IS THE BILL IN THE INTEREST OF BENGALURU? Expert Discussion

Since 1992, the Nagarpalika Act or the Constitution 74th Amendment Act stipulates the structure for Planning and Governance of cities. A Model Municipal Law has also been shared by the Ministry of Urban Development.
States are required to follow this law. Instead, states have been legislating their own laws which are not fully in compliance with the Nagarpalika Act.
The BBMP Act 2020 itself is not fully in compliance with the Nagarpalika Act. Several PILs have challened unconstitional provisions in the act.
Now we are facing the prospect of another law, the Greater Bengaluru Governance Act, which proposes to be a super law, above the BBMP Act, again violationg various provisions in the constitution.
This is for all of us to consider.
The Planning Commission has detailed how it can be implemented by subsuming all local planning authorities, and how the MPC can be an overreaching authority to coordinate between all authorities and parastatals, including the Central govt authorities, which is key for a city like Bengaluru which has large land owners which are the central authorities.

The BBMP Act 2020 itself has been challenged by several parties in PILs in the High Court, for not conforming to the Nagarpalika Act 1992.
Now a fresh legislation that is designed to sit on top of this? Will that conform to the constitutional provisions? Or will this get buried under PILs?
THE HON HIGH COURT OF KARNATAKA LITERALLY TERMED THE RMP 2015 VOID IN A JUDGMEMENT IN 2016. WITH HEIGHTENED AWARENESS AND CITIZEN ACTIVISM, ANY SUCH ILLEGALITY WILL BE CALLED OUT SOONER, AND LITIGATION WILL RENDER ANY VIOLATIVE LAWS VOID.
FOR INSTANCE, THERE ARE MULTIPLE PILS ALREADY IN THE HIGH COURT QUESTIONING VARIOUS PROVISIONS OF THE BBMP ACT 2020. WE DONT WISH THAT THE GOVERNANCE OF THE CITY GO INTO A STALEMATE BY IRRESPONSIBLE LEGISLATIONS
