This SMS Privacy Policy explains how Atlantic Care Services (“ACS,” “we,” “us”) collects, uses, and protects mobile telephone numbers and related information in connection with its automated text-message (SMS) program: the ACS Shift Verification and Electronic Visit Verification (EVV) Alert System. This policy supplements any general privacy practices ACS maintains.
In connection with the SMS program, we collect and maintain:
The mobile telephone number you provide to ACS.
Consent and opt-out records, including the date consent was given and the date of any opt-out (STOP) or opt-in (START) request.
Message and delivery information, such as message content sent, timestamps, and carrier delivery status, used to operate and audit the alert system.
We use your mobile number and related information solely to operate the Shift Verification and EVV Alert System, including to:
Send automated, operational text alerts related to your work, such as clock-in and clock-out reminders, missed-visit alerts, and shift or scheduling notifications;
Maintain records necessary for compliance with payor and Electronic Visit Verification requirements;
Record and honor opt-in and opt-out requests; and
Monitor and improve the reliability of message delivery.
These messages are operational and transactional in nature. We do not use this SMS program to send marketing or promotional messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who provide support services to ACS (for example, our SMS messaging provider) is permitted solely to operate the program.
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We may disclose information where required by law or to comply with a legal obligation.
Message frequency varies and depends on your clock-in and clock-out activity.
Message and data rates may apply, depending on your mobile carrier and plan.
You may reply STOP at any time to opt out of automated text messages to your number.
You may reply HELP at any time for support contact information.
We retain consent and opt-out records, and message delivery records, for as long as necessary to operate the program and to meet applicable compliance, audit, and recordkeeping obligations.
ACS maintains reasonable administrative, technical, and physical safeguards designed to protect the information described in this policy against unauthorized access, use, or disclosure.
