This Customer Service Agreement (“Agreement”) is a legally binding contract between Bantu2U Holdings Sdn Bhd (“Bantu”, “We”, “Us”) and the user of the Bantu Pandu Application (“Customer”, “You”). By creating an account, requesting roadside assistance, or using any feature of the Bantu Pandu Application, you acknowledge and agree to the terms of this Agreement.
1.1 Purpose of the Application The Bantu Pandu Application is a platform that connects Customers with independent third-party service providers (“Service Providers” or “Merchants”) offering roadside assistance, towing, repair, and other automotive services. Bantu does not provide roadside assistance services directly; we only facilitate the connection.
1.2 Eligibility By using the Application, you certify that:
You are at least 18 years old.
You provide accurate and truthful information.
You are legally authorized to request services for the vehicle listed.
2.1 Accurate Information You agree to provide accurate, complete, and updated information, including:
Contact details
Vehicle information
Location information
Relevant insurance information
Incorrect or incomplete information may result in delays or failed service delivery.
2.2 Safe Conduct You agree not to:
Endanger Service Providers
Provide fraudulent information
Request services for vehicles you do not own or have no authority over
Abuse or harass Service Providers, support staff, or Bantu representatives
Bantu reserves the right to suspend or terminate accounts violating these conditions.
3.1 Privacy Policy Incorporation The Privacy Policy for Customers (Last Updated 30 October 2025) is incorporated into this Agreement by reference. Your use of the Application signifies that you have read, understood, and agreed to the Privacy Policy.
3.2 Location Data You acknowledge and agree that:
The Application requires precise GPS location to dispatch the nearest available Service Provider.
Location is only collected during active service requests.
Disabling location services will prevent the use of emergency assistance features.
4.1 Independent Third-Party Service Providers You acknowledge that the Services are performed by independent Service Providers, including:
Tow truck drivers
Car workshops
Repair shops
Automotive merchants and panel providers
Bantu does not control or supervise their operations.
4.2 Quality of Services Bantu is not responsible for:
The quality, timeliness, or outcome of services provided
Damage, loss, or injury caused by Service Providers
Pricing or fees charged by Service Providers
Delays caused by traffic, weather, or inaccurate location information
All claims regarding service performance must be made directly with the Service Provider.
4.3 Safety and Conduct If a Service Provider behaves inappropriately or unsafely, you may report the incident through the Application. Bantu reserves the right to remove Service Providers who violate safety or conduct standards.
5.1 No Charges by Bantu Bantu Pandu’s core assistance platform is free for Customers. However, Service Providers may charge fees for:
Towing
Repair
Parts replacement
Labour
Additional services requested by you
Bantu does not:
Set prices for Service Providers
Process payments
Intervene in pricing disputes
All payment arrangements are between you and the Service Provider.
5.2 Disputes Any dispute regarding service charges must be resolved between you and the Service Provider directly. Bantu may assist with communication but is not responsible for refund decisions, damage claims, or price disagreements.
6.1 Customer Acknowledgment By using the Application, you acknowledge and agree that Bantu:
Is a technology platform, not a roadside service provider
Does not guarantee service availability or response times
Shall not be liable for delays, losses, or damages arising from service delivery
6.2 Indirect Damages Bantu is not liable for:
Vehicle damage caused by Service Providers
Personal injury caused during the service
Loss of property, income, or business
Any incidental, consequential, or indirect losses
7.1 Termination by Customer You may terminate your account at any time. Upon termination, data will be handled according to the Customer Privacy Policy (data deletion or anonymization).
7.2 Termination by Bantu We may suspend or terminate your account immediately for:
Fraudulent or harmful behaviour
Misuse of the Application
Harassment or threats toward Service Providers or staff
Providing false or misleading information
Violation of this Agreement or the Privacy Policy
8.1 Governing Law This Agreement shall be governed by the laws of Malaysia.
8.2 Dispute Resolution Any dispute arising from this Agreement shall be settled by binding arbitration under the rules of the Asian International Arbitration Centre (AIAC).
