Licensed Application End User License Agreement

1. Acceptance of Terms

By downloading, installing, or using ClipTone: Ringtone Maker & MP3  (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. Description of Service

The App provides tools to:

• Extract audio from video files

• Import and trim audio files

• Create custom ringtones, alarm sounds, iMessage tones, and charging sounds

• Save and manage your audio creations

• Set custom tones on your iPhone via GarageBand integration

4. Subscriptions and In-App Purchases

4.1 Free Trial

The App may offer a 3-day free trial to access premium features. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription.

4.2 Subscription Plans

• Subscriptions are available on a weekly or yearly basis

• Prices may vary by region and are displayed in the App before purchase

• All prices are subject to change

4.3 Payment and Renewal

• Payment is charged to your Apple ID account upon confirmation of purchase

• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase

4.4 Refunds

All purchases are processed by Apple. Refund requests must be directed to Apple Support in accordance with Apple's refund policy.

5. User Content

5.1 Ownership

You retain all ownership rights to the audio files and content you create using the App.

5.2 Responsibility

You are solely responsible for ensuring that:

• You have the right to use any source video or audio file you import into the App

• Your use of created ringtones and tones complies with applicable copyright laws

• You do not use the App to infringe upon the intellectual property rights of others

5.3 Copyright Notice

The App is a tool for creating personal ringtones and tones. Creating ringtones from copyrighted material for personal use may be subject to copyright laws in your jurisdiction. We do not endorse or encourage copyright infringement.

6. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose

• Distribute, sell, or commercially exploit content created with the App that infringes third-party copyrights

• Reverse engineer, decompile, or disassemble the App

• Attempt to gain unauthorized access to the App's systems or networks

• Use the App to create content that is harmful, offensive, or violates any applicable laws

• Remove or alter any proprietary notices or labels on the App

7. Intellectual Property

The App, including its design, features, code, graphics, and user interface, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure

• The results obtained from the App will be accurate or reliable

• Any defects in the App will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

10. Device Compatibility

The App is designed for use on iPhone devices running a compatible version of iOS. We do not guarantee compatibility with all devices or iOS versions. GarageBand is required for setting custom ringtones and is available separately from the App Store.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be effective upon posting within the App or on our website. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

14. Apple-Specific Terms

These Terms are between you and us, not with Apple. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
