Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Habits mobile application (the "Service" or "App") operated by Niccolò Luciani ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. License to Use
We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with these Terms. The App is licensed, not sold, to you for use only under the terms of this license. We reserve all rights not expressly granted to you.

2. Service Description and Functionality
Habits is a utility application designed to enhance user productivity via a home screen widget.

• Predictive Functionality: The App analyzes usage patterns locally to predict and display the specific applications likely to be most useful to the user at the current moment. You acknowledge that these predictions are based on statistical estimates and probabilistic models; therefore, we do not guarantee the accuracy or relevance of the suggestions provided at any specific time.

• Local Data Accumulation: To improve prediction accuracy, the App stores historical usage data locally on your device for an extended period.

• System Requirements: To perform these predictions, the App requires specific Android permissions ("Usage Access").

• Availability: We do not guarantee that the App will be compatible with all devices or operating system versions. The functionality relies on Android system APIs, which may change in future updates.

3. User Responsibilities
By using the App, you agree not to:

• Use the Service for any unlawful purpose or in any way that violates these Terms.

• Attempt to reverse engineer, decompile, or disassemble the App.

• Exploit the App in any unauthorized way whatsoever.

Data Security and Export/Import:
Since the App processes and stores data locally on your device:

• You are solely responsible for the security of your device and the data stored therein.

• Regarding the Data Export/Import feature: You are solely responsible for the custody, security, and integrity of the binary files exported from the App. We are not liable for any data loss, corruption, or privacy breach resulting from your handling of these files once they are exported from the App's protected storage (e.g., storing them on cloud services or transferring them to other devices).

• Uninstalling the App: You understand that uninstalling the App will permanently delete the local database and the accumulated history used for predictions.

4. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of the developer. The Service is protected by copyright and other laws of both Italy and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the developer.

5. Privacy Policy
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect (locally), use, and safeguard the information that results from your use of the Service.

6. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may terminate these Terms at any time by uninstalling the App and ceasing all use of the Service.

7. Limitation of Liability
In no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, loss of data (including the historical usage database), use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

The developer does not warrant that:
a) the Service will function uninterrupted, secure, or available at any particular time or location;
b) any errors or defects will be corrected;
c) the results of using the Service will meet your requirements;
d) the predictive models will accurately reflect your future behavior;
e) the data exported via the backup function will be compatible with future versions of the App.

9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
