These Legal Terms establish a binding agreement between you, whether individually or on behalf of an entity ("you"), concerning your access to and utilization of the Services. By accessing the Services, you acknowledge that you have read, understood, and consent to adhere to all these Legal Terms. IF YOU DISAGREE WITH ANY PART OF THESE LEGAL TERMS, YOU MUST NOT USE THE SERVICES AND SHOULD CEASE USAGE IMMEDIATELY.
Additional terms and conditions or documents posted on the Services periodically are specifically incorporated into these Legal Terms. We reserve the right, at our sole discretion, to modify or alter these Legal Terms for any reason and at any time. Any changes will be communicated by updating the "Last Updated" date of these Legal Terms. It is your responsibility to periodically review these Legal Terms to stay informed about any updates. Your continued use of the Services after any revised Legal Terms are posted signifies your acceptance of such changes.
Antique Scan allows you to capture or select a photo of an antique item and receive an AI-generated identification result, including estimated category, historical background, materials, condition assessment, and an estimated market value range. The App does not require account registration or login.
The information and identification results provided through the Services are not intended for distribution or use by any person or entity in any jurisdiction or country where such distribution or use contravenes the law or regulations or requires our registration within that jurisdiction or country. Individuals who access the Services from other locations do so at their own discretion and are solely responsible for compliance with local laws.
The identification results, historical information, condition assessments, and estimated market values generated by the App are produced by an AI-based image recognition service and are provided for general informational and entertainment purposes only.
Do NOT constitute a certified, professional, or legally binding appraisal of any item.
Should NOT be relied upon for insurance, sale, purchase, tax, estate planning, or any other legal or financial decision.
May contain inaccuracies, as AI-based identification has inherent limitations and cannot guarantee correctness.
We strongly recommend that you consult a qualified, licensed appraiser before making any financial or legal decision regarding an antique or collectible item.
We are the rightful owner or licensee of all intellectual property rights within our Services. This encompasses source code, databases, functionality, software, application designs, application layouts, text, and graphics found in the Services (referred to as the "Content"), along with trademarks, service marks, and logos (collectively known as the "Marks") present therein.
The Content and Marks are protected by copyright and trademark laws, as well as various other intellectual property rights and unfair competition laws globally.
Your Use of Our Services
In accordance with your compliance with these Legal Terms, including the "PROHIBITED ACTIVITIES" section, we grant you a non-exclusive, non-transferable, revocable license to:
Access and download the App.
Use the App to capture or select photos and receive identification results.
Save identification results locally on your own device in accordance with the App's features.
Except as stated in these Legal Terms, no part of the Services, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise utilized for any commercial purpose without our explicit prior written consent.
Ownership of Your Photos
You retain full ownership of any photos you capture or upload to the Services ("User Photos"). By submitting a User Photo for identification, you represent and warrant that:
You own the photo or otherwise have the necessary rights to submit it.
The photo does not infringe upon the intellectual property, privacy, or other rights of any third party.
The photo does not contain content that is illegal, harmful, or that identifies other individuals without their consent.
Processing of Your Photos
To generate an identification result, your photo is transmitted to a third-party AI recognition service for processing, as described in our Privacy Policy. We do not claim ownership over your photos or the resulting identification data. Photos and identification results are stored locally on your device; we do not retain a copy on our own servers.
By utilizing the Services, you warrant and affirm that:
You possess the legal capacity and consent to abide by these Legal Terms.
You are at least 13 years of age (or the applicable minimum age in your jurisdiction).
You will not access the Services through automated or non-human methods, such as bots or scripts.
You will not utilize the Services for any illegal or unauthorized purpose.
You are prohibited from:
Systematically extracting data, results, or content from the Services (scraping) to train other AI models or build competing databases.
Circumventing, disabling, or interfering with security features of the Services, including scan limits, subscription checks, or download restrictions.
Uploading photos containing illegal, harassing, hateful, harmful, defamatory, obscene, or threatening content.
Attempting to reverse-engineer, decompile, or disassemble any of the software or AI recognition systems used to run the Services.
Using the App's identification output to falsely represent an item's authenticity, origin, or value for fraudulent commercial purposes (e.g., misrepresenting an item to a buyer based solely on unverified AI results).
Engaging in improper use of our support services.
Premium Subscription: Certain features, including unlimited scans and an ad-free experience, require a paid Premium subscription. Subscriptions are offered on a Monthly or Yearly basis and automatically renew unless canceled before the end of the current billing period.
Free Trial: The Yearly subscription may be offered with a free trial period. If you do not cancel before the trial ends, you will automatically be charged the applicable Yearly subscription fee. Free trial eligibility is determined and managed by Google Play; each user is generally eligible for one free trial per subscription.
Billing Platform: All purchases, renewals, and cancellations are processed entirely through Google Play Billing and are subject to Google Play's own payment terms and policies. We do not collect or store your payment card details.
Cancellation: You may cancel your subscription at any time through your Google Play account settings. Cancellation will take effect at the end of the current billing period; no partial refunds are provided for the remaining period unless required by applicable law.
Refunds: All subscription purchases and renewals are generally non-refundable, except as required by applicable law or Google Play's refund policies.
Price Changes: We reserve the right to change subscription pricing at any time. Any price changes will not affect your current billing cycle and will only apply to subsequent renewals, subject to Google Play's notification requirements.
Free-tier users of the App will see advertisements served through Google AdMob. Premium subscribers will not see advertisements while their subscription is active. We are not responsible for the content of third-party advertisements displayed within the App.
These Legal Terms remain in full effect while you use the Services. We retain the right, at our sole discretion and without notice or liability, to deny access to and use of the Services to any individual for any reason, including without limitation for breach of these Legal Terms.
We may discontinue or restrict access to the Services at any time if we detect fraudulent activity, abuse of scan limits, or violation of these Legal Terms.
We reserve the right to change, modify, or remove any content or features within the Services at our discretion and for any reason without notice.
We cannot guarantee continuous availability of the Services. The identification feature depends on a third-party AI recognition service and internet connectivity; interruptions, delays, or unavailability of this third-party service may affect your ability to use the Services. We will not be held liable for any loss, damage, or inconvenience due to your inability to access or use the Services during downtime.
Governing Law
These Legal Terms are governed by and construed in accordance with the laws of Vietnam.
Dispute Resolution
Informal Negotiations: The parties agree to engage in informal negotiations for at least fourteen (14) days before initiating formal proceedings.
Binding Arbitration: Any dispute arising from or related to these Legal Terms shall be referred to and finally resolved by arbitration under the VIAC (Vietnam International Arbitration Center) Rules. The place of arbitration shall be Vietnam. The language of the arbitration shall be Vietnamese. The governing law of these Legal Terms shall be the substantive law of Vietnam.
Exclusions: Disputes related to intellectual property rights or claims for injunctive relief are not subject to the arbitration agreement.
12. DISCLAIMER
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." YOU AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO WARRANTIES ABOUT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY IDENTIFICATION RESULT, HISTORICAL INFORMATION, OR ESTIMATED VALUE GENERATED BY THE APP. WE WILL NOT BE LIABLE FOR ANY FINANCIAL LOSS, MISREPRESENTATION, OR DISPUTE ARISING FROM YOUR RELIANCE ON AI-GENERATED IDENTIFICATION RESULTS.
13. LIMITATIONS OF LIABILITY
IN NO EVENT SHALL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION.
