1. ข้อตกลงการใช้งาน
ข้อตกลงการใช้งานนี้ จัดทำขึ้นโดยบริษัท คลาวด์ ดิจิทัล โซลูชั่นส์ จำกัด (ซึ่งต่อไปจะเรียกว่า “บริษัท”) ซึ่งเป็นผู้พัฒนาแอพพลิเคชั่น aroii (ซึ่งต่อไปจะเรียกว่า “App”) เพื่อกำหนดเงื่อนไขในการใช้งาน ซึ่งจะมีผลบังคับกับคุณ (ซึ่งต่อไปจะเรียกว่า “ผู้ใช้”) เริ่มตั้งแต่เมื่อคุณสร้างบัญชีผู้ใช้งาน ฉะนั้น เมื่อคุณได้ใช้งาน App แสดงว่าคุณได้ยินยอมตามข้อกำหนดและเงื่อนไขเหล่านี้แล้ว โดยมีรายละเอียด ดังต่อไปนี้
1. ผู้ใช้รับรองว่าเป็นผู้มีอายุตั้งแต่ 13 ปีขึ้นไป, ไม่เป็นผู้ที่ถูกห้ามตามกฎหมายในการใช้งานแอพพลิเคชั่นเกี่ยวกับโซเชียลมีเดียและคอมเมิร์ซ, ไม่เป็นผู้ที่เคยถูกปฏิเสธหรือถูกยกเลิกบัญชีผู้ใช้จากบริษัท ผู้ใช้รับรองว่าจะไม่ใช้ App ไปในทางที่ผิดกฎหมาย, ผิดศีลธรรมอันดี, มุ่งร้ายหรือทำให้เสื่อมเสียชื่อเสียงต่อผู้หนึ่งผู้ใด, ก่อให้เกิดกระแสในทางลบต่อสังคม, เป็นต้น
หากผู้ใช้ละเมิดต่อข้อตกลงข้างต้น ผู้ใช้ยินยอมให้บริษัททำการระงับชั่วคราวหรือยกเลิกบัญชีของผู้ใช้ได้ในทันทีโดยไม่ต้องแจ้งให้ทราบล่วงหน้า
2. ผู้ใช้รับรองว่าเนื้อหาหรือคอนเท้นท์ต่างๆ อันได้แก่ โพสต์รูปหรือคลิปวิดีโอ, เขียนคอมเม้นท์หรือรีวิว ที่ผู้ใช้ป้อนข้อมูลใน App เป็นของผู้ใช้เอง มิได้ทำการคัดลอกจากผู้อื่นหรือนำมาปรับแต่งใดๆโดยมิได้รับความยินยอมมาก่อนอันเป็นการขัดต่อกฎหมายลิขสิทธิ์และ/หรือละเมิดเครื่องหมายทางการค้า ในกรณีที่ผู้ใช้ไม่ใช่เจ้าของลิขสิทธ์ฯ ผู้ใช้รับรองว่าได้ทำตามเงื่อนไขในการให้อนุญาตตามหลักการสากลของครีเอทีฟคอมมอนส์ (Creative Commons: CC) อย่างถูกต้องแล้ว ในกรณีที่บริษัทพิจารณาแล้วเห็นว่ามีความเป็นไปได้ที่จะเกิดประเด็นในเรื่องการละเมิดลิขสิทธิ์หรือการละเมิดต่อกฎหมายเกิดขึ้น บริษัทสงวนสิทธิ์แต่เพียงผู้เดียวในการพิจารณาและดำเนินการในทันที เพื่อทำการระงับยับยั้งเนื้อหาของผู้ใช้เหล่านั้นมิให้เผยแพร่ต่อไป รวมถึง บริษัทอาจทำการระงับบัญชีผู้ใช้แบบชั่วคราวหรือถาวร (ทั้งในกรณีที่บริษัทได้รับการร้องขอหรือมิได้รับการร้องขอก็ตาม) ทั้งนี้ ให้ถือว่าผู้ใช้ได้ยินยอมและตกลงให้บริษัทดำเนินการในประการนี้ได้โดยไม่ต้องแจ้งให้ผู้ใช้ทราบล่วงหน้าแต่อย่างใด
ทั้งนี้ โดยที่บริษัทไม่ได้มีส่วนเกี่ยวข้องหรือรับรู้กับการได้มาซึ่งเนื้อหาจากผู้ใช้แต่อย่างใดทั้งสิ้น ในกรณีที่บริษัทมิได้ทำการระงับยับยั้งเนื้อหาของผู้ใช้โดยบริษัทปล่อยให้มีการเผยแพร่ต่อไป ไม่ว่ากรณีใดๆก็ตาม และต่อมามีการฟ้องร้องจากเจ้าของลิขสิทธิ์เกิดขึ้น ผู้ใช้ยินยอมตกลงว่าผู้ใช้จะไม่ถือเอาเป็นเหตุที่ผู้ใช้จะปฏิเสธความรับผิดต่อเจ้าของลิขสิทธิ์อันเนื่องมาจากการไม่ทำการระงับยับยั้งเนื้อหาเหล่านั้นของผู้ใช้
3. ผู้ใช้รับรองว่าจะไม่ละเมิดกฎการตั้งชื่อบัญชี (username), โพสท์รูปภาพหรือคลิปวิดีโอหรือพิมพ์ข้อความที่เป็นเนื้อหาไม่เหมาะสมหรือขัดต่อกฎหมายหรือขัดต่อศีลธรรมอันดี ในกรณีที่บริษัทพิจารณาแล้วเห็นว่ามีความเป็นไปได้ที่จะเกิดประเด็นปัญหาเกิดขึ้น บริษัทสงวนสิทธิ์แต่เพียงผู้เดียวในการพิจารณาและดำเนินการในทันที เพื่อทำการระงับยับยั้งเนื้อหาของผู้ใช้เหล่านั้นมิให้ถูกเผยแพร่ต่อไป รวมถึง บริษัทอาจทำการระงับบัญชีผู้ใช้แบบชั่วคราวหรือถาวร (ทั้งในกรณีที่บริษัทได้รับการร้องขอหรือมิได้รับการร้องขอก็ตาม) ทั้งนี้ ให้ถือว่าผู้ใช้ได้ยินยอมและตกลงให้บริษัทดำเนินการในประการนี้ได้โดยไม่ต้องแจ้งให้ผู้ใช้ทราบล่วงหน้าแต่อย่างใด
4. การให้บริการใน App นี้ไม่ได้มีวัตถุประสงค์ในการให้บริการรับฝากเนื้อหาของผู้ใช้แต่อย่างใด (No Storage Service) โดยบริษัทจะเช่าใช้บริการ hosting กับบุคคลอื่นที่บริษัทเห็นว่าเหมาะสมเพื่อให้มีคุณภาพบริการที่ดี อย่างไรก็ตาม อาจเกิดกรณีที่ระบบเกิดเหตุขัดข้องใดที่อาจมีผลทำให้การบริการสะดุดหยุดลง หรืออาจมีผลทำให้ข้อมูลหรือเนื้อหาบางส่วนหรือทั้งหมดของผู้ใช้งานรายใดๆ เกิดความเสียหายหรือข้อมูลสูญหายไปได้ บริษัทจึงไม่สามารถรับประกันในการเก็บข้อมูลเนื้อหาของผู้ใช้งานได้ ผู้ใช้รับทราบว่าหากผู้ใช้ต้องการเก็บรักษาเนื้อหาใดๆ ที่เป็นข้อมูลสำคัญผู้ใช้จะต้องไปเช่าใช้บริการ Storage Service จากผู้ให้บริการรับฝากข้อมูลรายอื่น ดังนั้น ผู้ใช้ยินยอมตกลงว่าจะไม่เรียกร้องค่าเสียหายใดๆจากบริษัท ไม่ว่ากรณีใดๆก็ตาม
นอกจากนี้ ในกรณีที่มีจำนวนผู้ใช้งานเพิ่มขึ้นอย่างรวดเร็ว และบริษัทไม่สามารถขยายระบบรองรับได้ทัน หรือบริษัทอาจมีข้อจำกัดในเรื่องงบประมาณการลงทุน อันเป็นผลทำให้ขนาดความจุของหน่วยความจำของระบบไม่สามารถรองรับการใช้งานได้อย่างปกติ บริษัทอาจต้องพิจารณาดำเนินการต่างๆที่จำเป็นโดยไม่ต้องแจ้งให้ผู้ใช้ทราบล่วงหน้า เช่น ทำการลบเนื้อหาของโพสต์ต่างๆ ของผู้ใช้ ที่มีอายุเกินกว่าระยะเวลา 4 เดือนขึ้นไป เพื่อให้มีพื้นที่ความจุของหน่วยความจำเพียงพอสำหรับการเก็บข้อมูลเนื้อหาของผู้ใช้ที่เป็นปัจจุบัน, เป็นต้น
5. ในการดำเนินการในกรณีเกิดเหตุการณ์ต่างๆ ได้แก่ กรณีที่มีปัญหาข้อโต้แย้ง, การละเมิดเครื่องหมายทางการค้า, การละเมิดกฎความเป็นส่วนตัว, การกระทำที่อาจหมิ่นเหม่กับการทำผิดกฎหมาย, การกระทำที่ไม่เหมาะสมต่างๆ เป็นต้น บริษัทขอสงวนสิทธิ์ในการพิจารณาโดยลำพังแต่เพียงผู้เดียว โดยไม่ต้องแจ้งให้ผู้ใช้ทราบล่วงหน้า ในการดำเนินการต่างๆ ดังต่อไปนี้
5.1 ทำการระงับการแสดง หรือลบเนื้อหาที่มีปัญหา
5.2 ทำการเปลี่ยนแปลงชื่อผู้ใช้ (username) ที่ไม่เป็นไปตามกฎของการตั้งชื่อ เช่น ใช้ชื่อแบรนด์
5.3 ทำการระงับการใช้งานชั่วคราวหรือถาวรของบัญชีผู้ใช้ที่มีปัญหา
6. บริษัทสงวนสิทธิ์ที่จะประกาศหยุดการให้บริการเป็นบางส่วนหรือทั้งหมดในอนาคต หากเกิดกรณีที่บริษัทไม่สามารถดำเนินการต่อไปได้อันเนื่องจากเหตุผลทางธุรกิจหรือเหตุผลอื่นใดๆ โดยจะทำการแจ้งประกาศให้ผู้ใช้ทราบล่วงหน้าผ่านทางเว็บของบริษัท ทั้งนี้ บริษัทสงวนสิทธิ์ที่จะไม่ชดใช้ค่าเสียหายใดๆ ทั้งสิ้นแก่ผู้ใช้ทุกคน
7. ในกรณีที่มีการเปลี่ยนแปลงจากสภาพแวดล้อมที่เป็นสาระสำคัญ เช่น จากเทคโนโลยี, สภาพแวดล้อมทางเศรษฐกิจและสังคม, กฎหมาย เป็นต้น หรือจากความจำเป็นอื่นๆ ของบริษัท บริษัทสงวนสิทธิ์ที่จะทำการแก้ไข ปรับปรุง หรือเปลี่ยนแปลงข้อตกลงการใช้งานนี้ตามความเหมาะสม โดยมิต้องแจ้งให้ผู้ใช้ทราบล่วงหน้า ซึ่งผู้ใช้มีสิทธิที่จะยกเลิกบัญชีผู้ใช้ได้ทุกเมื่อ
กฎการตั้งชื่อบัญชี (username)
1. ห้ามมิให้ผู้ใช้ตั้งชื่อบัญชีผู้ใช้งาน ที่ตรงกับคำหยาบ, ชื่อทางการค้าของแบรนด์/ชื่อเฉพาะที่มีลิขสิทธิ์ เป็นต้น หรือตั้งชื่อที่มีวัตถุประสงค์เพื่อล้อเลียน, เลียนแบบ ซึ่งอาจทำให้เกิดความเข้าใจผิดหรือเกิดความเสียหายต่อผู้อื่น
2. กรณีที่บริษัทพิจารณาแล้วเห็นว่าผู้ใช้ได้ละเมิดกฎการตั้งชื่อนี้ บริษัทอาจระงับบัญชีของผู้ใช้ได้โดยไม่ต้องแจ้งให้ทราบล่วงหน้า
2. นโยบายข้อมูลและความเป็นส่วนตัว
เราให้ความสำคัญกับเรื่องสิทธิความเป็นส่วนตัวของผู้ใช้งานทุกท่าน นโยบายนี้ครอบคลุมเกี่ยวกับเนื้อหาที่โพสท์โดยผู้ใช้ด้วย ดังต่อไปนี้
1. การโพสท์คอมเม้นท์ที่ไม่เหมาะสมในเนื้อหาของผู้อื่น เช่น รูป, รีวิว ซึ่งเจ้าของเนื้อหาดังกล่าว หากเห็นว่าไม่เหมาะสมก็สามารถแจ้งแอดมินเพื่อเตือนไปยังผู้โพสท์คอมเม้นท์เหล่านั้นได้ และหากผู้โพสท์คอมเม้นท์เหล่านั้นยังไม่ปฏิบัติตามคำเตือนแอดมินอาจใช้สิทธ์ในการระงับแอคเค้าท์ของผู้ใช้เหล่านั้นต่อไป กรณีนี้อาจรวมไปถึงการโพสท์ข้อความที่มีลักษณะเป็นการฝากโฆษณาอันเป็นการรบกวนผู้อื่นด้วย
2. การทำเมนชั่นเพจของผู้อื่น โดยใช้รูป หรือ รีวิว ที่เจ้าของเพจเห็นว่าไม่เหมาะสม หรือที่มีลักษณะเป็นการโฆษณาแอบแฝง
3. บริษัทจะทำการเก็บรวบรวมข้อมูลของผู้ใช้ และอาจใช้เครื่องมือวิเคราะห์ข้อมูลที่จำเป็น เพื่อจุดประสงค์ในการสำรวจพฤติกรรมผู้บริโภคในพื้นที่ต่างๆ เพื่ออำนวยความสะดวกและปรับปรุงการใช้งานให้เกิดประโยชน์ต่อผู้ใช้ให้มากที่สุด รวมทั้งเพื่อให้ร้านค้าได้รับข้อมูลที่จำเป็นในการพัฒนาและปรับปรุงบริการให้ดียิ่งขึ้น บริษัทมีความมุ่งมั่นที่จะพัฒนาระบบการบริหารและจัดการข้อมูล (Big Data) เพื่อพัฒนาคุณภาพบริการอย่างต่อเนื่อง ทั้งนี้ บริษัทยังคงให้ความสำคัญต่อความเป็นส่วนตัวของข้อมูลผู้ใช้เป็นรายบุคคลอยู่ต่อไป
1. Term of Use
This term of use is prepared by Cloud Digital Solutions Co., Ltd. (later is called “we”) who is the owner of this application “aroii” (later is called “App”) in order to define the term and conditions of this App. When you have signed up, it is required that you agree to this term and conditions. Thus, once you have used this App, it means you have accepted and agreed upon the followings :
1. You certify that your age is over 13 years old. You are not prohibited by law to use applications which are relevant to social media and commerce. You have never been refused or terminated account by us. You agree not to use this App for unlawful or immoral purpose, make harmful or bad reputation to others, create negative social impact, etc.
You agree that if you have violated the above, we could take immediate action to suspend or terminate your account without prior inform to you in advance.
2. You certify that all contents in the form of photo or video posts, write comments, write reviews, etc. is belongs to user’s own right. You also certify that you have not made copying or modifying of contents owned by others without prior consent or authorized to be used that violates the copy right law or trademark law. In case that you are not the owner of such content, you have correctly follow the international practice on contents (Creative Commons : CC).
In the case we found there is possibility of a problem of copyright or trademark violation from any user, we reserve the sole right to take immediate actions ie. suspend or inhibit the broadcasting of such content, etc. without prior notice. The actions may include suspend or terminate the problem user’s account (whether or not there are requests to us). You agree to authorize us to do so without any prior notice. However, in the case that we has not took any actions on your problem contents, for any reasons, you agree that you cannot claim such case of our no-action to be reason to refuse the obligation on your copy right violation.
3. You certify that you will not violate our "Rule of Account Naming", post or write any contents that may violate Thai Law or any non-appropriate contents that construe to a bad personal habits. In the case we found there is possibility of a problem, we reserve the sole right to take immediate actions ie. to suspend or inhibit the broadcasting of such content, etc. without prior notice. The actions may include suspend or terminate the problem user’s account (whether or not there are requests to us). You agree to authorize us to do so without any prior notice.
4. The service of this App is not for content depositing (No Storage Service). We will rent hosting from a professional hosting service provider. However, there might be incidents that may cause few interruptions of service, or data lost which may include the lost of user’s data and contents. Such reasons, we cannot guarantee to you that your contents will not suffer any data lost. We hereby also declare that for those of you who demand a high reliable of storage to keep your crucial contents, you have to rent your own storage service from other providers. You agree that you cannot claim any charges from us on data lost.
In addition, in the circumstance of tremendous user growth and we could not expand the storage in time or in the situation where we have a budget problem, which has resulted in the insufficient of storage space. Thus, we reserve the right, without prior notice to users, to take necessary actions ie. to selectively purge those user’s contents which are older than 4 months in order to reserve the storage space for newly post contents, etc.
5. In order to cope with various circumstances ie. disputes between users, doubt of copyright, violate privacy rules, unlawful contents, inappropriate user behaviors, etc. We will need to take actions in time, therefore, we reserve the sole right, without prior notice, to take actions against user as followings :
5.1 Suspend or delete the particular user’s contents.
5.2 Change username or suspend user account that is in doubt of violating our naming rules (ie. use of commercial brand names).
5.3 Temporary or permanently suspend the account of problem users.
6. We reserve the rights to announce the close of some services or all services of the App in future in the case that we could not provide the service further due to business or other reasons by announcing via our web in advance. And we reserve the rights not to compensate any damages or claims from all users in any cases.
7. To cope with changes in the environment which is essence ie. technology, social and economics, laws, etc. or necessary reasons from company, we reserve the rights to amend or update this Term of Use wherever necessary without prior inform to you in advance. However, you have the right to terminate your user account at any time.
Rule of Username :
1. You're not allowed to create username that is brutal/rough or name that may violate to others' trademarks. The username that has objective to imitate or lead to bad reputation of others. .
2. We reserve the right to suspend the account which may violate the above rule without advanced notice to you.
2. Privacy and Data Policy
We recognize the ‘Privacy’ right of all users. This policy covers the content posted by all users which includes as below :
1. Comments on the posted contents of others ie. Photo, Review, etc. If the owner of the content consider as not appropriate comments, he/she could inform the admin to give warning notice. And if such behaviors continue, the admin may rectify its right to suspend the user account. This case also includes those comments relating to advertising.
2. Posting mentions on Pages of other users which is considered to be not appropriate or advertising-type by the owner of page.
3. We will collect user’s data and may use necessary data analysis tools for the purpose of consumer behavior survey in order to improve our services and make it more convenient and bring benefits to user. We also will analyze data for merchant to help them get necessary information in order to improve their service. We’ll continuously develop a good data science and management system tool (Big Data) that help improve our service to user. Meanwhile, we will give high attention to privacy data of each individual user.
