About these Terms
These Terms of Use ("Terms") govern the Archio AI service provided by Kalestial Teknoloji Limited Şirketi ("we", "us"), Türkiye.

By using Archio AI, you agree to these Terms. If you do not agree, do not use the service.
You must be at least 13 years old and meet any higher minimum age that applies where you live. If you are not legally able to enter into this agreement independently, a parent or legal guardian must authorize your use.
Mandatory consumer rights that apply to you are not limited or excluded by these Terms.
The Archio AI application software is licensed under [Apple's Standard End User License Agreement](https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). These Terms govern the Archio AI service and do not replace Apple's software license or purchase terms.
AI design service
Archio AI creates and edits visual design concepts based on photos, masks, descriptions and design choices you provide.
Features may include interior, exterior and garden redesign, furnishing visualizations, paint or surface edits, object replacement and other AI-assisted design tools.
You are responsible for having the rights and permissions necessary to upload and process the content you submit, including permission from other people where required.
AI-generated output may contain:
- inaccuracies;
- impossible or impractical layouts;
- unexpected visual changes;
- incorrect dimensions or proportions;
- objects or materials that do not exist; or
- visual artifacts.
Archio AI is intended for inspiration and visualization. It does not provide architectural, structural, electrical, engineering, construction, safety or other professional advice.
Before spending money, purchasing products, modifying property or carrying out construction or renovation work, you should verify dimensions, materials, feasibility, safety, permits and other relevant requirements with appropriately qualified professionals.
We do not guarantee a particular aesthetic result, that every element of an uploaded image will remain unchanged, or that any product, material or design depicted in an AI-generated image exists or is commercially available.
Your content
You retain any rights you hold in content you upload.
You grant us and the service providers involved a limited permission to process your content only as reasonably necessary to:
- provide the service you request;
- secure and operate the service;
- provide support;
- comply with law; and
- perform the activities described in our Privacy Policy.
This permission does not give us the right to use your private photos in advertising.
Generated designs and permitted use
Subject to applicable law and third-party rights, you may use designs generated by Archio AI for personal or commercial purposes.
We do not guarantee that generated output is:
- unique;
- copyrightable;
- registrable;
- non-infringing; or
- free of third-party rights.
Other users or AI systems may generate similar output.
You are responsible for reviewing generated content before publishing, selling, advertising or otherwise using it commercially.
Acceptable use
You must not use Archio AI to:
- submit or create illegal or infringing material;
- violate another person's privacy or rights;
- bypass access controls or security measures;
- misuse another person's purchase or subscription;
- resell, automate or commercially expose access to the service without permission;
- interfere with the security, operation or availability of the service;
- attempt to obtain unauthorized access to systems, credentials or infrastructure; or
- use the service in a fraudulent, abusive or unlawful manner.
We may apply proportionate technical safeguards or restrict access where reasonably necessary to address misuse, fraud, security risks or legal requirements.
PRO subscriptions
PRO subscriptions provide the features described on the purchase screen at the time of purchase.
The purchase screen and Apple's confirmation display the applicable:
- price;
- currency;
- billing period; and
- free-trial offer, if any.
Weekly and yearly subscriptions automatically renew unless canceled.
Apple charges your Apple account according to Apple's applicable purchase terms.
Free trials
A free trial applies only when:
1. a free-trial option is shown as available on the purchase screen;
2. you choose to activate that trial option; and
3. Apple determines that your account is eligible.
If you begin a free trial, it automatically converts to the displayed paid subscription when the trial ends unless you cancel in time.
To avoid renewal charges, cancel at least 24 hours before the current trial or subscription period ends.
You can manage or cancel your subscription through [your Apple account's subscription settings](https://apps.apple.com/account/subscriptions).
Deleting Archio AI does not cancel a subscription.
Restore Purchases and refunds
Use Restore Purchases with the Apple account that originally made the purchase to restore eligible subscription access.
Refund requests for Apple purchases are handled through [Apple's refund process](https://reportaproblem.apple.com/), subject to mandatory consumer rights.
Subscription prices may change in accordance with Apple's notification, consent and billing processes and applicable law.
Availability and service safeguards
Archio AI requires an internet connection for AI generation and depends on third-party services.
Outages, maintenance, model availability, network conditions or other technical factors may temporarily affect the service.
We may use reasonable safeguards against simultaneous, duplicate, automated, fraudulent or abusive generation requests.
These safeguards are intended to protect the service and do not change the paid benefits represented on the applicable purchase screen.
Beta or TestFlight versions may contain bugs, temporary safeguards or temporary testing limits and may differ from the public release.
Privacy
Our processing of personal information is described in the [Archio AI Privacy Policy](privacy-policy.md).
AI generation requires the images and instructions you submit to be processed by the service providers described in that policy. These Terms do not replace any separate permission required for that processing.
Responsibility
We will provide the service with the care required by applicable law, but we cannot guarantee:
- uninterrupted operation;
- permanent availability of any particular AI model or feature;
- error-free AI output; or
- that generated concepts can be implemented safely or practically.
Nothing in these Terms excludes or limits liability, remedies or consumer protections that cannot lawfully be excluded or limited.
To the extent permitted by law, we are not responsible for losses resulting from a decision to build, purchase, renovate or otherwise act solely on an unverified AI-generated concept.
Suspension and ending use
You may stop using Archio AI at any time.
You must separately cancel an active subscription if you want to prevent future renewal.
We may suspend or restrict access for material misuse, fraud, security threats, violation of these Terms or legal requirements. Where appropriate and legally required, we will provide notice.
Suspension or termination does not remove any refund or other remedy you may have under mandatory law.
Changes to the service or Terms
We may update Archio AI or these Terms when the service, our business or applicable law changes.
Where required, we will provide notice of material changes.
We will not retroactively remove mandatory consumer rights.
Governing law and disputes
These Terms are governed by the laws of Türkiye, except where the mandatory consumer-protection laws of your country require otherwise.
Nothing in these Terms deprives you of mandatory consumer protections, rights, courts or dispute-resolution forums available under the laws of your country of residence.
