These Terms of Service ("Terms") govern your access to and use of the mobile application Aura Beauty: AI camera for Selfie, Filter (the "Application"), provided by APT Vietnam ("we," "our," or "us").
By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not install or use the Application.
The Application is a photo editing and processing utility that provides users with artificial intelligence (AI) effects, beauty filters, image transformation, and camera features ("Services").
By using the Application, you represent and warrant that:
You are at least 13 years of age (or the minimum age required in your jurisdiction to consent to service usage without parental consent).
If you are between the ages of 13 and the legal age of majority in your jurisdiction, you have reviewed these Terms with your parent or legal guardian and they agree to these Terms on your behalf.
You retain all ownership rights, intellectual property rights, and title to the photos, images, and other media you upload, capture, or process through the Application ("User Content"). We do not claim ownership over any of your User Content.
By uploading or processing User Content through the Application, you grant us a worldwide, non-exclusive, royalty-free, limited, and temporary license to access, store, process, and use your User Content solely for the purpose of operating, rendering, and delivering the requested photo-editing and AI-processing Services to you.
You are solely responsible for the User Content you upload or process. You represent and warrant that:
You own or have obtained all necessary rights, permissions, and licenses to use and process the User Content.
The User Content does not infringe, misappropriate, or violate any third party’s intellectual property rights, privacy rights, publicity rights, or any applicable law.
You agree not to use the Application to perform any of the following prohibited activities:
Illegal or Unauthorized Use: Upload, create, or share content that is unlawful, defamatory, libelous, fraudulent, obscene, sexually explicit, hateful, or threatening.
Deepfakes and Non-Consensual Imagery: Generate, process, or distribute misleading, harmful, or non-consensual media depicting real persons, public figures, or minors without explicit authorization.
Infringing Content: Process images that violate trademark, copyright, or proprietary rights of third parties.
Reverse Engineering: Reverse-engineer, decompile, disassemble, or attempt to extract the source code or underlying AI models of the Application.
System Abuse: Interfere with, disrupt, or attempt to compromise the integrity, security, or availability of the Application's infrastructure or API connections.
Automated Access: Use scrapers, bots, or automated means to access or harvest data from the Application without prior written consent.
We reserve the right to suspend or terminate your access to the Application immediately if you violate any of these restrictions.
The Application may offer premium features, filters, or ad-free experiences accessible via paid subscriptions or one-time in-app purchases ("In-App Purchases"). All purchases are processed securely through the Google Play Store or applicable app store platforms.
Subscriptions auto-renew automatically unless auto-renew is turned off at least 24 hours before the end of the current billing period. Account charges for renewal will occur within 24 hours prior to the end of the current period.
You may manage or cancel your subscriptions at any time through your Google Play Account Settings. Refunds are handled in accordance with Google Play Store’s refund policies. We do not provide direct refunds for partial subscription periods.
The Application, including its design, source code, user interface, graphics, algorithms, trademarks, and original content (excluding User Content), is and remains the exclusive property of [Insert App Name/Company Name] and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes in accordance with these Terms.
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, OR THAT ANY DEFECTS WILL BE CORRECTED. RESULTS GENERATED BY AI FEATURES ARE FOR ENTERTAINMENT AND GENERAL UTILITY PURPOSES ONLY, AND WE DO NOT GUARANTEE SPECIFIC OUTCOMES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Aura Beauty: AI camera for Selfie, Filter, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APPLICATION;
ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR USER CONTENT;
ANY BUGS, VIRUSES, OR TECHNICAL FAILURES TRANSMITTED THROUGH THE APPLICATION.
You agree to defend, indemnify, and hold harmless Aura Beauty: AI camera for Selfie, Filter and its subsidiaries, affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your violation of these Terms or your use/misuse of the Application.
We reserve the right to modify, update, or replace these Terms or alter features of the Application at any time. Material changes will be communicated by updating the "Effective Date" of these Terms. Your continued use of the Application after any modifications constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws, without regard to its conflict of law principles.
