Terms of Use

1. About auPairNest

auPairNest is a digital contact and matching platform that connects families seeking childcare with au pairs, nannies, and babysitters. auPairNest is not an employment agency, staffing agency, or placement service under Swiss law (Arbeitsvermittlungsgesetz, AVG).

2. Contact Bridge Only

auPairNest acts solely as an intermediary communication platform. We facilitate introductions between users but are not a party to any arrangement, agreement, or contract entered into between families and caregivers. All employment, service, au pair host, or other agreements are concluded directly between the users themselves.

3. No Employment or Agency Services

auPairNest does not:

Act as employer or employee of any caregiver
Guarantee the suitability, qualifications, references, or background of any user
Supervise, direct, or control any work performed by caregivers
Provide employment agency services under Swiss law or the equivalent laws of any other jurisdiction

4. Eligibility

You must be at least 18 years old to use auPairNest. By registering, you confirm that you meet this requirement. If we become aware that a user is under 18, we will deactivate their account immediately.

5. User Responsibility

Users are solely responsible for:

Conducting their own background checks and due diligence on other users
Complying with all applicable employment, immigration, and social security laws in their respective country of residence
Drafting and executing any employment or service contracts
Obtaining all necessary work permits, residence permits, and insurance
Paying all applicable taxes, social security contributions, and mandatory insurances required by their local law

6. Limitation of Liability

To the maximum extent permitted by Swiss law (OR Art. 100), auPairNest, its officers, employees, and agents shall not be liable for:

Loss, damage, injury, or harm arising from any user's actions or omissions
The accuracy or completeness of user-provided information
Disputes between families and caregivers
Employment-related claims including unpaid wages, wrongful termination, or workplace injuries
Any breach of contract between users
Indirect, incidental, or consequential damages of any kind

7. No Warranty

The Platform is provided "as is" without warranties of any kind. auPairNest does not warrant that the Platform will be uninterrupted, error-free, or that any match will result in a successful arrangement.

8. Indemnification

You agree to indemnify, defend, and hold harmless auPairNest from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Platform, your arrangements with other users, or your breach of these Terms.

9. Data Protection

We process personal data in accordance with the Swiss Federal Act on Data Protection (nDSG, SR 235.1) and, where applicable, the EU General Data Protection Regulation (GDPR). By using the Platform you acknowledge our Privacy Policy, which is available within the app. You have the right to access, correct, and delete your personal data at any time by contacting us at aupairnest@gmail.com.

10. Prohibited Use

You may not use auPairNest to:

Post false, misleading, or fraudulent information
Harass, abuse, or harm other users
Circumvent any safety or verification features of the Platform
Solicit or accept payments outside the Platform in order to bypass its terms
Engage in any activity that violates applicable law in your country of residence

11. Termination

auPairNest reserves the right to suspend or terminate any account at its sole discretion, including for breach of these Terms, without prior notice or liability. You may delete your account at any time through the app settings.

12. Governing Law & Jurisdiction

These Terms are exclusively governed by Swiss substantive law, excluding conflict-of-law rules. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the ordinary courts of the Canton of Zurich, Switzerland.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the app. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
