These Terms of Service ("Terms") govern your use of the Smart Calorie Tracker mobile application (the "App"), operated by Byte Craft Enterprises ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Health and Medical Disclaimer (Important)

Smart Calorie Tracker is not a medical device, and we do not provide medical advice. The App is designed for general fitness, wellness, and informational purposes only. The nutritional calculations, macro estimates, climate-adjusted metabolism tracking, and AI insights provided by the App are not intended to diagnose, treat, cure, or prevent any medical condition or eating disorder.

Always consult with a qualified healthcare professional or registered dietitian before beginning any new diet, fitness program, or weight-loss plan. You assume full responsibility for any decisions you make based on the information provided by the App.

2. Artificial Intelligence and Accuracy Disclaimer

Smart Calorie Tracker utilizes advanced Artificial Intelligence to analyze images of food and estimate nutritional content.

• Estimates Only: You acknowledge that AI-generated nutritional macros, calories, and food identification are estimates based on standard portion sizes and visual data.

• No Guarantee of Accuracy: We do not guarantee the 100% accuracy, completeness, or reliability of any scan. The AI may misidentify ingredients or fail to detect hidden allergens (such as oils, nuts, or dairy). You should not rely on the App to manage severe food allergies or strict medical dietary requirements.

3. Subscriptions, Free Trials, and Payments

Certain features of Smart Calorie Tracker (such as unlimited AI food scanning) are available through an auto-renewing premium subscription.

• Billing: Payment will be charged to your Apple ID account at the confirmation of purchase.

• Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

• Auto-Renewal: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

• Cancellations and Refunds: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings on the App Store after purchase. Because payments are handled entirely by Apple, we do not have the ability to process direct refunds. All refund requests must be routed through Apple Support according to their standard policies.

4. User Responsibilities

By using the App, you agree that you will not:

• Use the App for any illegal or unauthorized purpose.

• Attempt to reverse-engineer, decompile, or hack the App's source code or AI integrations.

• Submit offensive, explicit, or illegal images to the AI scanner. We reserve the right to terminate access for users who abuse the scanning feature.

5. Intellectual Property

All content, design, graphics, code, and UI elements within the App are the intellectual property of Byte Craft Enterprises. You may not copy, reproduce, or distribute any part of the App without our explicit written permission.

6. Apple App Store Specific Terms

You acknowledge and agree that these Terms are solely between you and Byte Craft Enterprises, not Apple, and that Apple has no responsibility for the App or content thereof. Apple is not responsible for providing any maintenance or support services with respect to the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

7. Limitation of Liability

To the maximum extent permitted by law, Byte Craft Enterprises shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to health issues, personal injury, data loss, or financial loss resulting from your use of or inability to use the App. The App is provided on an "AS IS" and "AS AVAILABLE" basis.

8. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the App following the posting of any changes constitutes acceptance of those changes.
