TERMS AND CONDITIONS OF USE FOR THE “BAOOLE” APP**

## 1. INTRODUCTION AND ACCEPTANCE

Welcome to Baoole. These Terms and Conditions govern access to and use of the mobile application named “Baoole” (hereinafter, the “App” or “Service”), provided by the Owner indicated in Section 2. Use of the App implies full and unconditional acceptance of these Terms. If you do not accept the Terms, do not use the App.

## 3. TERRITORIAL SCOPE

The App is intended exclusively for use in Italy. Access and use from other jurisdictions are prohibited. The User declares that they will use the App only if they are physically located in Italy.

## 4. DEFINITIONS

User: a person who registers and uses the App.

Private Leagues: gaming spaces within the App with a maximum of 20 users each.

User Content: text, images, messages, and any material uploaded by Users.

Subscriptions: paid PRO, PREMIUM, GOLD, and GOLD+ plans as described in Section 7.

## 5. SERVICE DESCRIPTION

Baoole is a game where users predict the results of soccer matches and tournaments; no monetary bets are required to participate. The User may choose the competition/tournament and participate in Private Leagues consisting of up to 20 users. The App does not constitute gambling and does not allow for cash winnings.

## 6. ACCESS AND REGISTRATION REQUIREMENTS

Registration can be done via email and password or by logging in with a Google or Apple account. Required information: name, email, date of birth; uploading a profile photo is optional. The User is responsible for the accuracy of the information provided and for safeguarding their credentials.

Use of the App is permitted exclusively to Users of legal age (18 years or older). By registering and using the App, the User represents and warrants that they are of legal age. The Owner reserves the right to immediately delete any account without notice if it determines that it belongs to a minor.

## 7. MONETIZATION, SUBSCRIPTIONS, AND PAYMENTS

The App is currently free. In the future, annual subscriptions may be introduced with the following features:

- PRO: €5.90/year — view other users’ predictions in the same Private League.

- PREMIUM: €10.90/year — create a Private League in a single Competition.

- GOLD: €15.90/year — creation of a Private League in one or more Competitions.

- GOLD+: €25.90/year — creation of one or more Private Leagues in one or more Competitions.

Payments will be processed through the payment systems of the platforms (Google Play, App Store) or other providers indicated at the time of purchase. Refund conditions and billing methods are subject to the policies of the respective platforms.

Right of withdrawal: Generally, the consumer has a right of withdrawal within 14 days for distance contracts. For digital content provided immediately, the right of withdrawal may be excluded if the User gives their explicit consent and acknowledges the loss of the right of withdrawal at the time of purchase.

## 8. USER-GENERATED CONTENT AND LIABILITY

Users may upload profile photos and send messages/texts in internal chats. Each User is solely responsible for the content they publish.

The Owner does not perform prior moderation of content. The Owner reserves the right to remove or block content that is manifestly unlawful, violates the rights of third parties or these terms and conditions, or that is reported and verified as such.

It is prohibited to publish content that violates the law, the rights of third parties, or that is defamatory, discriminatory, pornographic, or offensive. The Owner may suspend or delete accounts that repeatedly violate these rules.

## 9. LIMITATION OF LIABILITY

The App is provided “as is,” and the Owner does not guarantee that the Service will be uninterrupted, error-free, or secure under all circumstances.

The Owner is not liable for indirect damages, data loss, lost profits, or other consequential damages arising from the use of the App, except in cases of mandatory liability provided for by Italian law.

The Owner is not liable for any malfunctions attributable to third parties, distribution platforms, or external service providers.

## 10. PROCESSING OF PERSONAL DATA (SUMMARY)

Data collected: email address, password (encrypted), name, profile photo, date of birth.

Purposes: provision of the Service, account management, authentication, operational communications, statistical analysis, and improvement of the Service.

Legal basis: performance of the contract and, where necessary, the User’s consent.

External processors: Firebase (Google Firestore and Storage), Google Sign-In, Apple Sign-In, Google Analytics.

Retention: for the time necessary to provide the Service and in accordance with the law.

Data subject rights: access, rectification, erasure, restriction, portability, objection, and the right to lodge a complaint with the Data Protection Authority.

## 11. THIRD PARTIES AND EXTERNAL SERVICES

The App uses third-party services for authentication, storage, analytics, and payments. The use of these services is governed by the respective policies of the providers. The Data Controller is not responsible for the practices of these third parties.

## 12. INTELLECTUAL PROPERTY

All content, trademarks, logos, graphics, and software in the App are the property of the Owner or its licensors and are protected by copyright and trademark laws. The User is granted a limited, non-exclusive, and revocable license to use the App in accordance with these Terms.

## 13. DISCLAIMER

This app is an independent project and is not affiliated with, sponsored by, or endorsed by FIFA, UEFA, AFC, CAF, CONCACAF, CONMEBOL, OFC, or any other official organizations. The names and references to tournaments are used for descriptive purposes only. The predictions are intended solely for entertainment purposes.

## 14. TERM, SUSPENSION, AND TERMINATION

Access to the App is granted until revoked. The Owner may suspend or terminate the User’s account in the event of a violation of these Terms or for technical or security reasons.

The User may delete their account at any time via the App or by writing to info@baoole.com.

## 15. CHANGES TO THE TERMS

The Owner reserves the right to modify these Terms. Changes will be communicated via notification within the App or by email. Continued use of the App following the publication of changes constitutes acceptance of such changes.

## 16. GOVERNING LAW AND JURISDICTION

These Terms are governed by Italian law. For disputes between the Owner and the User-consumer, the competent court is that of the consumer’s residence or domicile in Italy. For non-consumer Users, the competent court is that of Florence.

## 17. COMMUNICATIONS AND COMPLAINTS

For reports, support requests, or complaints, please write to info@baoole.com. The estimated response time is 4–5 business days.

## 18. FINAL PROVISIONS

These Terms do not exhaust all applicable legal information. For greater protection, we recommend consulting a legal advisor before final publication. The official version of the Terms is written in Italian.
