The following policy governs how Ardino Games(“Ardino Games“, “we” or “us“), and its subsidiaries, handle information collected from users.

Capitalised terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Use available on the Site, which this Privacy Policy is incorporated thereto by reference.

Please note that this privacy policy covers our privacy practices only with respect to the Site.

The Site is accessible for individuals around the world. Accordingly, throughout the document, we try to harmonise our approach and the language of the privacy policy as much as possible. However, sometimes we refer to specific laws that require further disclosures. These disclosures cover laws and regulations applicable to the following regions:

  • Individuals who we deem to be located in the European Economic Area, United Kingdom, or Switzerland – With respect to the collection and processing of their personal data, as defined by the General Data Protection Regulation (“GDPR”), and the UK Data Protection Act.

Why does Ardino Games collect data from its apps and games?

When you install and use Ardino Games mobile applications, we can collect and process some of your data for different legitimate purposes.

You will find below explanations regarding the reasons why Ardino Games may collect data and the legal bases Ardino Games relies on in each case.

Ardino Games collects data:

  • To provide you with the services you asked for (e.g., knowing that you completed the first level to allow access to the second one)

  • Legal basis – such data processing is strictly necessary for the service(s) asked

  • To run analytics and understand how users interact with our product and services in order to continuously improve it either directly or through third party partners (e.g. identifying that a feature is annoying for users or that a level is too difficult for most gamers)

  • consent may be required by applicable laws and regulations, Ardino Games only shares personal data collected through Ardino Games apps with third party partners that provide Ardino Games with analytics services once you express your consent through the pop-up notice included in our apps.

  • Legal basis for first party analytics – Legitimate interest. Ardino Games collects user data for the purpose of its own internal analytics tools. Data is used for the sole purpose of Ardino Games analytics tool and is not shared with any third parties. This data processing is based on the legitimate interest of Ardino Games.

  • To serve advertising tailored to the preference and interests of our users and allow Ardino Games to continue to provide free services and products

  • Legal basis – Express consent. In the countries where collecting users’ consent may be required by applicable laws and regulations, Ardino Games only processes or shares personal data collected through Ardino Games apps/games for personalised advertising purposes once you express your consent through the pop-up notice included in one of our apps.

For all data processing activities that rely on users’ consent, you can withdraw your consent at any time from the “settings” page in our various applications.

Please only note that in the case where you withdraw your consent or where you refuse to consent in the first place, you will still be served with advertising but that may be less relevant to you as it will not be tailored to your interests.

What data does Ardino Games collect from its apps and games?

For all the purposes listed above the data that Ardino Games collect is limited to:

  • The apps you are using

    • Your IP address

    • Your Mobile Advertising ID (Apple IDFA or Google AAID - which are technical identifiers developed by mobile operating systems for advertising purposes which remain under your control and can be reset or erased at any time in through your device settings) and device identifier (e.g., IDFV for iOS devices and Android ID for Android devices)

    • Information about the device you use and your connection (user agent, type of connection, timestamp, system language, device model, screen resolution and settings, battery level, available storage space, time zone, OS)

    • Data pertaining to your activities on our applications and notably the way in which you interact with our applications (for instance, how and when you use our applications) and with the advertising served in our applications (for instance, number of ads served, potential clicks)

With who may your data be shared & why?

Ardino Games does not share your personal data with third parties without your prior consent in the countries where collecting users’ consent may be required by applicable laws and regulations.

When you consent to the collection of data for advertising and analytics purpose, we may share the data listed above with the following categories of recipients:

Analytics Services:

Your personal data may be transferred to our service providers and business partners for the purpose of conducting analytical reviews, analyses, reporting and research activities regarding the use of our Services.

SECURITY AND OTHER IMPORTANT INFORMATION

How long does Ardino Games keep your data?

Personal data collected, received and processed for the purposes described in this policy is not kept longer than necessary by Ardino Games.

Ardino Games does not retain user level data for more than 13 months except for the data collected for the purpose of its first-party analytics tool which can be stored up to 25 months based on the guidelines of our Supervisory Data Protection Authority.

Children data

Ardino Games never knowingly or willingly collect any personal data concerning children under 16 years of age.

International transfers

Some of the partners and processors referred to in this policy are located outside of the European Union.

In such case, we ensure that:

  • the personal data is transferred to countries recognised as offering an equivalent level of protection or,

  • For personal data transferred outside of countries recognised by the European Commission as having a sufficient level of protection, any of the mechanisms offering appropriate guarantees is used, for which provision is made by applicable regulations, and notably the adoption of the standard contractual clauses of the European Commission.

  • Information to Individuals Located in the European Economic Area, Switzerland, and the United Kingdom

  • International Transfers – We store personal data on our google servers in the United States, and on the servers of our processors, which may be located outside of the European Union, or the United Kingdom. We will transfer personal data countries which are recognised as providing an adequate level of legal protection or where we can be satisfied that alternative arrangement are in place to protect your privacy rights.

  • Your Rights – Data subjects have the right to request us to access, rectify or erase personal data that we process, or to restrict or object to its processing in accordance with the provisions of the GDPR. A data subject can submit a request for exercising these rights by sending us an email to ardinogames@gmail.com. Please note that we will process the request subject to verification of the consumer’s identity.

  • State Privacy Rights:

    • California and Virginia residents have certain rights under state privacy laws with respect to personal data we collect. If you are a resident of such states, this section of the privacy policy contains disclosures required by law and explains rights that may be available to you.

    • Our Purposes for Processing Personal Data – We use and disclose the personal data we collect for our commercial and business purposes, as further described above in the “Information We Collect” and the “Sharing Information With Third Parties” Sections.

    • Recipients of Personal Data – Although we do not sell personal data for monetary consideration, including sharing for targeted advertising purposes, subject to the choices you make on the Site, to the categories of third parties listed below:

      • Advertising Companies

      • Analytics Providers

    • Your Rights Regarding Personal Data – Residents of certain states have rights with respect to the personal data collected by businesses like Arahamsoft. You may be able to exercise the following rights regarding your personal data, subject to certain exceptions and limitations:

      • The right to confirm whether we are processing personal data about you.

      • The right to correct inaccuracies in the personal data we have collected about you.

      • The right to request that we delete the personal data we have collected or maintain about you.

      • The right to opt out of our processing (including sharing) for targeted advertising purposes. Please note that if you opt out of certain practices, we may be unable to provide you with some services.

      • The right not to receive discriminatory treatment for the exercise of the above privacy rights.

  • While some states provide residents with rights related to “sensitive” personal data, Ardino Games does not collect this type of personal data.

    In order to exercise the right to opt out of our sale or sharing of your personal data, including for targeted advertising purposes, use the cookie settings provided in the Site.
    Depending on your state, if you have submitted a request that we have not fulfilled, you may contact us to appeal our decision by sending an email with the subject line “Appeal” to     ardinogames@gmail.com.
    You may also designate an authorised agent to make a request on your behalf by verifying your identity and providing the agent with a written permission to make the request on your behalf.
    Verification Process and Required Information

    • * Note that we may need to request additional information from you to verify your identity or process your request. You will not be required to create an account with us to submit a request or have it fulfilled. We may require you to provide, at a minimum, your email address. We will also ask you to provide us a few of your device identifiers, so that we can verify your identity. Once we verify your identity, we will request additional information necessary to authenticate the request.

WHAT RIGHTS DO YOU HAVE?

Consent withdrawal and opt-out of sale of information

You can change your consent status at any time from the Privacy Settings available in Ardino Games mobile games and applications.

Please note that if Ardino Games does not sell the personal information of its users , we may share it with third parties such as analytics and advertising companies in order to improve and personalise your experience and adapt the content and ads of our services.

Adjusting your consent settings within Ardino Games apps and games, will allow you to block the collection of data for these purposes and will de facto prevent the sharing of information with our analytics and/or advertising partners.

Access right

Upon request, Ardino Games will provide you with information about whether we hold any of your personal information. You may access or request deletion of your personal information directly in Ardino Games mobile apps/games or by contacting Ardino Games Data Protection Officer as indicated in the “Contact” section below. We will respond to your request within a reasonable timeframe.

Rectification and erasure You may request Ardino Games the rectification of inaccurate personal data concerning you, as well as the completion of incomplete personal data. You may also request Ardino Games to erase without undue delay your personal data when it is no longer necessary for Ardino Games to retain such data.

In order for your data to be erased or rendered inaccessible you can either:

  • reset your mobile advertising identifier (IDFA on iOS, GAAID on Android) or activate “Limit Ad Tracking” in your device’ settings in order to make previously collected data non linkable to you or your device anymore and limit further data collection if you choose to enable the “Limit Ad Tracking” option

  • contact Ardino Games Data Protection Officer, as indicated in the “Contact” section below in order to have the data previously collected by Ardino Games on you and/or your device permanently erased or anonymised

Portability

Upon request, Ardino Games will provide you with the personal data that you provided to us and, if possible, will communicate this information directly to another data controller of your choice in a portable format when the processing is based on consent or contract.

Changes To The Privacy Policy

We may revise this privacy policy from time to time. The most current version of the policy will govern our processing of information and is posted at privacypolicy. If we make a change to this policy, we will post the revised privacy policy to this page.
