These Terms of Use (the “Terms”) form a legal agreement between you and HG Mobile Apps (“we,” “us,” or “our”) governing your use of the Attune mobile application (the “App”). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the App. By using the App you represent that you meet these requirements.
To use the App you create an account (via Sign in with Apple or email). You are responsible for keeping your login credentials secure and for all activity under your account. Attune connects you with one partner at a time; you are responsible for confirming you are pairing with the correct person. You agree to provide accurate information and to keep it up to date.
Attune lets two paired partners privately answer relationship check-ins that reveal only after both respond, exchange conversation responses, leave notes, share a list, send “thinking of you” pings, track anniversaries, and view their shared history. We may add, change, or remove features at any time.
You own your content. You retain ownership of the check-in answers, notes, list items, and other content you create (“Your Content”).
License to operate the service. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process Your Content solely to operate and provide the App to you and your paired partner. We do not use Your Content for advertising and do not sell it.
Sharing with your partner. You understand that content you create is, by design, shared with your paired partner and will be visible to them. You are responsible for what you choose to share.
Your responsibility. You represent that Your Content does not violate any law or third-party right, and that you have the right to share it.
You agree not to:
use the App for any unlawful, harmful, harassing, abusive, threatening, or defamatory purpose;
upload content that is illegal, infringing, or that violates another person’s rights or privacy;
attempt to access another user’s account or data without authorization;
reverse engineer, decompile, interfere with, overload, or disrupt the App or its infrastructure, except to the extent this restriction is prohibited by applicable law;
use the App to send spam or to collect others’ data without consent; or
misuse the App in any way not permitted by these Terms.
We may suspend or terminate accounts that violate these Terms.
Attune offers an auto-renewable subscription, Attune Premium. One subscription covers both partners.
Billing. Payment is charged to your Apple Account at confirmation of purchase. All purchases are processed by Apple under the Apple Media Services Terms; we do not process or store your payment details.
Auto-renewal. Your subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
Managing and cancelling. You can manage or cancel your subscription anytime in your Apple Account settings (Settings → your name → Subscriptions, or https://apps.apple.com/account/subscriptions). Cancellation takes effect at the end of the current paid period.
Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
Price changes. We may change subscription prices; changes apply to future renewals and, where required, Apple will seek your consent before renewing at a new price.
Refunds. Purchases are handled by Apple and are generally non-refundable except as required by law or Apple’s policies. Refund requests are managed by Apple (https://support.apple.com/HT204084).
Exact prices and durations are shown in the App before purchase.
The App, including its design, software, text, and branding (excluding Your Content), is owned by HG Mobile Apps and protected by intellectual property laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use the App for your personal, non-commercial use, subject to these Terms and the App Store Usage Rules.
The App relies on third-party services, including Apple (Sign in with Apple, App Store) and Google Firebase (authentication, storage, functions, messaging). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services.
Attune is a tool for connection and communication. It is not a substitute for professional advice. It does not provide medical, psychological, therapeutic, legal, or relationship-counseling services, and it is not a crisis or emergency service. If you or someone else is in crisis or in danger, contact your local emergency services or a qualified professional.
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
To the maximum extent permitted by law, HG Mobile Apps will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or relating to your use of the App. To the extent we are found liable, our total liability will not exceed the greater of (a) the amount you paid us for the App in the 12 months before the claim, or (b) USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law (including, for EU consumers, statutory rights).
You agree to indemnify and hold harmless HG Mobile Apps from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the App, or your violation of these Terms or any law or third-party right, except to the extent prohibited by applicable law.
You may stop using the App and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms or if necessary to protect the App or other users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
We may update these Terms from time to time. We will post the updated version with a new effective date and, where appropriate, notify you in the App. Your continued use after changes take effect constitutes acceptance.
Because the App is distributed through the Apple App Store, the following apply and prevail over any conflicting term in these Terms:
Acknowledgment. These Terms are between you and HG Mobile Apps only, not with Apple. Apple is not responsible for the App or its content.
Scope of license. The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
Maintenance and support. HG Mobile Apps is solely responsible for any maintenance and support for the App. Apple has no obligation to provide any maintenance or support.
Warranty. HG Mobile Apps is solely responsible for any product warranties, whether express or implied, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Product claims. HG Mobile Apps, not Apple, is responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar laws.
Intellectual property. In the event of a third-party claim that the App infringes intellectual property rights, HG Mobile Apps, not Apple, is responsible for the investigation, defense, settlement, and discharge of such claim.
Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you.
